HomeMy WebLinkAboutRES 2006-39 APPROVING PRELIMINARY PLAT FOR MARILYN BINA FOR "BINA MEADOWS" ON PROPERTY LOCATED AT 6890 COUNTY ROAD 19 �r' � CITY OF CORCORAN RESOLUTION 2006- 39 APPROVING PRELIMINARY PLAT FOR MARILYN BINA FOR "BINA MEADOWS" ON PROPERTY LOCATED AT 6890 COUNTY ROAD 19 WHEREAS, Marilyn Bina has requested approval of a preliminary plat to create three lots on the property legally described as follows: The west 46 2/3 acres of the Northeast Quarter of Section 31, Township 119, Range 23, Hennepin County, Minnesota. Except therefrom that parcel described in Document Number 4888896 in the office of the County Recorder. Also, except Pioneer Trail and County State Aid Highway Number 19. WHEREAS, the Planning Commission has reviewed the preliminary plat at a duly called Public Hearing and recommends approval, and; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORCORAN, MINNESOTA, that it should and hereby does approve the request by Marilyn Bina for a preliminary plat, subject to the following findings and conditions: 1. A preliminary plat is approved to allow the creation of three lots in accordance with the plans and application received by the City on May 22, 2006; and revisions received on June 15, 2006 and except as amended by this resolution. 2. The property was approximately 27-acres in size when the City's development rights program was established in 1981. The 27-acre parcel had 3 building rights. Recently, Hennepin County acquired additional right-of- way, which reduced the parcel size to 24.37 acres, but did not reduce the number of existing development rights. The existing single family home counts towards 1 of the development rights and there are 2 development rights remaining. 3. Prior to release of the final plat for filing with the County, the applicant shall: a) Dedicate a 10 foot-wide trail easement adjacent to Pioneer Trail (over the drainage and utility easement) to the City. b) Submit trail easement documents for review and approval by the City Attorney. Resolution 2006-39 Page 2 c) Pay the park dedication fees for the 2 new lots, subject to the park dedication requirements at the time of release of the final plat for filing. i. Park dedication credit shall be given for the net area of the land within the trail easement. d) The existing septic system must be inspe�ted by the City Building Inspector to ensure that the system is not a failing system that poses an imminent health threat. If the system is failing and poses an imminent health threat, it must be replaced in compliance with City and State regulations. e) Revise the plat to provide a drainage and utility easement over all wetlands. f) Revise the plat to identify any drain tile locations on site. A drainage and utility easement should be provided over any drain tiles. g) Comply with all conditions in the City Engineer's memo dated June 26, 2006. h) Obtain approval of the wetland delineation for the site from the Elm Creek Watershed Management Commission. 4. Prior to issuance of a building permit; #he applicant shall: a) Submit grading and erosion control plans for the proposed house pads and driveways on Lots 2 and 3, Block 1. b) Install wetland buffer monument signs on-site prior to beginning any work on site. c) Submit final septic system designs for review and approval by the Building Official. d) Stake, survey and properly record all drainage and utility easements prior to beginning any work on site. e) Stake both the proposed and alternative septic sites with steel posts and snow fencing prior to beginning any work on site, which must be left in place until issuance of a Certificate of Occupancy.
