HomeMy WebLinkAboutResolution 2009-56 Bechtold Severson Preliminary PlatCITY OF CORCORAN RESOLUTION 2009-56 A RESOLUTION APPROVING A PRELIMINARY PLAT TO BE KNOWN As "BECHTOLD FAMILY ACRES" FOR THE BECHTOLD PROPERTY LOCATED WEST OF BECHTOLD ROAD (PID 08-1 19-23-1 1 -0005) WHEREAS, the applicant has subdivision of the existing 46.65 follows: requested approval of a preliminary plat to -acre parcel into 2 lots on property legally described as That part of the North Half of the Northeast Quarter of Section 8, Township 119, Range 23, Hennepin County, Minnesota, that lies East of the West 907.70 feet thereof, except the East 660.00 feet of the North 330.00 feet thereof. WHEREAS, the Planning Commission has reviewed the preliminary plat at a duly called Public Hearing and recommends approval, and; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORCORAN, MINNESOTA, that it should and hereby does approve the request for a preliminary plat, subject to the following conditions: 1. A preliminary plat is approved, in accordance with the plans received by the City on October 22, 2009 and revisions received on November 20, 2009, except as amended by this resolution. 2. The previous subdivision that was approved in 2008 for "Bechtold Family Acres" is invalidated and shall not be recorded. 3. The property currently has 1 building right remaining. The 1 building right will be assigned to Lot 1 and zero building rights will be assigned to Outlot A. Until such time as Bechtold Road is paved; or the City of Corcoran amends the City Code to allow further development on a gravel road; or Outlot A is combined with the 78.96- acres owned by the Bechtold's located north of it (PID #05-119-23-44-0001); Outlot A shall have Zero (0) building rights remaining and further subdivision or development shall not be allowed. Resolution 2009-56 Page 2 4. There are no wetlands on Lot 1. There are wetlands on Outlot A, but that outlOt will not be developed at this time and, therefore, shall be exempt from wetland buffer monument signage requirements as per Resolution 2008-30. When development or future subdivision occurs on Outlot A, the site shall be subject to the wetland buffer monument signage requirements in place at that time. 5. The applicant shall provide the approved preliminary and final plat drawings to the City in an electronic (AutoCAD) format. 6. Park dedication fees shall be a trail easement on the 80-acre Bechtold property located north of this site as volunteered by the land owner. The total area of the trail easement shall be 1 net acre. a. The donation of the trail easement shall satisfy the park dedication requirements for Lot 1, Block 1, Bechtold Family Acres only. b. Prior to release of the final plat for recording, the applicant and landowner shall prepare a trail easement document and trail easement exhibit for review and approval by the city. c. It shall be the applicant's responsibility to show the City that the proposed trail easement will meet these minimum 1 net acre area requirements. The total area of the trail easement shall be noted in the trail easement document and exhibit. d. It shall be the applicant/landowner Is responsibility to record this easement at Hennepin County. e. The applicant/landowner shall be responsible for meeting all Hennepin County requirements. f. Proof of recording shall be provided to the City prior to issuance of building permits and prior to release of any remaining escrow. 7. Prior to issuance of building permits: a. The final plat, resolutions and trail easement shall be recorded at Hennepin County by the applicant/landowner and proof of recording shall be provided to the City. b. Lot monuments shall be installed as required by the Subdivision Ordinance. c. The applicant shall show the location of the well and primary/septic on the plans. d. The septic designs shall be approved by Hennepin County and proof of approval shall be provided to the city. e. A driveway culvert shall be installed for Lot 1, Block 1. Culvert size, type, location and purchase shall be coordinated with the City Public Works staff. Drainage calculations shall be submitted to the City Engineer to verify the sizing of the culvert.
