HomeMy WebLinkAboutRES 2006-28 APPROVING PRELIMINARY PLAT FOR LEE CORNELIUS FOR "OAK RIDGE FARM 3RD ADDITION" ON PROPERTY LOCATED WEST OF COUNTY ROAD 116 AND EAST OF BLUE BONNET DRIVE Ciry of Corcoran County of Hennepin State of Minnesota CITY OF CORCORAN RESOLUTION 2006-28 MOTION BY: Grabowski SECONDED BY: Thomas APPROVING PRELIMINARY PLAT FOR LEE CORNELIUS FOR "OAK RIDGE FARM 3RD ADDITION" ON PROPERTY LOCATED WEST OF COUNTY ROAD 116 AND EAST OF BLUE BONNET DRIVE WHEREAS, Lee Cornelius has requested approval of a preliminary plat to aliow 2 lots on the 54.83-acre property legally described as follows: Lots 1 — 2, Block 1 and Outlot A, Oak Ridge Farm Second Addition, according to the recorded plat thereof, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed the preliminary plat at a duly called Public Hearing and recommends approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORCORAN, MINNESOTA, that it should and hereby does approve the request by Lee Cornelius for a preliminary plat, subject to the following conditions: 1. The preliminary plat is approved to allow the reconfiguration of 2 lots and an outlot into 2 lots, in accordance with the application received by the City on April 17, 2006 and revisions received on May 9, 2006, except as amended by this resolution. 2. The preliminary plat is approved contingent upon the approval of the vacation of the drainage and utility easements associated with the existing Lot 2. The applicant shall submit an application for vacation of the drainage and utility easement for review and approval by the City Council prior to release of the final plat for filing with the County. 3. Prior to release af the final plat for filing with the County, the applicant shall: a) Either provide proof that the existing septic system on Lot 1 complies with Rule 7080 and City standards or provide revised plans, soil borings and perc tests for a new primary and secondary septic. A certified inspector must approve the existing septic system to ensure compliance with these Resolution 2006-28 Page 2 standards. If the existing system on Lot 1 does not comply, the septic system must be replaced prior to release of the final plat for recording. b) Submit soil borings for a secondary site on Lot 1 and revise the preliminary plat to show the proposed location of the secondary septic site. c) The subject property is located in the shoreland overlay district for a Rush Creek tributary. The plans must be revised to identify the location of the creek and the shoreland district boundary as required by Section 1050 of the Zoning Ordinance. Future development on Lot 2 will be subject to the shoreland overlay district requirements. d) Revise the plat to show the septic setback from the new Blue Bonnet Drive right-of-way on Lot 2. e) Revise the plat to provide a drainage and utility easement over all wetlands. f� Revise the plat to identify any drain tile locations on site. A drainage and utility easement shall be provided over any drain tiles. g) Revise the plat to show the 20-foot easement for an off-road trail along the south side of Lot 1. h) Revise the plat to dedicate a 33-foot wide half right-of-way along the east side of Blue Bonnet Drive. i) Comply with all conditions in the City Engineer's memo dated May 23, 2006 . j) Obtain approval from the Elm Creek Watershed District. k) Revise the plans to provide a 60-foot easement to the City for public street purposes, extending across Lot 1 from the southern cul de sac of Oak Ridge Drive to the western lot line of Lot 1. 4. Prior to issuance of a building permit, the applicant shall: a) Submit final septic system designs on Lot 2 for review and approval by the Building Official. b) Install wetland buffer monument signs on-site prior to issuance of building permits on Lot 2. . Resolution 2006-28 Page 3 c) Stake, survey and properly record ail drainage and utility easements prior to beginning any work on site. d) Stake both primary and secondary septic sites prior to beginning any construction on site. 5. Because no new parcels are being created, park dedication is not required at this time. The new Lot 2 shall be replatted in order to be developed with more than one single-family home and park dedication will be required according to the ordinance in effect at that time.
