RESOLUTION NO. 2009-52

A RESOLUTION TO APPROVE A TOPOGRAPHY AND WETLAND DELINEATION
WAIVER FOR PLATTING OF THE ARMBRUSTER AT 22963 COUNTRY ROAD 50
(PID 29-119-23-22-0003)
WHEREAS, the applicant has requested a waiver from the topography and wetland
delineation requirements for a preliminary plat as allowed in Section 930.020, Subd.
6(B)2 and 3 of the Corcoran Subdivision Ordinance; and
WHEREAS, the Corcoran City Council reviewed this item at their meeting on November
23, 2009; and
NOW THEREFORE BE IT RESOLVED that the Corcoran City Council approves the
topography waiver based on the following findings:
1. The property has 7 building rights remaining.
2. No new development is proposed at this time. The property has one single
family home in the southeast corner of this 75-acre parcel and the property is
currently farmed.
3. A topographic survey and wetland delineation shall be required prior to issuance
of a building permit for any new development on the home site lot.
4. A topographic survey and wetland delineation shall be required prior to further
subdivision.
5. The applicant is not proposing any development at this time; therefore, well and
septic design and location is not required as part of the preliminary plat
application. Well and septic information shall be required prior any further
subdivision.
6. The applicant must submit all other items as required for preliminary plat
approval.
7. The existing use is consistent with the City’s Comprehensive Land Use Plan.
8. The use is generally consistent with the Zoning Ordinance and Subdivision
Ordinance.
9. No other waivers or variances are granted.
10. By granting the topography waiver in no manner grants or implies approval of
any plat.
