HomeMy WebLinkAboutRES 2006-11 APPROVING PRELIMINARY PLAT FOR ERIC AND STEPHANIE SARI FOR "OVERLAKE BLUFFS" ON PROPERTY LOCATED WEST OF ROLLING HILLS ROAD AND NORTH OF HORSESHOE TRAIL . , . � 4 � iy City of Co�oran Counry of Henr►epin State of Minnesota CITY OF CORCORAN RESOLUTION 2006-11 MOTION BY: Thomas SECONDED BY: Grabowski APPROVING PRELIMINARY PLAT FOR ERIC AND STEPHANIE SARI FOR °OVERLAKE BLUFFS" ON PROPERTY LOCATED WEST OF ROLLING HILLS ROAD AND NORTH OF HORSESHOE TRAIL WHEREAS, Eric and Stephanie Sari has requested approval of a preliminary plat to allow the creation of 9 lots and 3 outlots on the 60.93-acre property legally described as follows: Government Lot 4, except that part of the East 445 feet thereof lying South of the North 583.17 feet and North of the South 252 feet thereof, Se�tion 32, Township 119, Range 23, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed the preliminary plat at a duly called Public Hearing and recommends approval, and; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORCORAN, MINNESOTA, that it should and hereby does approve the request by Eric and Stephanie Sari for a preliminary plat, subject to the following conditions: 1. A preliminary plat is approved to allow the creation of 9 lots and 3 outlots, in accordance with the revised plans and application received by the City on February 8, 2006, except as amended by this resolution. 2. Approval of the preliminary plat is contingent upon approval of the conditional use permit. 3. A copy of the Homeowners Association Documents must be provided which clearly defines the rights and responsibitities of the Homeowners Association. The revised HOA documents must be submitted for review and approval by the City Attorney prior to final plat. The Homeowners Association shall be responsible for maintenance of the common outlots B and C. ` , Resolution 2006-11 Page 2 4. The open space shall be preserved in perpetuity. A conservation easement over the permanent open space is required to be submitted for review and approval by the City Attorney prior to final plat. 5. The applicant shall dedicate Outlot A to the City as permanently preserved open space. 6. In addition to the dedication of Outlot A to the City as part of the OSP plat, the applicant shall be required to pay park dedication fees determined by the Parks Commission. Park dedication cash shall be subject to the park dedication fees in place at the time of filing the final plat and is due prior to release of the final plat. 7. All debris must be removed from Outlot A prior to dedication of the land to the City of Corcoran with the final plat. 8. The plans shall be revised to provide a trail section connecting the proposed trail in Outlot A to the new public loop street. 9. The developer shall provide a 20-foot trail easement over the main trail loop in Outlot A and dedicate the trail and the 20-foot trail easement to the City. The trail should connect to the dock area adjacent to the lake. 10.Park dedication credit will be given for construction of the trail through Outlot A. 11.The developer shall construct the trail within the dedicated trail easement in the adjacent Lake Jubert Estates and be reimbursed for the cost of this construction. The trail shall be staked for City inspection prior to beginning construction to minimize impacts to trees and other natural resources. 12.The developer shall construct the trailhead parking in Outlot A to City standards. The developer shall submit plans with the final plat application for review and approval by the City. Park dedication credit will be given for constructing the trailhead parking area. 13.The applicant must submit final septic system designs for review and approval by the Building Official prior to the issuance of building permits. 14.The septic sites must be individually fenced with steel posts and snow fencing, which must be left in place until issuance of a Certificate of Occupancy. , � , � Resolution 2006-11 Page 3 15.The applicant shall comply with the Wetland Conservation Act and shall receive Elm Creek Watershed approval prior to final plat approval. 16.The basement for Lot 1, Block 4 is proposed at a 1011 elevation. The overflow for wetland 4 appears to also be at a 1011 elevation. The walkout elevation for this home should be a minimum of 2 feet above the wetland overflow eleva#ion. 17.The 15-foot wetland structure setback, the location of the monument signs and the 25-foot average wetland buffer must be shown on the plans. 18.The developer must instalt wetland buffer monument signs on-site. 19.A11 drainage and utility easements must be staked, surveyed and properly recorded prior to beginning any work on site. 20.The developer will be required to pay an Area Charge for the improvements of collector roads outside the MUSA boundary. The preliminary area charge is estimated by the City Engineer at $2,000 per acre, which equates to $91,540. Payment shall be due prior to release of the final plat for filing. 21.The applicant shall be required to construct the new public loop street. The improvements shall be at the developer's expense and in compliance with City street standards. 22.The property has deferred assessments from the previous Rolling Hills Road improvement project. The assessments will need to be paid in addition to the Area Charges. Payment shall be due prior to filing the final plat. 23.A sign plan shall be submitted prior to final plat to ensure compliance with sign standards. 24.The landscaping plan must provide one overstory tree per residential unit. 25.A tree preservation plan must be submitted prior to beginning any grading on-site. The tree preservation plan should identify the existing wood lot, identify the sizes and species of any large trees on the site and indicate which trees are to be removed. The tree plan should show the timits of the proposed grading activity near any large tree or woodlot to be preserved and identi�fy the tree protection fencing. . . � . � Resolution 2006-11 Page 4 26.The developer must provide written conformation that the landowner of Lot 11 Biock 1 of Lake Jubert Estates agrees to vacate the existing easement to Rolling Hills Road before the final plat will be approved. If an arrangement cannot be worked out with the adjacent property owner, then Outlot C should be divided betwe�n the two proposed residential lots on- site. 27.The developer should ensure that a 40-foot tuming radius is provided on Outlot C. 28.The existing conditions sunrey shall be revised to identify the drain tile locations on site. 29.The final plans must also identify the drain tile location and maintain drainage through the site. 30.A drainage and utility easement must be provided over the drain tiles. 31.The applicant must comply with all conditions in the City Engineer's memo dated February 10, 2006.
