HomeMy WebLinkAboutRES 2006-01 IDENTIFYING FINDINGS FOR THE DENIAL OF A CONDITIONAL HOME OCCUPATION LICENSE FOR TERRY SAVOIE AT 21801 City of Corcoran County of Hennepin State of Minnesota RESOLUTION 2006-01 Motion By: Thomas Seconded By: Lymangood A RESOLUTION IDENTIFYING FINDINGS FOR THE DENIAL OF A CONDITIONAL HOME OCCUPATION LICENSE FOR TERRY SAVOIE AT 21801 HOMESTEAD TRAIL WHEREAS, Terry Savoie at 21801 Homestead Trail has applied for a Conditional Home Occupation License, (CHOL);and WHEREAS,a hearing was held on November 17,2005,as required by Ordinance; and WHEREAS, the ordinance states that the Commission shall consider certain standards and criteria when reviewing a CHOL;and THEREFORE,BE IT RESOLVED,that the City of Corcoran does hereby identify the following as findings for the denial of the Home Occupation License application submitted by Terry Savoie: FINDINGS: 1. The current use is presently illegal under the existing zoning ordinance. 2. Testimony established that the use is incompatible with the residential neighborhood because: � Industrial uses not permitted in a residential area. • Deliveries of lumber and roofing materials by large trucks,excessive for a residential neighborhood. • The noise of nail guns and saws. • The site lines of the outside storage of building materials and sheds 3. It is the City's responsibility to protect the health, safety,and general welfare of its residents; and therefore,without contrary testimony finds this use to be incompatible with the surrounding residential neighborhood. CONDITIONS: 1. The City has deferred enforcement to give the resident six months from December 1,2005 to cease operations. 2. No signage is allowed. 3. No acceleration of the business allowed for the next six months.
