HomeMy WebLinkAboutResolution 2009-06 Authorizing Elm Creek Watershed to Develop TMDLCity ()jCohcohan 701Inty of Het neplan State of Atli.*nnesota CITY OF CORCORAN RESOLUTION 2009-06 MOTION BY: Gmach SECONDED BY: Milbrandt A RESOLUTION AI1�'HORIZING THE ELM CREEK WATERSHED MANAGEMENT COMMISSION TO DEVELOP A TOTAL MAXIMUM DAILY LOAD FOR ELM AND RUSH CREEKS AND FOR DIAMOND, FISH, FRENCH, AND HENRY LAKES WHEREAS, Elm Creek is currently listed for dissolved oxygen i Water Act's 303 (d) list of impaired waters; and mpairment on the Federal Clean WHEREAS, the upstream reaches and tributaries of Elm Creek (Rush and Diamond Creeks and French, Diamond, Fish and Henry Lakes) are listed for a range of impairments, including excessive nutrients, dissolved oxygen, and biotic health, on the Federal Clean Water Act" s 3 03 d) list of impaired waters; and WHEREAS, a T otal Maximum Daily Load (TMDL) and Implementation Plan must be prepared for each Impaired Water, identifying the contributors to the impairments and outlining a plan for returning the waters to an unimpaired state, and W�IEREAS, the L11�1 Creeh Watershed Management Colnnlission (Commission) is currently completing a program to monitor rim Creek, Rush Creek, North Fork Rush Creek, and Diamond Creek and Weaver, Fish, Diamond, Cowley, Henry and Rice Lakes that will allow the Commission to begin development of strategies to complete a TMDL analysis of the stream network in the watershed; and WHEREAS, a Work Plan to conduct a watershed. -wide TMDL was developed by the Commission's Technical Advisory Committee to address all blown impairments in the Elm Creel{ watershed; and WHEREAS, the Commission will pa�tner with Three Rivers Park District and Minnesota Pollution Control Agency (MPCA) to develop the TMDL at an anticipated total. project cost of $443,000; and WHEREAS, the watershed -wide TMDL will be implemented in Phases as described in the Watershed -wide TMDL Work Play, and WHEREAS, Phase I (excluding Commission ($20,000/year), MPCA Task 1.6) will be funded ($35,000), a11d Three Rive��s tlu ough Park D contributions from 1st11Ct (111-1C111d, 25, the WHEREAS, the contribution for funding to this project by individual. cities will come from the annual member assessments to the Elm Creek Watershed; and WHEREAS, implementation of subsequent Phases will be dependent on continue MPCA as outlined in the Work. Plan; and d funding from WHEREAS, the Con�nission alld Three Rivers Park District will work with YWCA to identify/secure long-term funding; and WHEREAS, as stakeholders, the member communities are reduired to be participants in the development and implementation of the TMDL. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORCORAN, MINNESOTA* that the City of Corcoran hereby authorizes the Elm Creek Watershed Management Commission, on its behalf, to begin development of a comprehensive TMDL and Implementation Plan for the impaired waters in the Elm Creek watershed.
