HomeMy WebLinkAbout2008-47 Board Resolution for the City CouncilCity of Corcoran County of Hennepin State of Minnesota CITY OF CORCORAN RESOLUTION 2008 47 MOTION BY: SECONDED BY: Tho mas Grabowski BOARD RESOL�JTION FOR THE CITY COUNCIL OF THE CITY OF CORCORAN The undersigned, constituting the members of the City C Corcoran (the "Employer"), a Minnesota governmental entity, resolutions in writing pursuant to applicable Minnesota law. ouncil ("Council") of the City of do hereby adopt the following WHEREAS, the Employer previously adopted the City of Corcoran Health Reimbursement Arrangement (the "Plan") effective January 1, 2007; WHEREAS, Article XI of the Plan provides that it may be amended, in whole or in part, at any time, by the Managing Body of the Employer; NOW THEREFORE BE IT RESOLVED, as the Managing Body of the Employer, the Council hereby amends the Plan by adopting the amendment attached here to, effective January 1, 2009, providing the following: • Participants will be allowed to suspend their participation in the Plan for a future Plan Year by submitting a Health Reimbursement Arrangement Suspension Election Form to the Employer before the beginning of that Plan Year. ATTEST: Kim Bachm City Cler Ken Guenthner, Mayor City Seal H:\City Hall Information\Resolutions\Resolutions 2008\2008-47 Board Resolution for the City Council. do c PLAN AMENDMENT TO THE CITY OF CORCORAN HEALTH REIMBURSEMENT ARRANGEMENT Pursuant to the authority retained by the Employer under Section 11.1 of the City of Corcoran Health Reimbursement Arrangement (the "Plan"), the Plan is hereby amended as follows, effective January 1, 2009: ❖ Anew definition "Suspension Election Form" has been added to Article II "DEFINITIONS". Suspension Election Form means the form provided by the Claims Administrator for the purpose of allowing a Participant to suspend his or her HRA Account for the P Ian Year. ❖ Anew Section 4.7 "Election to Suspend HRA Account" has been added. 4.7 Election to Suspend HRA Account. A Participant may elect to suspend his or her HRA Account for any future Plan Year by submitting a Suspension Election Form to the Plan Administrator before the beginning of that Plan Year. a) The Participant's suspension election will remain in effect for the entire Plan Year to which it applies, and the Participant may not modify or revoke the election during that Plan Year. The Participant will not receive reimbursements for any eligible Health Care Expenses incurred during the Plan Year to which the suspension election applies. b) During the suspended Plan Year, a Participant will also not receive reimbursements for any eligible Health Care Expenses incurred in the Plan Year before the suspension election becomes effective. c) If a Participant suspends his or her HRA Account for a Plan Year, the Employer will not make any contributions to the HRA Account during that Plan Year. ❖ Section 5.3 of the Plan titled "Claims for Reimbursement" has been changed to read as follows: 5.3 Claims for Reimbursement. A Participant may elect to make claims under this Plan by completing and submitting a claim form or, if such service is provided by the Claims Administrator, to have claims under this Plan made automatically on his/her behalf as further described below. Such an election shall be made by completing a form provided by the Plan Administrator. If no such election form is submitted, the Participant must make claims via claim forms. An election regarding the filing of claims may be changed at any time by a Participant upon submitting a new election form to the Plan Administrator. determined in accordance with Article VII. A claim must be submitted for payment within twelve (12) calendar months following the close of the Plan Year in which the Health Care Expense was incurred. Where circumstances beyond the Participant's control prevent submission within the described time frame, notice of a claim with an explanation of the circumstances may be accepted by the Claims Administrator as a timely filing. b) Notwithstanding the foregoing, however, if a Participant elects to suspend his or her HRA Account pursuant to Section 4.7 above, during the suspended Plan Year, the Participant will not be permitted to submit claims for reimbursement of any eligible Health Care Expenses incurred in the Plan Year before the suspension election becomes effective. c) Automatic claims reimbursement, if such service is provided by the Claims Administrator, shall be available to Participants actively employed by the Employer for Health Care Expenses describe in Section 2.15(a)(i).
