RESOLUTION 2006-41
APPROVING FINAL PLAT AND DEVELOPMENT CONTRACT FOR "RUSH
CREEK MEADOWS" FOR NORTHSTAR INVESTMENTS, LLC, PROPERTY
LOCATED ON THE NORTHEAST CORNER OF CAIN ROAD AND COUNTY
ROAD 30
WHEREAS, Northstar Investments, LLC has requested approval of a final plat to
allow the creation of 7 lots on the 101.75-acre property legally described as
follows:
The northwest Quarter of the Northwest Quarter, the West half of the
Southwest Quarter of the Nortwest Quarter all in Section 11, Township
119, Range 23, and the Southwest Quarter of the Southwest Quarter of
Section 2, Township 119, Range 23, Hennepin County,Minnesota.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF CORCORAN, MINNESOTA, that it should and hereby does
approve the request by Northstar Investments, LLC for a finai plat for Rush Creek
Meadows and,
FURTHER, that the development contract for said plat shall be completed by the
City Attomey and the Mayor and that the City Administrator be authorized to
execute the development contract on behalf of the City; and
FURTHER, that the following conditions be met prior to release of the final plat
for recording with the County:
1. A final plat is approved to create 7 lots in accordance with the plans and
application received by the City on April 26, 2006 and the revised plans
received by the City on May 31, 2006, June 26, 2006 and July 6, 2006,
except as amended by this resolution.
2. Development standards shall be according to the RR (Rural Residential)
zoning district standards.
3. The developer shall comply with all conditions of preliminary plat
(Resolution # 2006-14) approval, except item # 6, which was removed at
the request of the Elm Creek Watershed Management Commission.
4. Three building rights remain on Lot 7, but any future development must
comply with ordinance standards.

5. The development contract must be executed by the developer and the
City and must be filed with the final plat.
6. Drainage and utility easements shall be provided over and across all
wetlands. A drainage and utility easement shall also be provided to
include and connect the culvert on Lot 4 with the small wetland, as shown
on the final development plans.
7. The applicant shall revise the final plat to extend the drainage and utility
easement over the wetland located on the park land and over the FEMA
mitigation being provided on the park land.
8. Wetland buffer plantings are required. The applicant must either:
a. Prove that the native vegetation within the wetland buffer complies
with Section 1050.010, Subd. 8 or
b. Plant the wetland buffer with a native plant seed mix that complies
with Section 1050.010, Subd. 8
9. The applicant must provide at least one overstory tree per dwelling unit, as
shown on the final development plans.
10.The applicant shall revise the final grading, landscape and erosion control
plan to:
a. Show the building setback from the wetland buffer on the park land.
b. Relocate the wetland buffer line on the park land to place the
required buffer outside of the FEMA mitigation area.
c. Provide wetland buffer and building setbacks around all the
wetlands located on Lot 7.
d. Provide wetland buffer monument signs in compliance with Section
1050.010, Subd. 7 of the Zoning Ordinance. Specifically:
i. The wetland buffer monuments currently shown on the plans
shall be relocated to be placed exactly on the proposed lot lines
and at every jog in the buffer line, to indicate the contour of the
buffer.
ii. Additional wetland bufFer monument signs shall be placed near
the public park and around all the wetlands in Lot 7, to comply
with Ordinance requirements.

e. Show the location of the silt fencing around the wetlands.
f. Identify the spruce as 4� feet in height versus 2'h inches in caliper.
11.The title page of the final plat shall be revised to reflect the park dedication
and to acknowledge the wetlands on site.
12.Park dedication shall be as follows:
a. The applicant shall dedicate the park to the City of Corcoran. Park
dedication credit shall be granted based on the net area. Net area
is defined as gross area minus wetlands, areas below the 100-year
Ordinary High Water Elevation (OHWE) and right-of-way or
easements for existing public streets. The FEMA mitigation area
must be deducted from the gross land area.
b. The applicant shall dedicate a 20-foot trail easement from Cain
Road through the proposed public park to the east property line as
shown on the Parks and Trails Map. Park dedication credit shall be
granted for the net area of this trail easement.
c. The applicant shall provide detailed calculations of the gross and
net areas for the park and trail easements for City review and
approval.
d. Park dedication shall be due prior to release of the final plat and
shall be satisfied by cash-in-lieu of land based on the park
dedication requirements in effect at the time of release of the final
plat. Credit shall be given for the net area of the park and trail
dedication described above.
13.The applicant will be required to construct the on-road trail along the east
side of Cain Road as part of the street project.
14.The applicant shall revise the plans to meet the City storm water rate and
quality control requirements.
15. The applicant shall comply with all requirements of the City Engineer's
memo, dated December 22, 2005.
16.The applicant shall comply with all recommendations of Brad Schleeter's
storm water memo dated November 21, 2005.
17.The application shall provide the approved final plat in an electronic
format.

FURTHER, that the following conditions be met prior to issuance of building
permits:
1. The primary and secondary septic sites shall be staked and fenced prior to
beginning any construction on site. The septic sites must be individually
fenced with steel posts and snow fencing, which must be left in place until
issuance of a Certificate of Occupancy.
2. The Building Inspector must approve the soil percolation tests and septic
system designs.
3. All drainage and utility easements shall be staked, surveyed and properly
recorded prior to beginning any work on site.
4. All permanent wetland buffer monument signs must be erected along the
wetland buffer line as required by Section 1050.010, Subd. 7 of the City
Code. The final locations must be inspected and approved by City staff.
5. The applicant must file the final plat at Hennepin County within 2 years of
the date of approval or the approval shall expire.
6. The approved trail easement document for the off-road trail must be filed
with the final plat at Hennepin County.
