No.'s 28-119-23-43-0007 WHEREAS, Terry and Karen Savoie have requested approval of a final plat to create t�vo �2) lots on the property legally described as follows: "The West 1/2 of the Northeast 1/4 of the Southwest 1/4 of the Southeast �/4 of Section. 28, Township 119 North, Range 23 West of the 5t" Principal Meridian, Hennepin County, Minnesota; and The South 1/2 of the No�th 1/� of the East 1/4 of the Southwest 1/4 of the Southeast '/4 of the Southeast �/4 of Section 28, Township 119 North, Range 23 West of the 5"' Principal Meridian, Hennepin county, Minnesota; and The East 1/2 of the West 1/2 of the Southwest North, Range 23 West of the Sty' Principal Meri 1/4 of the Southeast 1/� of Section 28, Township 119 than, Hennepin County, Minnesota" NOW, THEREFORE, BL I� RESOLVED BY THE CITY COUNCIL 01� THE CITY OF CURCORAN, MINNESOTA, that IL should and hereby does approve the request by Terry and Karen Savoie for a final plat, and FURTHER, that the Mayor anal City Clerk are authorized. to execute the final plat on behalf of the City; and FURTHER, that the final plat shall be subject to the following findings and conditions: l . A final plat is approved to allow the creation of Lots plans and application received by the City on DecE 1 and 2, Block. 1 nber 11, 2007 , in accordance 2. There are zero (U) building entitlements remaining for future development on Lots 1 Block 1, Savoie Fields. 3. All conditions of the preliminary plat must be met. 4. The applicant shall comply with all comments received from Bonestroo, the Elm Creek Water Management Commission, and the Hennepin County Human Services Department. 5. Prior to release of the final plat, the Developers shall satisfy the amount of the Transportation Area Charge by submitting an irrevocable letter of credit in the amount of $8,000 to the City in a form acceptable to the City. The letter of credit shall remain in place for a period of one-year from the date of submission and shall be payable at the bank issuing the letter upon presentation by the City, whether in person or by mail, of a signed statement evincing the assessment of the charge. All costs associated with obtaining the letter of credit shall be paid by the Developer. ��, prior to release of the final plat, the Developers shall pay Park Dedication fees for the one (1) lot, subject to the park dedication requirements at the time of the release of the final plat for filing. Currently the "cash" donation would total $6,000, 7. The applicant must file the final plat at Hennepin County. 8. The existing garage along the south line of Lot 1, which encroaches upon the dedicated drainage and utility easement, is a non -conforming structure and subject to partial or complete demolition without compensation if necessary to effectuate the use of the aforesaid easement.
