No.'s 26419-2341-0022 WHEREAS, the past records of the City of Corcoran and Hennepin County do not reflect that a Conditional Use Permit exists for 19905 County Road No.10; and WHEREAS, the Corcoran City Code in effect for that the prof ect be approved as an amendment to the the NAPA Store expansion of 1 Conditional Use Permit; and 999, required WHEREAS, the current building at 19905 County Road No.10 is a legal non -conforming building because it does not meet the setback requirements of the Corcoran City Code; and WHEREAS, the applicants Ron and Julie Reh doing business as RJ's Corner Store have requested an amendment to its existing Conditional Use Permit for the construction of a new 8 foot by 25 foot addition to their building, which will contain a restroom and storage/service area; and WHEREAS, building; and the proposed building addition will not increase the legal non -conformity of the WHEREAS, the Corcoran Planning Commission has reviewed the Amendment to the Conditional Use Permit at a duly called Public Hearing held on December 6, 2007, adopted Findings of Fact and recommends approval; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORCORAN7 MINNESOTA, that RJ's Corner Store and its predecessor have been operating at 19905 County Road No.10 under the Conditional Use Permit requirements of the Corcoran City Code. BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORCORAN, MINNESOTA, that it should and hereby does approve the Amendment to the Conditional Use Permit for Ron and Julie Reh doing business as RJ's Corner Store, allowing the construction of an 8 Foot by 25 foot addition to their building, which will contain a restroom and storage/service area; subject to the following findings and conditions: 1. The applicant shall comply with the recommendations cited in the November received from B onestroo and any amendments thereto . 15, 2007 letter 2. The applicant shall provide a simple landscape plan showing the location, type and size of six new shrubs to replace those which may be lost to the additions construction. If possible the shrubs shall be installed on the Highway 10 or Highway 116 sides of the building. 3. If necessary, relocate the existing sidewalk on the west side of the building so it is more conducive to pedestrian use. 4. The building addition shall be constructed of steel siding and a paint system that matches the existing building structure.
