City Council Work Session Minutes
April 14, 2022 – 5:30 pm
The Corcoran City Council met on April 14, 2022, in Corcoran, Minnesota. The City Council work session
meeting was held in person and the public was present in person and remotely through electronic means using
the audio and video conferencing platform Zoom.
Mayor McKee, Councilor Nichols, Councilor Schultz, and Councilor Vehrenkamp were present. Councilor
Bottema was excused.
Interim City Administrator Beise, Deputy Clerk Friedrich, and City Planner Lindahl were present.
1.Call to Order / Roll Call
Mayor McKee called the work session to order at 5:30 pm.
2.Code Enforcement Review and Priorities for 2022
Interim City Administrator Beise reviewed the recent history of code enforcement noting prior to 2019 code
enforcement action was initiated through complaints. Interim City Administrator Beise reviewed the code
enforcement change effective in 2019 reflected a proactive code enforcement approach initiated by the City
with annual priorities identified, along with reviewing of complaints. Interim City Administrative Beise
reviewed the current Council approach to code enforcement effective in 2021 included pausing the
proactive approach, however allowing the existing violations currently in process to continue, resuming to
the complaint-based approach regarding code enforcement activity. Interim City Administrator Beise
reviewed the current budget and previous council priorities. Council discussed obstruction and construction
debris violations and focusing on new construction developments and adhering to code. City Planner
Lindahl noted discussion of Stantec inspections monitoring as engineers are normally on -site. Council and
staff discussed options available to identify debris within stormwater ponds and adding service to future
Stantec inspections. Council noted including general police site inspections, all staff, and contracted service
staff involvement when driving by a development with noticeable violations. Council discussed next steps
available from an administrative function once a violation is present and confirmed. Council and staff
discussed notification and educational piece included within the quarterly news letter. Council and staff
discussed confidentiality of resident complaint-based system and clarifying when complaint is considered a
consent to review violation. Council discussed independent city -based evidence on resident complaint to
confirm violation. Council noted including a form of instruction for anonymous complaints. Council and staff
discussed City process for assisting residents in property clean up with violations, and measurable
standards and timelines. Council and staff discussed liabilities and costs associated with removing junk
vehicles. Council and staff discussed remediation in situations where debris blows onto public property,
individual property, and stormwater areas. Council discussed the responsibility of debris clean up regarding
accepted, newly constructed areas by the City. Staff noted process of notification to property owners of
code compliance violation, language within the violation, and tracking ability processes. Council noted
systemic, high-density construction areas and safety issues as priorities, and subjectivity of properties in
rural areas with no available site-lines from the road. Council discussed responsibility of builder to clean up
construction debris at the end of every day and include as a stipulation in the deve lopment contract
agreement, at certificate of occupancy debris will be removed, and implementing an expectation at the pre-
construction meetings of daily construction debris clean up. Council discussed ordinance changes for
repeated violations, and fines associated with repeated violations. Council reviewed signs within right -of-
way, specifically commercial advertisement signs, the public safety issue related to location of signs, and
processes for sign removal. Interim City Administrator Beise summarized Council direction regarding code
enforcement includes complaint based by resident, a focus on sign enforcement within right -of-ways, and
overall site violations apparent to staff that are egregious or multiple, construction debris , high incidence
neighborhoods, and blocked sidewalks. Council noted prioritizing ordinances by level of offense with sweep
focuses and reviewing historical, reported violations . City Planner Lindahl noted identifying violation through
Council direction, for example tall grass or junk vehicles, noting a property could be flagged for several
violations, or a single, specific violation priority based upon Council direction. Council discussed violations
and complaints, status of Hennepin County court dates regarding violations, and focus on compliance for

the most offensive violations within the City. Council and staff discussed zoning action of code enforcement
versus police action and noted the difficulties of police staff enforcing abatement while also maintaining
public safety. Council discussed including code enforcement violation communication to residents within
the summer quarterly newsletter and monthly utility bills. Council directed staff in code compliance
enforcement goals for 2022.

The Corcoran City Council met on April 14, 2022, in Corcoran, Minnesota. The City Council meeting was held in

present.
Interim City Administrator Beise, Deputy Clerk Friedrich, Public Works Director Mattson, Director of Public
Safety Gottschalk, and Lieutenant Burns were present.

Mayor McKee called the meeting to order at 7:00 pm.

Mayor McKee invited all in attendance to rise and join in the Pledge of Allegiance.
3.Agenda Approval
Interim City Administrator Beise noted an additional claim to item 7e., under Consent Agenda, and the
addition of item 10f., Grant Support Resolution, under New Business. Council noted Council request to add
item 8a., Current Zoning of Area Surrounding the Larkin Road and County Road 116 substation property, to
allow for Council discussion. Council also requested moving existing 8a., Preliminary Plat, Site Plan and
Administrative Permit for “Corcoran II Substation” at Larkin Road and County Road 116 (City File 22-004) to
item 8b.

5.Open Forum (Public Comment Opportunity)
Mayor McKee invited residents to communicate in-person or telephonically during Open Forum. Interim
City Administrator Beise explained the instructions to participate in the meeting via the Zoom video format
and reviewed instructions for participation in the meeting through telephone or computer. No residents
participated in the public comment opportunity.
6.Presentations/Recognitions
a.Fire Department Annual Reports
Brad Feist, Fire Chief of Rogers, reviewed the communities served, mission statement, the 2021 annual
report, and briefly outlined post-COVID processes. Chief Feist noted department inspection and permit
activity, fire prevention program improvements, and public relation events. Chief Feist noted equipment and
training completed. Chief Feist noted increased calls for faulty smoke detectors, calls by time-of-day, fire
and EMS activity calls in 2021, with 81 response calls in Corcoran. Chief Feist noted 51 percent of the calls
were medical response calls in Corcoran, with the remainder falling under faulty smoke detectors, rescue
personal injury, fires, hazardous condition, service calls, and good intent calls. Chief Feist reviewed calls for
mutual aid. Chief Feist reviewed staffing, delivery of a new fire truck, land for a new fire station near the
Rogers High School north of County Road 101.
Council and staff discussed type of vehicles used for EMS calls, noting smaller vehicles are utilized versus
full fire trucks. Council and staff noted EMS capacity and targeting peak times and utilizing light-duty pickup
vehicles in future fire services discussions. Council discussed physical and mental health of firefighters and
post-fire discussions regarding traumatic fire incidents, and analysis and implementation discussion for

future fire service needs. Hanover Fire Chief Malewicki noted sponsorship of a suicide prevention coin by
the Hanover Fire Department to raise awareness within local communities.
Dave Malewicki, Hanover Fire Chief, reviewed the 2021 annual report, noting community involvement
events, call history, with highest call volume received for medical assistance. Fire Chief Malewicki noted 35
calls were received for Corcoran. Fire Chief Malewicki reviewed staffing increases, department training
completed, and total service hours by the Hanover Fire Department totaling 2,639.65, with 3,095 individual
responses.
Jeff Leuer, Loretto Fire Chief, reviewed the Loretto Fire Department 2021 report, calls by days of the week,
service hours, response times for fire trucks, mutual aid participation, and noted medical calls were the
highest calls received. Chief Leuer noted number of response times under 5 minutes, 6-10 minutes, and
over 10 minutes. Chief Leuer noted total firefighter hours for 2021 of 9,787 hours. Chief Leuer publicly
thanked an anonymous Corcoran resident for a donation of $16,000 for a lifesaving, Lucas machine. Chief
Leuer reviewed the department’s 2021 purchases, donations, highlights of training, event participation, and
fire instruction. Chief Leuer reviewed mental health counseling assistance available to firefighter service
members and their families. Chief Leuer noted a consolidation possibility with the Hamel Fire Department.

Council discussed item 7g., City Hall Remodel Pay Request 9, and inquired how many remaining pay
requests are remaining. Council and discussed noted repair and replacement of Council camera and sound.
Council noted the project was completed with an overage of two percent. Interim City Administrator Beise
noted the pay request is for HVAC additions to cool the server room, and to control and balance the
temperature between separate workspaces and rooms.

Council discussed item 7h., thanked the NW Area Jaycees for their continued support and donation of
$1,065.00 for the Parks and Trails Commission annual tree give away event. Council thanked
Commissioner Anderson for all his work on the annual tree give away event.

8. Planning Business (Public Comment Opportunity)
Mayor McKee invited residents to communicate in-person or telephonically during the public comment
opportunity for Planning Business items 8a-b. Interim City Administrator Beise explained the instructions to
participate in the meeting via the Zoom video format and reviewed instructions for participation in the
meeting through telephone or computer.
Tim Sullivan, CEO WH Electric, reviewed current plans of City Code landscaping, minimum requirement of
31 trees, and inclusion of 76 trees, a 4-ft berm on north and west sides with barrier of 8-14 ft., and noted
current plans meets all sound and safety ordinances local, state, and federal. Mr. Sullivan noted the
substation will supply reliable power for decades to come. Mr. Sullivan opined meeting should be fact-
based, and non-germane issues that are unsubstantiated should not be allowed in discussion. Mr. Sullivan
reviewed responsibilities and requirements of electric company, noted what is at staked and asked for
Council’s approval and support.

Mark Lanterman, 6936 Oak Ridge Road, opined on Court Order highlighted in previous meeting has been
cured, with title transfer requirements, and opined on current City Code.
a. Zoning of Area Surrounding the Larkin Road and County Road 116 Substation Property
Council discussed potential of re-zoning parcels surrounding where the substation will be located, noted the
parcels of interest, with current zoning including mixed residential on east, downtown mixed use to north,
industrial on the west, and urban reserve guided medium density residential on the south. Council noted
review of zoning when substation construction is completed, will retain an industrial look, and noted a
mixed-use extension possibility of transition area. Council noted parcel review and allowable uses of
affected parcels. Council and staff discussed zoning use changes in the current Comprehensive Plan
without an applicant request and land use changes initiated by landowner.
b. Preliminary Plat, Site Plan, and Administrative Permit for “Corcoran II Substation” at Larkin Road
and County Road 116 (City File 22-004)
City Planner Lindahl outlined the current administrative permit for the substation and reviewed history of
Council and Commission meetings regarding the application. City Planner Lindahl outlined the current
parcel location is guided Mixed Residential, zoned Mixed Residential and noted essential services are
permitted in all zoning districts. City Planner Lindahl noted the original application referenced a location on
the south side of 19835 Larkin Road in 2021, however, the applicant withdrew the original application in
2021 to review alternate sites. City Planner Lindahl reviewed the recommendation by the Planning
Commission at the April 7 meeting to include five additional screening requirements.
MOTION: made by Bottema, to table item until ownership is transferred to Wright Hennepin Electric (WHE).
Motion fails due to lack of second.
Council and staff discussed the transfer of funds for the property scheduled for April 26, 2022. City Attorney
Thames noted WHE cannot take title according to law prior to April 26, and noted the Resolution presented
to Council is conditional upon WHE owning title of property. Council and staff discussed ownership of
property, willing and non-willing sellers, and PUD agreements prior to ownership transfers.
MOTION: made by Bottema, seconded by Schultz to table item until ownership is transferred to WHE.
Council and staff reviewed the 120-day application extension deadline of May 31, 2022, and the next
Council meeting of April 28 to review administrative permit. Council discussed the existing Court Order on
the parcel.

9. Unfinished Business (Public Comment Opportunity)
Mayor McKee invited residents to communicate in-person or telephonically during the public comment
opportunity for Unfinished Business. Interim City Administrator Beise noted no public comment cards were
received. Interim City Administrator Beise explained the instructions to participate in the meeting via the
Zoom video format and reviewed instructions for participation in the meeting through telephone or
computer. No residents participated in the public comment opportunity.
a. Water Supply Planning – Financial Analysis
Interim City Administrator Beise introduced Tammy Omdal.
Tammy Ohmdahl, Northland Securities, reviewed the long-term financials the Water Enterprise Fund
relating to the water treatment and storage project Council is considering. Ms. Omdal noted assumptions
for future development, impact on the projected revenue and expenses, and source of funds and timing for
capital improvements. Ms. Omdal noted projections indicate Water Fund would have sufficient cash to
meet obligations, both operating and future debt obligations. Ms. Ohmdahl noted assumptions of two to
three percent annual increase in users’ fees and changes, along with adoption of development changes at
level to pay for future improvements to support development. Ms. Omdal reviewed adopted TLAC charges
in 2020, the proposed TLAC change in 2022, and the estimated TLAC charges for 2023. Ms. Omdal
reviewed the TLAC charges for Northeast Corcoran and Southeast Corcoran. Ms. Omdal outlined the
Water Fund Finance Plan is based on achieving annual ending cash balances sufficient to meet specific
cash needs and include three months of operating cash, following year debt-service and planned pay-go
capital, and maintaining a reserve for future capital improvements. Ms. Omdal noted assumptions of the
Water Fund Finance Plan include approximately 1, 265 acres of land platted between 2022-2031, with
3,664 residential equivalent customer units to be added, and gallons billed between 2022-2031. Ms. Omdal
reviewed combination of bonding and use of pay-go cash to finance capital improvements and debt service

payments based on anticipated debt issuance. Ms. Omdal summary points to the Water Fund Plan
including maintaining focus on long-term financial planning and achieving cash sufficient to meet objectives
through regular review of assumptions for development. Ms. Omdal noted the Water Fund Plan as
presented assumes adoption of proposed fees and charges to achieve cash sufficient to meet objectives.
Council inquired on assumptions of new residents and variability of analysis. Ms. Omdal noted projections
are based on model staff has used over last number of years based on development. Council noted an
increase in materials for the water tower and storage treatment plants, bond rating, potential costs and how
it could affect the City’s credit rating in the future. Ms. Omdal noted the City’s current rating call for bonds
related to equipment, and as part of the rating call, staff must disclose plans and discussions, and when
the rating is released, it will account for current 2023 project financing. Ms. Omdal noted the analyst on call
did not indicate a negative rating review. Ms. Omdal noted rating review forthcoming in the following week.
Council and staff discussed debt service from funding source and ensuring funds are coming from Utility
Fund. Council discussed TLAC fees and current fees when both Corcoran and Maple Grove are paid.
Public Works Director Mattson and Council discussed costs for trunk fees per acre with Maple Grove at
$12,000 and impact window of spring of 2024 until fully operational, both Maple Grove fees and Corcoran
fees would need to be paid. Public Works Director Mattson noted once system is operational, TLAC fees
would be like today’s current fees. Staff and Council discussed with the development system in place, the
system pays for itself and justifies changes with modifications as each development occurs and system
implementation is completed. Public Works Director Mattson reviewed variability assumptions over the
next 10 years, projection averages with reasonable proximity to trunk line, trend line plateaus, and noted
conservative estimates within the municipal utility service area. Public Works Director Mattson noted trends
are mimicking average per acre in similar trendlines over the last 5 years, and noted policy conversations
discussed tonight, and adhering to current plan and process. Ms. Omdal reviewed cushion of staff
projections and noted with current projections, approximately five years of cushion to draw down for debt
service payments. Public Works Director Mattson noted development pays for what is needed as city
growth continues, noting sewer drives development within the projected timeline. Council and staff
discussed sewer capacity and limits, and development within both the northeast and southeast districts,
and risks involved.
b. Municipal Well #1 – Award Bid
Public Work Director Mattson reviewed the municipal well #1 award bid cost and noted low bid was a
successful bid and staff recommendation is to award bid to EH Renner for the bid amount of $218,772.
MOTION: made by Schultz, seconded by Bottema approve bid award of $218,772 to EH Renner.

c. Park Trail Feasibility Study
Public Works Director Mattson reviewed request to pave Park Trail from fall of 2021 near 66th and Gleason
Parkway and noted discovery of poor soil and noted numerous developable lots on Park Trail likely
requiring future utility infrastructure, creating a need to demolish road and reconstruct after utility
construction. Public Works Director Mattson reviewed staff recommendation to not proceed with pavement
request. Council noted discussion with the neighborhood prior to feasibility study. Public Works Director
Mattson outlined the city portion funding for the project of approximately $400,000 to pave road. Council
and staff discussed benefits on Park Trail on appraisal values were higher than Corcoran East and West.
In review of poor soils, Council reviewed option of concrete versus asphalt. Public Works Director Mattson
noting efficiencies in stabilizing road, infrastructure of utilities, and due to the constraints the project is not
feasible to complete twice. Council directed staff to take no further action.
12. Closed Session – Item moved up after 9c. Attorney-Client Privilege: Discuss Response to Action Filed by
Housing First Minnesota
Mayor McKee stated “Under the authority of Minnesota Stat. § 13D.05 subd. 3(b) the city is permitted to
close a meeting for attorney client privilege to discuss pending litigation. The City Council is going into
closed session for the purpose to discuss the response to the action filed by Housing First Minnesota.
Upon completion of the first closed session, the Council is going into a second closed session to
discuss non-public health and medical data which must be discussed in a closed session per Minn.
Stat. § 13D.05 subd. 2(a) (3 and 4)”.

Mayor McKee recessed the Council meeting at 8:58 pm.
Mayor McKee reconvened the Council meeting at 9:39 pm.
After the closed session meetings concluded, Mayor McKee stated, “In the first closed session the City
Council discussed attorney client privilege items related to Housing First Minnesota; staff was provided
direction. In the second closed session meeting City Council discussed non-public health and medical
data which must be discussed in a closed session per Minn. Stat. § 13D.05 subd. 2(a) (3 and 4); staff
was provided direction”.
9. Unfinished Business Continued (Public Comment Opportunity)
Mayor McKee invited residents to communicate in-person or telephonically during the public comment
opportunity for Unfinished Business items 9d-9g. Interim City Administrator Beise noted no public comment
cards were received. Interim City Administrator Beise explained the instructions to participate in the meeting
via the Zoom video format and reviewed instructions for participation in the meeting through telephone or
computer.
Mark Lanterman, 6936 Oak Ridge Road, thanked staff for addressing item 9d. Mr. Lanterman opined on
adjustments to section 4, license ineligibility, subsection e., and g. Mr. Lanterman opined on code
subsection e., referencing the reputation of solicitor, and referenced complaints, and convictions within 5
years for any violation of state, federal, or local adversely reflecting on person’s ability to conduct business
for which license is sought in professional, honest, and legal matter. Mr. Lanterman expressed clarifying and
simplifying sentence and changing conviction timeframe to 10 years within period of crime for federal or
state crime; and reference felony, to encompass all crimes, rather identifying all crimes individually within
code. Mr. Lanterman referenced a recent roofing solicitor within Corcoran.
d. Solicitors, Peddlers, Transient Merchant Ordinance
Council discussed the 10-year limit, and convenient to list felonies only, but also include gross
misdemeanors, and are there items that are not as egregious. Staff and Council discussed parameters of
language used within code, and the purpose behind the specific language.
Mr. Lanterman added verbiage could reflect felonies, gross misdemeanors related to crimes of violence,
controlled substance, and dishonesty.
Council reviewed the 3-complaints limit, and if accredited with the BBB, could be a viable mechanism to
proceed, or have a more subjective evaluative scope of complaints. Council noted standardizing sign sizes
to inches rather than points and simplify language regarding signs. Council gave staff direction to proceed
with drafting an ordinance.
e. Permit Technician Appointment
Interim City Administrator Beise outlined the draft offer letter to the preferred internal candidate for the
Permit Technician position and noted staff recommendation to appoint Shawna Zuther to the role of Permit
Technician.
MOTION: made by Bottema, seconded by Nichols to authorize staff to extend an employment offer to the
preferred candidate, Shawna Zuther, subject to final approval by the City Administrator and Mayor. Council
congratulated Shawna Zuther in her new role.

f. Public Works Maintenance Worker Appointment

10. New Business (Public Comment Opportunity)
Mayor McKee invited residents to participate in person and telephonically to comment on New Business.
Interim City Administrator Beise explained the instructions to participate in the meeting via the Zoom video
format and reviewed instructions for participation in the meeting through telephone or computer. No persons
participated in the public comment opportunity.
a. Request for Feedback – Variance Proposal
City Administrator Beise noted request for feedback item was tabled by requester and would be brought
forth to Council at a future meeting.
b. Police Office, Radio, and Audio Solution
Lieutenant Burns outlined the need identified after the City Hall remodel for police radio coverage within
the Police Department. Lieutenant Burns reviewed the anticipated cost of $10,000, and utilizing American
Recuse Plan Act (ARPA) funds for the expense.

and speakers in the Police Department for a total cost of $10,507.

c. Hackamore Road Improvements – CR 47 Cost Share Agreement and Funding Request
Public Works Director Mattson reviewed two requests relating to cost share agreements. Public Works
Director Mattson reviewed the 75 percent plan adopted with Medina and reviewed the opportunity of a co-
partnership with Medina and Hennepin County at the Hackamore Road and County Road 101 intersection,
noting a cost share not exceeding $80,000; and in tandem with the first cost share agreement, authorize
WSB for $1,303 to pursue cost share opportunities for the Hackamore Road and County Road 116
intersection. Public Works Director Mattson noted funds would support a new signal and accommodate turn
lanes in a future project. Council and staff discussed, and remaining funds would be allocated to the
Hackamore project. Council and staff discussed ped-work prepping for intersection.

and Hennepin County Transportation CIP Cost Participation Request.

d. City Logo Update
City Administrator Beise reviewed logo update in lieu of potential water tower construction and proposal
options. Council discussed leaving as is and using City of Corcoran. Council and staff discussed value of
branding of logo and identity of City. Council appreciates the elements of logo but simplifying the logo with
less color. Council consensus was to move forward with a proposal and review at a future Council meeting.
e. Labor Negotiations Team
City Administrator Beise outlined the expiring agreement later in 2022 with the Police Department and
indicated City Council representatives to serve on committee. Director of Public Safety Gottschalk reviewed
timeline and process with past negotiation discussions. Council questioned if expiring agreement remains in
effect if negotiation is not reached by agreement expiration. Councilor Bottema and Mayor McKee
volunteered to participate in the negotiations as Council liaisons.
f. Resolution 2022-36 Funding the City of Corcoran Water Supply Construction Project
City Administrator Beise outlined the possible funding opportunity through the federal government for
Corcoran’s Water Supply Construction Project by Representative Phillip’s office. City Administrator Beise
noted requesting the full request maximum amount of $4 million. Council and staff discussed applying for
more than one grant. Council also noted grant deadline of April 15, 2022. Council and staff discussed the
September 2023 deadline to utilize grant funds. City Administrator Beise noted audit expenses may
increase due to Federal funding exceeding $750,000.

Council received 2022 schedule, City Administrator Beise noted upcoming planning items at the April 28
meeting and noted Councilor Bottema will be Acting Mayor for the April 28, 2022, meeting. Council
requested guidance from City Attorney as to what level of doubt can be discussed regarding applications
without it becoming a legal issue. Council inquired about additional information from solar company
presentation for the Public Works facility. City Administrator Beise noted nothing has been received buy
staff.

FOURTH AMENDMENT TO LAND PURCHASE AGREEMENT
THIS FOURTH AMENDMENT TO LAND PURCHASE AGREEMENT (this “Fourth
Amendment”) is made and entered into as of June ___, 2022 to that certain Land Purchase
Agreement dated December 12, 2019 (the “Original Agreement”) and amended by the First
Amendment to Land Purchase Agreement approved by the City of Corcoran on May 13, 2021 (the
“First Amendment”), and by the Second Amendment to Land Purchase Agreement approved by
the City of Corcoran on December 22, 2021 (the “Second Amendment ”), and by the Third
Amendment to Land Purchase Agreement and Assignment of Purchase Agreement approved by
the City of Corcoran on April 28, 2022 (the “Third Amendment”), (all validly executed portions
of the “Original Agreement”, the “First Amendment”, the “Second Amendment”, and the “Third
Amendment” are collectively referred to herein as the “Agreement”) by and between THE CITY
OF CORCORAN, a Minnesota municipal corporation (“Seller”) and SAINT THERESE OF
CORCORAN, LLC, a Minnesota limited liability company (“New Buyer”). Seller and New
Buyer and are collectively referred to herein as the “parties”.
WHEREAS, Seller and New Buyer have experienced delays in completing all pre -
conditions to Closing and the parties desire to extend the deadline to complete Closing which is
set forth in the Agreement; and
WHEREAS, the parties still mutually in tend to close the transaction by June 17, 2022, but
agree to this extension as a precautionary measure, in the event the completion of certain pre -
conditions is delayed; and
WHEREAS, Seller and New Buyer have mutually agreed to make certain amendments to
the Agreement as set forth herein.
NOW THEREFORE, for valuable consideration, the receipt and sufficiency of which is
hereby acknowledged, Seller and New Buyer hereby agree as follows:
1. Capitalized terms in this Fourth Amendment that are not defined h erein shall have the
meanings set forth in the Agreement.
2. The first sentence of Section 7.1 of the Original Agreement, as amended by the Second
Amendment and the Third Amendment, is hereby deleted and replaced with the following
language:
“The closing of the transaction contemplated by this Agreement (the
"Closing ") shall be held on a date mutually acceptable to Seller and New Buyer,
but no later than July 22, 2022.”
3. Except as specifically provided in this Fourth Amendment , the Agreement is hereby
ratified and confirmed and shall remain in full force and effect.
IN WITNESS WHEREOF, the parties hereto have executed this Fourth Amendment to
Land Purchase Agreement by their duly authorized representatives effective as of the day and year
first above written.

A RESOLUTION AUTHORIZING EXECUTION OF TERMINATION OF LEASE AGREEMENTS
WHEREAS, the City of Corcoran (the “City”) is the owner of certain real property within the City
of Corcoran, described on the attached Exhibit A (the “Property”); and
WHEREAS, during a recent review of title of the Property, certain encumbrances to title were
found to exist in the form of a ground lease and a lease-purchase agreement (collectively the
“Leases”) between the City and the Corcoran Economic Development Authority (the “EDA”),
both executed on October 7, 2004; and
WHEREAS, a review of City records revealed that by 2006 all funds which were required to be
paid pursuant to the Leases were paid and the Leases thereafter terminated; and
WHEREAS, in the interest of clarifying the status of the Leases, the City desires to execute and
record a mutually executed “Termination of Lease Agreements” with the EDA.
NOW THEREFORE BE IT RESOLVED, the City Council of the City of Corcoran hereby
approves the Termination of Lease Agreements and authorizes the Mayor and the Administrator
or their respective designees to execute the same.

1.Description of Request
The applicant is requesting approval of a rezoning, preliminary plat and planned unit development
(PUD) plan for “Walcott Glen” on 35.07 acres at the northwest corner of Hackamore Road and County
Road 101. The residential development includes 85 townhomes and 44 single family units.
Development plans show the construction of the project in a single phase.
2. Background
On November 22, 2021, Council reviewed a concept plan for the project and provided feedback to the
applicant.
On May 26, 2022, City Council tabled this item at the request of the applicant. The City of Corcoran
exercised its authority to extend the review period from 60 to 120 days. The 120-day review period
ends on August 4, 2022.

On May 31, 2022, the applicant has provided a revised plan which eliminates the on-street parking

WHEREAS, Pulte Homes of Minnesota, LLC (the “applicant”) has requested approval to rezone
34.59 acres legally described as follows:
See Attachment A
WHEREAS, the Planning commission has reviewed the request at a duly called Public Hearing,
and;
WHEREAS, the City Council has adopted an ordinance rezoning the affected parcels to
Planned Unit Development (PUD);
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
CORCORAN, MINNESOTA, that it should and hereby does support the request for the
reclassification of the property, based on the following findings and conditions:
1. The planned development is not in conflict with the Comprehensive Plan. The proposed
pre-development density of 3.97 units per acre is expected to be within the 3-5 units per
acre required in the Low Density Residential land use classification when calculated with
post-development numbers at final plat. The plan incorporates the on-road trail and
street connections anticipated within the site.
2. The planned development of 44 single family is consistent with the intent of the RSF-2
zoning district, which allows single family homes. The applicant is requesting approval of
PUD zoning to allow the development of 85 townhomes. The purpose of the PUD district
is to allow for mixing of land uses that could not otherwise be accomplished through
standard zoning regulations. The applicant is also requesting approval of PUD zoning for
design flexibility for modification of townhome architecture and building standards for this
development.
3. The planned development is not in conflict with other applicable provisions of the City’s
Zoning Ordinance, except that PUD flexibility is requested as noted in the staff report. In
exchange for this flexibility, the developer indicates they will preserve wetlands, preserve
existing trees to buffer the development, establish buffers and screening between the
existing development and the townhomes, provide a small private park and provide an
additional 55 ft. setback from County Road 101 for the lots on 62nd Avenue N.
4. The planned development is feasibly without dependence upon any other subsequent
phase. The project will be completed in a single phase and integrate into the existing
Ravinia neighborhood.

5. With the improvements required by the feasibility study, the development will not create
an excessive burden on parks, schools, streets and other public facilities and utilities
which serve or are proposed to serve the planned development. The developer is
providing public trails and sidewalks consistent with the City’s Comprehensive Plan. The
private park will serve neighborhood residents in addition to the existing public parks in
the surrounding area.
6. The planned development is a residential neighborhood developed consistent with the
Comprehensive Plan and, therefore, will not have an undue and adverse impact on the
reasonable enjoyment of the neighborhood property. The development is estimated to
be 3.97 units per acre where 3-5 units per acre are required for this property.
7. The quality of the building and site design proposed by the PUD plan shall substantially
enhance the aesthetics of the site, shall demonstrate higher standards, more efficient
and effective uses of streets, utilities and public facilities, it shall maintain and enhance
any natural resources within the development, and create a public benefit that is greater
than what would be achieved through the strict application of the primary zoning
regulations. Staff finds the developer meets this standard. The development will meet
the City’s density goals while providing land for land for a private park, trails and quality
architecture.

WHEREAS, Pulte Homes of Minnesota, LLC (the “applicant”) has requested approval of “Walcott
Glen” a residential subdivision on property legal described as follows:

WHEREAS, the Planning Commission has reviewed the plan at a duly called Public Hearing and;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
CORCORAN, MINNESOTA, that the Corcoran City Council hereby approves the request for
preliminary PUD plan, subject to the following conditions:
1. A preliminary PUD plan is approved to create 129 lots and five outlots for “Walcott Glen”, in
accordance with the plans and application received by the City on February 15, 2022,
February 24, 2022, March 11, 2022, March 30, 2022, April 6, 2022, April 26, 2022, April 27,
2022, May 18, 2022 and May 31, 2022, except as amended by this resolution.
2. Approval is contingent upon City Council approval of the requested rezoning and
preliminary plat (Ordinance 2022-63 and Resolution 2022-65).
3. The preliminary PUD plan is approved based on the finding that the proposed project is
consistent with the City’s Comprehensive Plan.
4. The townhomes shall comply with the RMF-1 townhome standards in Section 1040.060
of the Zoning Ordinance.
5. The applicant shall comply with all requirements of the Public Safety Memo dated April
12, 2022.
6. The applicant shall comply with all requirements of the City Engineer’s memo, dated
April 24, 2022.
7. The applicant shall comply with all requirements of the Feasibility Study dated April 6,
2022.
8. The applicant shall comply with all requirements of the comments provided by Hennepin
County on May 12, 2022. The applicant is also required to secure all permits and
approvals from the County.

9. PUD flexibility is granted for the following:

plat is released for recording.
b. A 20 ft. wide trail easement must be deeded to the City for the Hackamore Road
trail. Final alignment will be determined by the City Engineer. No park dedication
will be granted.
c. The future County Road 101 trail shall be shown on the plans.
12. Minimum lot area calculations for the townhomes shall be provided with the application
for final plat (sum of the unit footprints plus the common areas divided by the number of
townhome units).
13. Plans shall be revised to show compliance with the 30 ft. rear yard setback for single
family lots.
14. Plans shall be revised to show building setback flexibility for Lot 38 as 60 ft. from County
Road 101. Building setback flexibility is permitted to reduce the required setback up to
40% of the required 100 ft. setback if the applicant provides:
a. One overstory deciduous tree, one overstory coniferous tree, two ornamental
trees and ten understory shrubs for 100 ft. along the property line where flexibility
is requested, or preserve the equivalent number of existing trees and shrubs.
b. Plans shall show the required landscaping for the reduced setback.

15. Building setback flexibility is provided for Lot 38 for a 60 ft. front setback from major
roadways. In exchange, the applicant shall provide a minimum of one overstory
deciduous tree, one overstory coniferous tree, two ornamental trees and ten understory
shrubs for 100 ft. of length along the property line where flexibility is requested, or
preserve the equivalent number of existing trees and shrubs.
16. All driveways must have a minimum 22 ft. wide parking area between the garage and
right-of-way that does not overlap into sidewalks, drives or streets.
17. Mechanical equipment (including air conditioning units) must be located in the side or
rear yard.
18. Driveways may not encroach in the drainage and utility easements on the side yards.
19. The developer shall provide centralized mailbox locations. A mailbox plan shall be
provided for City review and approval. Mailbox locations shall be approved by the US
Postal Service and proof of the approved locations shall be provided to the City prior to
release of final plat.
20. The applicant shall provide details of the driveway, house pads, and setbacks as part of
the final PUD plan applicant that demonstrate compliance with the approved PUD
standards.
Architecture and Design Standards
21. Single family homes shall comply with all design requirements for the RSF-2 district
described in Section 1040.040.
a. Provide updated architectural plans delineating the garage area to ensure
compliance with the requirement that the garage shall not comprise more than
55% of the viewable ground floor street-facing building frontage.
22. Townhomes shall comply with all design requirements for the RMF-1 district described in
Section 1040.060, Subd. 9, except that PUD flexibility is provided for garage size and
width. The plans submitted do comply with all architectural standards for building
materials.
23. Any changes or updates to the architectural elevations or plans provided to the City must
be approved by City staff to ensure compliance with PUD approvals.
24. The applicant shall provide copies of the final HOA documents/covenants for City review
as part of the final plat application.
25. Porches, patios and/or decks must comply with the 30 ft. rear yard setback.
Landscaping and Lighting
26. Lawn sprinklers/irrigation systems (if provided) shall all have rain sensors to limit
unnecessary watering.

27. Plans shall be revised to show proposed location of streetlights and street light details
shall also be provided.
28. The Tree Preservation Plan shall be revised to show additional trees for removal
adjacent to the retaining wall north of Wetland #H3.
29. Landscaping 3 ft. high shall be provided for parking areas with four or more stalls to
screen vehicle headlights from adjacent residential and public streets.
30. The applicant shall provide plans showing the proposed location of required trees and
utility connections to ensure no conflicts between the two.
31. Trees shall be planted prior to issuance of a certificate of occupancy for the single family
homes.
32. Any request to for the City to inspect the required landscaping in order to reduce
financial guarantees must be accompanied by recertification/verification of field
inspection by the project Landscape Architect. A letter signed by the project Landscape
Architect verifying plantings (including wetland and pond buffers) have been correctly
installed in compliance with the plans and specifications will suffice.
Wetlands
33. A wetland buffer planting plan and maintenance plan must be submitted for review and
approval by the City.
34. Well and septic system abandonment shall be completed as noted in the City Engineer’s
memo.

Honorable Mayor & City Council:
We appreciate the varied comments that we received during the City Council meeting of May
26th. Upon further contemplation, we made some revisions to the site plan. We increased the
“onsite” perpendicular parking within the townhome portion of the neighborhood to fully satisfy
off-driveway parking requirements without the need to count any parking on public streets. As
a result, we also eliminated the bay parking along Larkspur Lane. It is our intention that these
revisions will address a concern that was raised during the meeting.
Please find attached to this letter a revised engineering site plan, a revised colored rendering
of the site plan, and a revised setback exhibit. We thank you again for your consideration of
this application.

Dear Corcoran City Council,
We are all residents of the Ravinia neighborhood in Corcoran to which the proposed Pulte
development at the northwest corner of Hackamore Road and County Road 101 would connect.
We appreciate you all taking the time to read this letter.
We oppose the rezoning for the neighborhood for the following reasons:
(1)The proposed property is in conflict with the Single Family Residents (RSF-2) zoning
district which does not allow construction of townhomes. We see no reason to alter the
original zoning and believe it could create a dangerous precedent.
(2)The traffic which 85 townhomes and 44 single family homes would generate would
negatively impact the Ravinia neighborhood. Even though the proposal would have an
entrance for the townhomes off Hackamore we believe many people would wind up
traveling through Ravinia to get to 101 or to exit further west out of Ravinia. The traffic
from the 85 townhomes would be significantly more than what single family homes in the
same area would create and we have concerns over the impact on children playing in
the neighborhood.
(3)The property values of the surrounding single family homes will almost certainly
decrease with this development. Ravinia is currently surrounded by neighborhoods
consisting of single family homes and the addition of townhomes will change the
character and density of the area.
We hope you will consider our input and request that the council deny the request for rezoning.

site. Also Larkspur LN was a
dead end with no connection to

know -

. But in total against all city and

or minor they are breaching and
would need exceptions?
Earlier esteemed City council
members rejected the proposal so
what has changed?
There is no good reason to give
exception to build townhomes in
this neighborhood just to give
more profit to the builder.
There is no middle ground i.e the
builder can build single family
homes but he is showing home
density or preserving trees and
pushing for personal profits at the
expense of existing home owners

Dear City Council members,
I've recently learned about a new proposal being tabled at the city council to extend the Larkspur
lane in favor of building a townhome ship by Pulte Constructions/builders.
I must express that this matter concerns me, my family and a lot of our community residents,
especially those who reside in Larkspur lane & court.
Firstly, we have paid an enormous premium to the existing builder, which is at risk for
homeowners given the current proposal is to connect our immediate site as an entry point to a
townhome. This as we all understand depreciates the goodwill/value of our homes.
Second & most importantly - each & every family including ours is that of baby boomers. We have
put our children at risk by increasing the foot print in terms of traffic through these streets. While I
appreciate we need affordable housing for everyone, taking it through an established, premium
community to allow builders to make additional profits is something we should reconsider
immediately.
While there's already an affordable option to build smaller individual houses, we would rather prefer
similar single family homes over townhomes, which pretty much sell for the same price these days.
In which case, why allow a builder to reap more profits by increasing the numbers?
We have multiple townhome communities in the neighborhood already, along with Sr living
established to meet the demands in my view. Adding additional townhomes linked to highly priced
single family homes doesn't help us protect our investments and the sanctity of the beautiful
community we've built for ourselves here.
I would greatly appreciate it if you could kindly represent these views in the city council push back
on these one sided, builder profit oriented plans.

Specifically on the question of trees, I did review the plans regarding landscaping pretty closely. It looks like there is a plan to re-plant in this area after grading. Specifically, it looks like white oak, river birch, black hills
spruce and white pin would be backfilled in this area where trees are being removed.

Is there anything in the plans about restoring the wetland that borders the proposed development to the north? My home is on the pond & I’ve noticed that the pond seems to be getting shallower
even this earlyt in the spring with the weeds starting to show more. I can also tell by the barrier that is on the southern edge of the pond.
I remember reading in one of the proposals that there was a need to improve the barrier, but I can’t recall if it was the Pulte or Eaglebrook proposals.
I’d like to better understand why the majority of the trees are being removed from the northern borders of lots 5, 6, 7 & 8. Will these trees be replaced?
Pulte’s proposal talks a lot about tree preservation in other areas of the development, but not this area.
The existing trees demonstrate the beauty of nature & also provide a visual barrier between my home & those across the pond.

Good afternoon!
We bought the property and build home 5 years ago made Corcoran our new home, paid premium price
to adhere to Corcoran city rules for single family homes and meting setback requirements and we made
decision to buy knowing that this neighborhood is only approved for single family homes.
Pulte builder is making a marketing pitch to make maximum profit and the expense of the people who are
living in this neighborhood, showing just 1.9 homes per acre when only 1 or 2 homes in their current
proposal meets city rules for setbacks. Under the pretext of building 3.9 homes per acer and saving
threes they have not explored middle ground that would have been beneficial to the existing home
owners, save trees and yet make profit for the property seller and the builder.
The property seller said in the last meeting that he is agony, well he will sell and walk away with profit, we
the current residents in this neighborhood will live in agony for the rest of our lives in Corcoran.
City planning who are the experts rejected the proposal outright and Pulte has made no changes other
than minor updates to address parking concerns from the council member concern.
The just didn't explore middle ground that could save trees; address concerns for council member
concerns and more importantly address all issues raised by existing neighbors.
1) Safety of kids - with increased home density associated with town homes, there will lot more cars going
in front out house and significantly increasing risk for my kids doing their things like going to school or
playing with neighbors
2) Noise - with all north bound traffic going from town homes will increase by more than 50 cars on top of
existing traffic (based on mathematical models) and may be more cars from Ravini going south may take
Larkspur Lane increasing the noice pollution
3) Property Values - Town homes that are stone's throwing distance will impact our property values and
bring it down
4) Altering rules - Just to benefit the one or two sellers and a buyer to make more profit from the sale, we
are punishing hundreds of families and home owners who made Corcoran as their home, why are we
even encouraging someone to come up with this proposal and discuss?
5) Parking - someone in Larkspur CT had a get together and all the streets were full with cars, imaging
what is going to happen if someone in town homes is having a get together, make streets dangerous to
drive and significantly increase risk for kids.
6) Town homes just done fit in the current neighbor hood, surrounded by single family homes and at the
entrance of Corcoran
Request council members to reject the proposal and make it very clear to the builder that two homes are
just not allowed.

came to know and quite surprised about the Pulte proposal to build townhomes at 62nd N and

We purchased out home last year under the assumption that the community would be a single
family home facility and the neighborhood would be developed per the city council rules\guidelines.
As I understand the current the proposal, the following items are of big concern.
• The proposal, if allowed will increase noise, crowd and risk safety of the kids playing in the
community and for families spending time in the neighborhood.
• The property value is going to be reduced and no guidelines at the present time on impact of the
reduction in value or on compensation.
• Pulte, as any profit driven organization, is trying to maximize its return on investment by
meandering and flouting city developmental guideline rules.
Hence, requesting you to close out and deny this proposal to build townhomes once and for all so
that this doesn’t come back again and allowing only single family house to be built.

I know you have received a lot of feedback on this neighborhood and I have several concerns as well,
but my two largest concerns include:
1. It appears the park is a small tot lot or something similar? I do not believe this is sufficient for the
area. With only 1 city park within safe walking distance of multiple neighborhoods and more and
more being built every day, the park is very crowded. I do believe this is a wonderful problem to
have as kids and families are out enjoying life and interacting together! With a larger park, people in
the area would have more options and as we see with the current park, it will certainly get used and
that is a good thing! If you look at surrounding cities (Plymouth, Maple Grove) almost every new
housing development has a large park.
2. The traffic is very concerning. This has nothing to do with a development going in, I think
everyone assumed that was happening.The concern is rezoning for townhomes and the amount of
traffic that will bring to Hackamore and the Ravinia neighborhood. Kids are outside playing
constantly, which is amazing, but adding that much more traffic to the roads would be dangerous.
The townhomes just do not make sense in that area and with the current infrastructure.

Dear city administrator,
I am a resident at 6465 Larkspur Ln, Corcoran, MN, 55340. I purchased my home in 2017 knowing
that the neighbourhood (including the new development that is requested for rezoning) is zoned as
a single family home. If that was not the case or if that is going to be changed in the 5 years I would
not have purchased the home. I am opposing the rezoning the neighborhood to accommodate the
townhomes and single family homes for the Pulti development on the northwest corner of
Hackamore and Country Road 101 due to following reasons:
1. The increased traffic will create an unsafe environment for the children.
2. This will bring down the property value of the neighborhood.
3. The increased traffic and activities will create a hostile environment to the wildlife and to the
residents in which we paid a premium lot price to have a peaceful neighborhood.
If the proposed Pulti development gets approved by the council I feel the council betrayed me as a
Corcoran resident and a Ravinia resident as a whole.
I am in favour of any development project that obeys existing city rules to build single family homes.
I hope many young families continue to call Corcoran their home in many years to come.

1. Background
In January, the City Council discussed a Zoning Ordinance Amendment request by Larry Aller to
allow a fence of 6-foot tall with nearly 100% opacity to be built up to the front property line
where there is a 50-foot front setback required. The direction at the end of this meeting was for
staff to look at amending the definition of “front yard” for corner lots with the hopes this would
allow Mr. Aller’s fence to remain by considering the frontage along Trail Lane as a side yard or
secondary frontage.
2. Analysis
Unfortunately, achieving Council’s desired result is proving difficult as Mr. Aller’s address and
driveway access indicate the primary frontage that serves his lot is indeed along Trail Lane.
While it is possible to amend the code so that corner lots only have one “front yard,” staff does
not recommend crafting a definition of front yard for corner lots that is not tied to the primary
frontage that serves the property. Establishing a convoluted definition that will achieve Mr.
Aller’s goals will not make sense when applied uniformly across the City and will likely lead to
unintended impacts. With this in mind, staff asks for further direction to identify the underlying
goal(s) of the City Council.
Is the goal to amend the Zoning Ordinance so that corner lots only have one “front yard?”
If so, staff looked at definitions of frontage, front lot line, and front yard for 5 cities within
Hennepin County to inform how Corcoran’s definitions could be amended. A comparison table
is attached to this report for your reference. Of the cities surveyed, three did not subject corner
lots to two required front yard setbacks. This was accomplished in a different way for each city.
In Dayton, the definition of front lot line as it relates to corner lots is determined by the
shortest dimension of lot abutting the street or road. If the dimensions of a corner lot are
equal, the front lot line shall be designated by the owner and filed with the City.

A similar definition is applied in Brooklyn Park. The
front lot line for corner lots is the shortest of the sides
abutting the public street. When the dimensions of a
corner lot are within 10% of being equal, the front lot
line shall be designated by the owner. Once the
address and principal entrance is established, the
front shall not be reversed. The diagram to the left is
taken from the Brooklyn Park Zoning Ordinance and is
meant to show the yard types for a standard corner
lot.
In Rogers, they defer between primary and
secondary frontages within their definitions. A
primary frontage is the boundary of a lot that buts
a public street or private road. For a lot that has
more than one frontage, the primary frontage is
defined as the lot boundary that abuts the street
on which the property is addressed. All other
frontages are classified as secondary frontages.
The front lot line is identified as the line
connecting the side lot lines of a lot measured
along the boundary of the right-of-way designated
by the City Council to serve the lot. The diagram to the right confirms is taken from Roger’s
Zoning Ordinance and confirms that corner lots have only one front yard.
Maple Grove has a hybrid approach in that the definition of front yard for corner lots is applied
to all frontages when the lot abuts one or more major roads (i.e., a collector road or greater).
Plymouth’s definition of front yard is applied to any street frontage of a lot.
Within our own nuisance code, the City updated the definition of “front yard” last year to read
as follows:
An area extending the full width of a lot between the front line and the nearest principal
structure. For the purposes of Chapter 82.04, Subd. 3., a corner lot shall have one front
yard and it shall be the area extending the full width of a lot between the principal
structure and the front lot line with driveway access to the principal structure.
Staff believes it makes the most sense to apply this same definition in the Zoning Ordinance. It
is believed this could be easily applied to established lots. However, if City Council prefers, the
definition could be tweaked so that newly established lots are determined by the frontage with
the shortest dimension, and the driveway access and address would then be determined by the

identified front yard. While this seems to be a straightforward solution, staff will further
evaluate potential impacts in applying this uniformly and how this may impact other areas of
the Code as the Zoning Ordinance Amendment moves forward. To provide an initial example of
an anticipated impact, architectural standards are required to a higher degree along frontages
as they are considered front yards. Changing the definition of front yard could impact how
these standards are applied throughout the City. Unfortunately, staff’s proposed change would
not allow for Mr. Aller’s fence to remain as-is.
Is the goal to reduce the front yard setback for fences in excess of 4 feet tall with an opacity of
greater than 50%?
If so, staff looked at the fence
regulations for the same 5 cities
discussed above, a comparison chart
is attached to this report for
reference. Of these cities, only
Brooklyn Park allowed fences to be
placed within the front yard setback
for structures. Fences in excess of 4
feet tall are subject to a 15-foot
setback from the front property line
and must provide a clear view
triangle (a 30-foot clear view triangle
is required for driveways on standard
lots, and a 50-foot clear view triangle
is required for intersections on corner lots). The image to the right provides a helpful visual of
Brooklyn Park’s clear view triangle requirements.
Rogers does not have any fence flexibility for corner lots, but the other three cities did.

Dayton identifies a different setback standard for the longest lot line with frontage on a corner
lot (which is considered a side yard). A fence in excess of 4 feet tall is allowed if it is placed at
least 20 feet behind the front elevation of the house. A diagram of how this is applied is below.
This approach allows for fences of up to 6 feet tall along the side frontage while still
accomplishing a clear view triangle.
Plymouth provides an exception for fences of up
to 6’ tall and 100% opacity on corner lots where
the rear wall of the principal building faces the
rear wall of an abutting principal building. These
fences can be located within the required front
yard setback in the area that lies between the
side wall of the principal building and the
abutting side street, from the rear wall of the
principal building to the rear lot line. A diagram of
this standard is pictured to the right.
Maple Grove also provides flexibility for corner
lots. A fence may be placed in the front yard of a
corner lot that abuts an arterial street as long as
it provides a 30’ clear view triangle. Additionally,
fences may be constructed along any portion of a
side lot line which also serves as the rear lot line of a corner lot.
Corcoran’s City Code applies a 30-foot “sight visibility triangle” (AKA clear view triangle) for
intersections and driveways within Section 1060.090, Subd. 2. In evaluating how other cities
have designed their fence regulations to allow fences within frontages while still achieving sight

visibility triangles, it looks like a 15’ front setback for fences in excess of 4 feet tall and an
opacity of 50% is doable. However, Public Works has concerns with impacts to the access of
drainage and utility (D&U) easements as there are a number of lots with D&U easements along
frontages that are close to or exceed 15 feet. A compromise that would provide more flexibility
to residents while factoring in the varied sizes of D&U easements throughout the City seems to
be a front setback for fences of 25 feet or the front setback for structures in the underlying
zoning district, whichever is less. The impacts of broadly applying this proposed change would
need to be further evaluated along with the potential impacts to other areas of the City Code.
This evaluation will occur as the Zoning Ordinance Amendment moves forward. While this
would not completely address Mr. Aller’s desires, it would reduce the length of fence he would
need to remove from 50 feet to 25 feet to bring his property into compliance.
Is the desire to specifically address Mr. Aller’s request?
If the Council only wants to make an exception for Mr. Aller’s property, the Council should
direct staff to ask Mr. Aller to submit a variance application. It is important to note that staff
will likely recommend denial of a variance for the fence as conversations with Mr. Aller indicate
the strict variances standards are not met in this instance. The fence within the front yard
setback is a situation of the property owner’s own making that is not based on conditions
unique to this property (this is not the only property with multiple frontages and/or a conflict
with a neighbor). However, Mr. Aller would be able to make his own argument for the Planning
Commission and City Council to consider further.
Furthermore, it is important for the City Council to clarify whether the fees and escrow for such
an application will be required (every other variance request is subject to these fees). Part of
the reason Mr. Aller petitioned for a city-driven Zoning Ordinance Amendment was to avoid the
fees and escrows required of an applicant-driven Zoning Ordinance Amendment. As a reminder,
City Council told Mr. Aller in January that the City would cover the costs of a Zoning Ordinance
Amendment.
3. Summary
The Council is asked to provide direction to staff on the underlying goals of the potential Zoning
Ordinance Amendment discussed back in January in relation to Mr. Aller’s fence. Is the ultimate
driver of the amendment one or a combination of the following three goals?
1. Redefining front lot line/front yard so that corner lots have only one front yard.
2. Reduce the front setback for fences.
3. Grant Mr. Aller the ability to keep his fence as-is within the required front yard
setback.
Council should also provide feedback on staff’s proposals to address the potential underlying
goals of the Council:

1. Using a similar definition of front yard as what is found in our Nuisance chapter of
City Code (Chapter 82).
2. Reducing the front setback for fences down to 25 feet or the structure setback in the
underlying zoning district, whichever is less.
3. Moving forward with a variance application for Mr. Aller’s specific situation.

Corcoran Codes and standards are easily understood and and do effect multiple
citizens and neighbors when one property owner habitually tries to influence and dictate
the rules.
I object to Property owner at 6508 Trail Lane application to amend zoning ordinance for
fences that will negatively impact adjacent land owners from here on.
It is unfortunate that some people cannot see how their actions affect others, or simply
just do not care.
Appeasing this land owner for deliberately building a non conforming fence will only
satisfy his motives. Amending the ordinance does not comply with a pro property rights
action.

The property owner at 6508 Trail Lane has applied for a zoning ordinance amendment that may impact
their ability to have a fence on the property line. While City staff explore ordinance amendment options
to present to Council, the fence violation has been put on pause as the status of the violation could
change pending the outcome of the zoning ordinance amendment.
As it stands, the tentative schedule is for Council to review options for the zoning ordinance at their June
9th work session meeting, prior to the council meeting from 5:30‐6:30PM. I need to confirm this date
with one of the City planners but she's out of the office today ‐ I will follow up with you early next week
to confirm this is the correct meeting date. During their work session, Council will review staff's findings
related to the feasibility of a zoning ordinance amendment. The work sessions are open to the public
and zoom links for remote attendance can be found on the City website.

Summary:
Planning for street improvements to Hackamore Road are underway along the border of
Corcoran and Medina. T he existing road is reaching its life expectancy and the need for
improvements to the corridor have been identified because of increasing transportation
demands resulting from development activity and pavement condition .
Over the past two years, both Medina and Corcoran City Council approved a proposal
from WSB to complete engineering services for two 30% street design layout options
and a 75% design.
A virtual Open House meeting for adjacent property owners was held in May 2020.
Approximately 20 residents participated in the event with preliminary feedback given
related to the increased traffic potential, future development in the area, and drainage
concerns.
Road design has been completed to 75% design. Staff have been actively discussing
the next steps and potential timeframe to move forward with the project. Mayors McKee
and Martin have also discussed coordination.
A cost estimate was completed in May 2021 and projected a total cost of $6.7 million.
The project was pledged funding of $700,000 from the Minnesota Department of
Transportation from the Local Road Improvement Program (LRIP), which would need to
be contracted by 2023. To utilize this funding, both staffs are recommending
proceeding with final design in 2022.
Proceeding with final design will provide the opportunity for the cities to refine costs,
analyze funding mechanisms, and complete a cohesive plan guiding the transportation
needs, right-of-way, and pedestrian mobility of this corridor. It also positions the cities
to be able to contract for an improvement project in 2023.
Final Design
Staff from both Cities recommend proceeding with final design for the project with the
goal of finalizing design by early 2023. Staff also recommend submitting for final
watershed approval prior to October 31, 202 2, when new rules are anticipated to take
effect which may increase the cost and complexity of the project. Based on current
schedules the Cities would need to authorize final design by June 9th and begin work on
the project to get into the watershed for review by October 31, 202 2.

WSB has submitted a proposal (attached) with an hourly not-to-exceed cost as follows:
• Final Design - $229,612
• Easement preparation and staking - $28,484
• Construction Services - $310,094
Staff has reviewed the proposal and reviewed engineering costs for other past projects
for context. WSB has also adjusted the scope and costs based on staff feedback. Staff
from both cities believes there are significant benefits for WSB to complete final review
since the firm has complet ed the preliminary design work to this point.
Staff brought forward an update to each Council in May on the next steps of the project.
There was consensus with both City Councils to proceed with bringing forward the final
design proposal and to continue t o refine the financing framework.
Financial/Budget:
The following funding sources have been identified and are projected to cover a majority
of the project costs:
• Development Responsibilities /Contributions
• LRIP Grant Funds from MNDOT
• Potential Assessments
The cities are also seeking additional funding from Hennepin County for the signals and
street improvements at County Road 116 and Hackamore Road. The County
participation is expected to be known in the fall of 2022.
The amount an d means that adjacent developments will contribute to the overall project
are still being finalized on various projects. However, staff have projected that there will
be a gap after all the funding noted above have been finalized.
The final design allows for the City to review the possibility of assessments. The final
report will outline options for assessments subdividable property. City staff has
conferred with the City Attorney that it is possible to assess properties that are
subdividable. If the City would not like to pursue assessments a portion of the final
design scope could be reduced .
Staff proposes a 50/50 cost share for the remaining gap. There seemed to be general
support for the framework with both Councils.
Next Steps
• Prepare a memorandu m of understanding for consideration by each Council
related to the schedule, process, and framework described above (or as
indicated by the Councils).
Options:
1. Authorize WSB to complete the final design of the Hackamore Road Improvement
project; direct staff to work with the City Attorney and Medina City Staff to create a

Dear Mr. Finke and Mr. Mattson:
On behalf of WSB, we are pleased to present this proposal to provide professional engineering
services to the cites of Medina and Corcoran. Specifically, our services will include the completion
of 100% final design and plans, technical specifications, construction documents, bidding, and
construction services for the Hackamore Road Street Improvement Project. WSB has the staff
and experience needed to complete all of the proposed services inhouse. The following letter
proposal represents our entire understanding of the project scope and level of engineering
services requested.
WSB’s experience in working for the Cities of Medina and Corcoran on the design for the
Hackamore Road project to date and our history of working with project stakeholders along
similar project corridors in the area makes WSB the ideal candidate to complete the 100% final
design and construction services. Our project team members have led many projects requiring
coordination with the multiple Cities, MnDOT, and Hennepin County. We will support Medina and
Corcoran in their efforts at all levels to complete this project in the most efficient and cost effective
manner.
PROJECT UNDERSTANDING
The Cities are requesting engineering design services that include 100% final design plans,
specifications, construction documents, bidding, and construction services for the full
reconstruction of Hackamore Road. The project will generally include final design of the proposed
street, trail, storm sewer, and related stormwater management from 1,500 feet west of CR 116 to
the westerly quadrant of CR 101; in total approximately 6,800 lineal feet.
The scope of the requested engineering and technical services will include the following:
· This design phase will be an extension of the plans previously completed up to a 75%
level; it has been assumed that the general design and proposed alignments/locations for
the roadway, trail, storm sewer, and stormwater management systems will not change
significantly.
· The portions of the proposed trail and permanent stormwater management that are
adjacent to or extend beyond the street right-of-way into the future development parcels
at the NE quadrant of CR 116 and NW quadrant of CR 101 will not be designed or
constructed with this scope of work.
· The signal at CR 116 will be included with the project scope for both design and
construction. Coordination with Hennepin County for approval of the signal funding and
design has also been included.

· The easterly extents of the project will include what is needed to connect into the project
currently being proposed at CR 101 by the City of Plymouth for the CR 47 improvements.
This project proposes the design and installation of the signal system and street
improvements up to the westerly quadrant radii of the intersection at CR101.
· No watermain or sanitary sewer reconstruction or extension will be included with this
scope of work.
· For the construction services phase, it has been assumed that all portions of the project
included with 100% final design will be bid and constructed as one contiguous project,
but with multiple phases occurring during the specified duration for active construction.
· The City of Corcoran is considering assessments to adjacent property owners with the
potential for subdivision.
As requested in the RFP, the proposed scope of engineering services detailed in this proposal
will include the following in summary:
100% Final Construction Documents & Bidding
· Topographic survey for remaining areas (confirmation of Wenck ROW boundary) and
base-map updates in an AutoCAD format.
· Preparation of temporary/permanent easement sketches, legal descriptions, and staking
of easements in the field. Cities will coordinate and provide title work/searches and
owner negotiations. Lennar project easements not needed.
· Utility coordination and two meetings with utility companies.
· Final design and preparation of 100% construction plans, specifications, contract
documents.
· Prepare feasibility study meeting the requirements of MN Chapter 429, preparation of
assessment roll, and attendance/presentations at public hearings.
· Prepare Intersection Control Evaluation (ICE) report for the CR 116 intersection.
· Coordinate the signal design and approval through Hennepin County.
· Stormwater management design (interim conditions) and preparation of SWPPP.
· Submit plans/permit application to watershed district for permanent stormwater
management and construction related erosion control.
· Prepare wetland impact permit application, coordinate mitigation or credit request.
· Prepare a cost estimate at 90% and 100% completion to the City for the road, trail,
stormwater management, and the CR 116 signal location.
· Submit final plans and SEQ to MnDOT for review and approval meeting State Aid
Requirements.
· Prepare LRIP agreement and coordinate approvals for use of grant funds on project.
· Constructability review and QA/QC coordination.
· Bidding services, attend bid opening, coordination and preparation of bid tabulation.
Provide brief memorandum for Council agenda packet.
Stakeholder Engagement & Public Involvement
· Project meetings with the staff of both Cities (simultaneous) including one for a kick-off
and one every month thereafter through December (total of seven meetings).
· One meeting that includes Hennepin County, Medina, and Corcoran.
· Two City Council meetings with each of the Cities (total of four meetings), one at
approximately 90% design and the other at the approval of plans/specifications. Provide
presentation and brief memorandum for Council agenda packets as needed.
· Meetings with property owner groups, two total meetings.
· Public involvement including one community engagement activity, virtual or in-person.

· Materials testing in accordance with MnDOT standards.
· Preparation of record drawings (both roadway and wetland impacts).
· Project documentation review and prevailing wage compliance coordination.
· Warranty inspection and coordination.
DETAILED SCOPE OF SERVICES FOR 100% DESIGN & BIDDING
The following is a list of deliverables needed to complete the engineering and design components
of the project at a 100% level of design, final construction plans, construction documents,
specifications, and bidding services.
Project management is a key component included in each task as proposed. Within each task
and deliverable, project coordination and communication with both Cities, residents, other project
stakeholders, and the project design team will be critical for success. Active project management
and utilization of WSB’s project controls group will allow for open lines of communication and
routine updates on project issues, as well as keeping the project on schedule and within budget.
Topographic Survey, Boundary Confirmation & Base-Mapping Updates
A design level topographic survey was completed prior for the project between Wenck & WSB for the
general corridor area within public right of way to identify surficial information/landmarks, existing
grades, and public/private utility locations. Because Wenck completed the original survey of the
boundary and right of way line work, WSB will need to confirm with shots of additional property
corners and review with available monumentation. The final AutoCAD base-mapping information will
not constitute an official boundary survey, but a high-quality survey grade right-of-way/parcel map will
be created using available plat maps and existing field survey shots. The cost of document fees for
official plats, title work, or easement documents have not been included with this proposal.
The overall task will also include additional topography work in areas beyond the public right of way
where the proposed design extends into these areas and finalizing an AutoCAD base map with the
additional information for the purposes of final design, notification of private utility companies within
the project corridor, and any other related information for the area that may impact design or future
construction. In addition, once private utility mapping is received and reviewed, the scope of the
survey work will include additional field shots and verification of private utility lines that may have
changed since the original survey was completed.
100% Design and Final Construction Plan Preparation
WSB will complete 100% final design and prepare a set of final construction plans in accordance with
MnDOT State Aid Highway standards. WSB will coordinate its work closely with the Cities of Medina
and Corcoran, MnDOT State Aid, and other public agencies (including Hennepin County) during the
entire design process to ensure that agency requirements are met. We will work together with both City
staff during the final design task to determine any further cost saving means and methods of
designing and constructing the proposed street and trail improvements.
The plans will detail the improvements including the roadway typical street/pavement sections,
quantity tabulations with MnDOT SEQ, removals and restoration, plan/profiles for street/storm sewer
improvements, signal design at CR 116, temporary/permanent signing/striping, construction traffic

control, erosion control, SWPPP, cross sections, and other plans required to meet the governing
agency requirements for submittal at this stage of the project.
Assessment Process
We understood that the City of Corcoran is considering assessments to adjacent property owners
with the potential for subdivision. If the City elects to proceed, our team will prepare a feasibility study
that outlines the project necessity, feasibility of constructing the improvements, review of existing
conditions, include estimated costs, and include a preliminary assessment roll.
We will assist the City of Corcoran in the special assessment process, including preparation of the
assessment roll based on the estimated project costs in conformance with State Statute Chapter 429
for special assessments. WSB will prepare for, attend, and present at both the improvement and
assessment hearings.
Final Signal Design & Coordination with Hennepin County
WSB will prepare final construction plans for the signal system at CR 116 based on the preliminary
design. The traffic signal system will be designed in conformance with all applicable state and local
electrical codes, federal and state Manuals on Uniform Traffic Control Devices (MnMUTCD), and both
MnDOT State Aid and Hennepin County standards.
The traffic signal final design and construction plans will be prepared to be included in the roadway
plans. The final plan sheets will include:
· Standard traffic signal detail sheets
· Intersection layout showing the signal phasing, detector operations, pedestrian
accommodations, and Emergency Vehicle Preemption (EVP)
· Field wiring diagram
Prepare Intersection Control Evaluation (ICE) Report
In accordance with MnDOT and Hennepin County requirements, WSB will prepare an
Intersection Control Evaluation (ICE) for a proposed revision to the Hackamore Road and CR 116
intersection. The ICE report will be prepared using the site and traffic data and analysis
previously completed.
The report will be prepared and signed by a WSB registered engineer and submitted to the Cities
for review and comment. It is assumed that the Cities will provide one set of review comments.
Following receipt of comments, a final report and recommendation will be prepared and submitted
to the Cities for final approval and signature. The document will then be submitted to Hennepin
County and MnDOT State Aid for review and approval.
MnDOT Coordination & Final Plan Submittal
WSB will prepare and submit final plans for both Cities, Hennepin County, and MnDOT State Aid
review and comments. We will provide a written comment resolution form for each submittal
addressing the comments and actions taken. We will work proactively with both Cities, Hennepin
County, and MnDOT’s review staff to address the comments in the most efficient manner. WSB will
prepare and submit a final signed and certified plan set to Hennepin County and MnDOT in order to
receive approval to let the project.
The Cites received and LRIP grant award for this project and our scope of services will also assist in
preparing the necessary MnDOT agreements and coordination with the pertinent staff for approvals.
Private Utility & GSOC Coordination
This task will include a Gopher State One Call request for utility maps to confirm the locations of
utilities match that of the original field survey, and coordination with specific utility companies that
may have conflicts with the proposed street and storm sewer installations. If potholing in the field
is necessary to determine the elevation of specific utility lines, WSB will coordinate this effort, but

the City will be responsible for contracting with a company or providing staff that can complete the
pot-holing work.
WSB will hold two formal utility coordination meetings with the affected utility providers and any
necessary meetings in the field to discuss specific impacts, if needed. It has been assumed there
will be utility impacts and modifications needed to complete the reconstruction as proposed and
this task includes the coordination necessary with the private utility owners to accommodate
relocations. The scope of work does not include interpretation or enforcement of the cities
franchise agreements for the costs of relocation or undergrounding of utilities.
Stormwater Management Design & Permitting
WSB will provide final design services for the storm sewer system and BMPs for the proposed
Hackamore Road improvements in accordance with both Cities and ECWMC’s design
requirements. Taking the 75% design to final design and construction documents for drainage
includes:
· Finalize permitting with ECWMC. The 75% plans were submitted for preliminary review
by ECWMC. They have indicated preliminary acceptance of the concept plan for the
project and the potential for it to meet the Commission requirements. However, they will
require a full submittal (Erosion sediment control, SWPPP, updated BMP design using
adjacent developments for a portion of compliance, evaluation of interim conditions, etc).
Based on the initial permit submittal comment memo from ECMWC, this includes:
o We have included in our scope response to one round of ECWMC comments.
o Both the Reserve of Medina and Tavera have submitted plans for approval from
ECWMC that included treatment of impervious areas from the Hackamore Road
project. We have assumed that no additional rate control analysis for those
portions of the road project will be required.
o We have budgeted for a total of 6 hours of coordination and updates with the
Tavera developer’s engineer. This development has continued to progress since
the 75% submittal date. We will update the design and permit memo as needed
to reflect the updates for the Tavera development.
o We have assumed that the other future developments along the corridor have
not progressed since the 75% plans were completed and sent to ECWMC.
o Since the developments at the NE quadrant of CR 116 and NW quadrant of CR
101 have not proceeded, ECWMC staff have indicated that interim BMPs may
be needed to mitigate downstream erosion and discharge rate increases. We
have assumed that interim BMPs will be needed at 2 locations. We will design
interim BMPs to address the temporary conditions until developments occur on
these properties. It is assumed that ECWMC will approve an interim solution that
allows Hackamore Road to be built adjacent to these properties and full BMP
designs to be provided at a later date when the developments occur.
· Prepare 90% and 100% drainage plans, specifications and engineering cost estimates.
Our budget assumes that no major changes will be required to the roadway profile and
typical section from the 75% submittal.
· Prepare and submit the State Aid Hydraulic submittal.
· Prepare a summary Stormwater Report for submittal to ECWMC, including an
accounting of the proposed impervious values to be routed to future developments for
tracking at the NE quadrant of CR 116 and NW quadrant of CR 101.
· The final version of both the HydroCAD modeling and Stormwater Report will incorporate
any comments received from both City staff members.
· We have included 2 meetings with full project team (including both Cities) to discuss the
drainage design.
· We have included 3 meetings with ECWMC Staff to discuss the updated permit
submittal.
· We have included 2 meetings with 2 of the property owners to specifically discuss the
proposed drainage improvements.

Stormwater Pollution Prevention Plan (SWPPP) Development
This task includes the final preparation of the construction related erosion/sediment control plan
sheets and the written narrative of a Stormwater Pollution Prevention Plan (SWPPP) in
accordance with MPCA NPDES permitting requirements. The NPDES permit will not be
submitted for until the project has been bid and construction is imminent. The permit fee has not
been included but can be invoiced as a pass-through cost.
Wetland Impact Permitting
WSB will prepare permit applications and obtain permits from the following agencies, as needed:
· Elm Creek Watershed Management Commission
· Wetland Conservation Act (City of Medina and City of Corcoran)
· US Army Corps of Engineers
· MN Board of Water and Soil Resources (for Local Road Wetland Replacement Program,
if applicable)

· MN Pollution Control Agency (NPDES Construction Stormwater Permit)
Permits may also be needed for construction dewatering but will be the responsibility of the
construction contractor to obtain. This scope also assumes that any wetland impacts from the
project will fall under the USACE’s Transportation Regional General Permit or a Nationwide
Permit Category and no additional MPCA coordination will be required for Section 401
Certification.
To prepare the applications, WSB will develop a purpose and need, evaluate project alternatives,
and create impact exhibits. If the project qualifies for the BWSR Local Road Wetland
Replacement Program, WSB will develop the information for that approval as well. If the project
impacts do not qualify, WSB will identify wetland banks that meet the siting criteria for WCA and
the USACE Section 404 permit. Upon approval of permits, WSB will review permit conditions and
inform the Cities of any conditions prior to construction. Mitigation for impacts to DNR public
waters is expected to be covered by the WCA/USACE mitigation and no additional DNR-specific
mitigation will be required.
Specifications & Contract Documents
WSB will prepare final specifications, special provisions, contract documents, wage compliance
documents, and bid form(s) in accordance with both City standards and State Aid requirements
and to facilitate bidding of the project.
Cost Estimating
WSB will prepare final project cost estimate at 90% and 100% completion levels that includes the
proposed street, trail, intersection control (signal) improvements, stormwater management
components, and associated overhead allotments. The costs will be split by funding categories in
accordance with what MnDOT requires for a State Aid compliant plan.
Quality Control
Within all tasks of this project, WSB will implement plan review and quality assurance/quality
control procedures and protocols for the proposed design and plans. This will provide the client
with a high level of plan/document quality and future constructability.
Public Engagement & Stakeholder Involvement
WSB will hold project meetings with the Cities and other stakeholders throughout the design process
to ensure the final product meets the intended need. The meetings will include one kick-off meeting
with both City staff members upon authorization of the proposal, six progress/design meetings with
both Cities (simultaneously) approximately every month, three City Council meetings (two with
Median and one with Corcoran), two separate public hearings at the City of Corcoran for the Chapter

429 assessment process, one community engagement activity with affected residents or other
stakeholders, a total of two meetings with property owner groups in the field to discuss project related
impacts, and one meeting that includes Hennepin County and both Cities. WSB has excellent working
relationships with the regulatory agencies and will plan early and frequent communication in order to
keep the permitting process on schedule.
WSB will provide the necessary graphics, maps, and presentation materials to be used at the public
engagement activity and project meetings. We will work with the staff members of both Cities to
develop and mail the required notices for project meetings and prepare any necessary resolutions for
City Council meetings, if needed. WSB can provide a formatted notice to be sent to property owners
or other stakeholders, but the City will mail the notices using City stationary and address labels.
Bidding Services
WSB staff will prepare the advertisement for bids, respond to contractor questions, attend the bid
opening at City Hall, provide a bid tabulation, tabulate the bids, evaluate qualifications, and
provide an award recommendation. It has been assumed that no pre-bid meeting will be required
and that bidding will occur in an electronic format.
Easement Sketches & Staking
There are a37 total parcels adjacent to Hackamore Road through the 1.4 miles of the project
area. Of those parcels, our design team identified approximately 22 that may have a need for
temporary, permanent (or both) easements. The scope of work will include the additional field
work to verify parcel boundaries and the necessary updates to the AutoCAD base-mapping.
We will also prepare temporary/permanent easement sketches, legal descriptions, and provide
staking of easements in the field (one set for each property). We did not include easements for
the Lennar parcel(s) west of CR 116. It is expected that the cities will coordinate and provide the
title searches for each of the properties, negotiate with the property owners, and draft the
required conveyance documents if needed.
We understand that some properties may have existing easements and some time has been
included for identifying these through the title work. However, if there are a significant amount of
them and/or are highly complicated, the time and fee for our services could vary and increase; we
will not know how this could vary without reviewing the title work first.
DETAILED SCOPE OF SERVICES FOR CONSTRUCTION SERVICES
The following is a list of detailed deliverables needed to administer the construction phase of the
project. WSB will provide the necessary project management and inspection services to ensure
the construction phase proceeds according to the plans and specifications. Based on our
knowledge of this project, we anticipate 22 weeks of active construction in 2023; it is understood
that final project completion including wear course will be in 2023.
It is understood that the Cities may utilize State Aid funding for this project and therefore
materials testing and wage compliance procedures will be required and the necessary oversight
achieved with our scope of services to allow for retroactive MSA or grant funding reimbursement.
Project Management
WSB will provide project management throughout the duration of this project. This will include the
following deliverables:
· Prepare materials for and attend the preconstruction meeting and weekly on-site meetings
for the duration of the project.
· Prepare materials and coordinate private utility relocations prior to construction.
· Communicate with the City Engineer’s and Contractor to address project related issues.

· Coordinate signal construction with Hennepin County.
· Review shop drawings, respond to RFI’s, prepare any necessary plan revisions, and
coordinate with the contractor and cities on any plan changes.
· Provide understanding of City’s standard construction practices as they relate to the
project.
· Provide the necessary resources and direction to WSB personnel to ensure project
compliance and quality results.
· Review and verify prepared pay vouchers and documented quantities.
· Provide the tools and equipment needed to WSB personnel to perform and meet the
expected outcomes of the project including cell phones, computers, iPad’s, PPE, testing
equipment, and additional supplies needed to perform the work.
· Provide services required under this contract as necessary to accommodate the
contractor’s schedule.
Contract Administration
WSB will provide contract administration for this project. Our project team will work with the
contractor and the Cities to ensure construction work and activities will be constructed in
accordance with the plans and standards and are correctly and adequately documented throughout
the project. Scope of work for this task includes:
· Attend construction meetings for close coordination of day-to-day progress of work and
ensure the project is being completed as intended.
· Communicate regularly with involved stakeholders to keep them informed regarding the
impact of construction to the area, including neighbors, businesses, and local agencies.
· Review, document and file contractor permits, submittals, test reports, and certificates of
compliance.
· Verify and review all labor submittals meet requirements.
· Accurately verify contract pay items daily.
· Prepare all pay vouchers in accordance to project revenues and expenses.
· Prepare contract change documents and cost estimates with negotiations with the
contractor on any contract changes.
· Respond to all contractor requests for information (RFI).
· Complete all necessary field finalizing of the project documentation in accordance with
project specifications.
Construction Observation and Inspection
WSB will provide Construction Observation and Inspection services through construction of the
project and final project closeout. This task will include:
· Record all construction activities daily, making a complete and accurate record of all
events.
· Ensure construction practices and materials used on site are compliant with project
specifications.
· Accurately measure and record contract pay items daily.
· Perform daily reviews of construction signing, detour signing, and construction traffic
control maintenance.
· Perform monthly labor compliance interviews.
· Communicate regularly with the Project Manager, Contractor, Cities, and involved
stakeholders.
· Perform reviews of temporary and permanent erosion control measures on the project for
compliance to applicable permits and specifications.
· Provide services required under this contract as necessary to accommodate the
contractors schedule and needs.
· Exercise the “Authority and Duties of the Inspector” as necessary.

Construction Staking
WSB will provide Survey services through project construction. This will include:
· Verifying datum points are accurate and correct.
· Provide all required construction staking including setting benchmark elevation locations.
· Providing and maintain records for as-builts.
· Coordinate with contractor on private utility relocations.
Depending on project sequencing and workload, as determined by the contractor, we will adjust
our staffing needs accordingly.
Materials Testing
WSB will conduct materials testing for the project in compliance with State Aid requirements. The
testing is conducted to verify that what materials the contractor is procuring for the project are
consistent with the construction specifications. The deliverable for this task will include plant
inspections, materials certification review, certification summary, and any exception reports
required.
Project Closeout, Wage Compliance, & Documentation Review
WSB will review project documents including those as a result of the materials testing, wage
compliance, and other required documentation. This work is an effort to complete this project
under the requirements of MnDOT State Aid.
Record Drawings
WSB will prepare record drawings for the project upon completion of construction. This task will
include a field survey of the final invert elevations of any storm sewer, hydrants, or sewer
manholes as well as updates to the pertinent plan sheet information. WSB will provide hard
copies to City staff, update the City’s Datalink system mapping, and provide a link to the
electronic record plan pdf.
Warranty Inspection
WSB will conduct a warranty review of the project with City staff and prepare a letter of final
acceptability prior to the expiration of the warranty period.

Right-Of-Way Acquisition/Coordination
Our right of way group has extensive experience acquiring right of way for Cities, counties,
MnDOT and outstate DOT’s as well. These acquisitions were completed on a variety of types of
properties including residential, commercial, industrial, agricultural and recreational land. Our
approach on all our projects is to treat the owners respectfully, listen to their concerns and work
to address them, if possible, without compromising the needs and integrity of the project
schedule. A determination of the scope of this work can be determined once the affected parcels
are identified.
