HomeMy WebLinkAboutResolution 2009-07 Ess Addition Preliminary PlatCITY OF CORCORAN RESOLUTION 2009-07 Motion By: George Gmach Seconded By: Ron Thomas APPRQVING PRELIMINARY PLAT FOR "ESS ADDITION" ON PROPERTY LOCATED AT THE NORTHWEST QUADRANT OF THE INTERSECTION OF HIGHWAY 55 AND PIONEER TRAIL WHEREAS, Troy and Thomas Ess have requested approval of a preliminary plat to allow subdivision of the existing 69.42-acre parcel into 2 lots and one outlot on property legally described in Appendix A. WHEREAS, the Planning Commission has reviewed the preliminary plat at a duly called Public Hearing and recommends approval, and, NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORCORAN, MINNESOTA, that it should and hereby does approve the request by Troy and Tom Ess for a preliminary plat, subject to the following conditions: 1. A preliminary plat is approved, in accordance with the plans received by the City on January 23, 2009, except as amended by this resolution. 2. The applicant shall dedicate the 80-foot wide public street right-of-way from Pioneer Trail to the western lot line of Lot 1, Block 2 in order to provide the required public street frontage for this new lot. 3. The applicant shall provide a 40-foot �/z right-of-way on the north lot line of Lot 1, Block 1. 4. The applicant shall provide an 80-foot wide road easement in favor of the City for the portion of this future collector road that crosses Outlot A. The easement shall be on forms acceptable to this City and shall be submitted to the City for review and approval prior to recording. 5. The small parcel created north of the new right of way and east of Lot 1, Block 2 shall be platted as an outlot. No development would be allowed on this parcel without City approval of a final plat. 6. The applicant must provide the city with a copy of the existing driveway easement across Outlot A for use by Lot 1, Block 2. The easement may be used until such time as a public road is constructed to provide access to the home site. At that time, the driveway easement shall be vacated and access will be via the new public street. The city accepts no responsibility for maintenance of the private drive within the public right-of-way. The easement must be revised to address these issues. This revised easement shall submitted for review and approval by the City and then shall be recorded at Hennepin County with the final plat. Resolution 2009- Page 2 7. The existing conditions plan must be revised to show the existing well and septic on Lot 1, Block 1. 8. The existing conditions plan must be revised to show the existing well on Lot 1, Block 2. 9. Outlots will not be developed at this time and, therefore, shall be exempt from wetland buffer monument signage requirements. When development occurs, the site shall be subject to the wetland buffer monument signage requirements in place at that time. 10. The applicant shall install wetland buffer monument signs on Lot 1, Block 1 and Lot 1, Block 2. A financial guarantee shall be provided to the City as required by Section 960.050 to ensure installation. Signage must be obtained from the City of Corcoran and installed per City requirements. 11. The applicant shall comply with all conditions in the City Engineer's letter dated January 287 2009. 14. However, future subdivision of these parcels and future platting of Outlot A shall be subject to the park dedication policy in effect at the time.
