HomeMy WebLinkAbout2008-04 Pr Ck Est Rev Final Plat TABLEDCity of Corcoran County of Hennepin State of Minnesota CITY OF CORCOR.AN RESOLUTION 2008-04 MOTION BY: SECONDED BY. ` A RESOLUTION APPROVING THE FINAL PLAT FOR "PRAIRIE CREEK E PROPERTY LOCATED AT 10435 COUNTY ROAD NO.19 P.I.D. No.'s 06419-23-31-0001 & 06-119-23-32-0001 " ON WHEREAS, Mr. Michael Leuer has requested approval of a final plat to create three (3) lots and five (5) outlots on the property legally described as follows: "The South 40 rods of the North 60 rods of the Southwest Quarter of Section 6, Township 119, Range 23, Hennepi n n County, Minnesota. (In 2 earlier deeds, Doc. No. 491725, Recorded May 6, 1908 and Doc. No. 7959305 Recorded April 7,1915, this property was described as "the Center 40 acres of the North Half of the Southwest Quarter".) The North 20 acres of the North Half of the Southwest Quarter of Section 6, Township 119, Range 23, Hennepin County, Minnesota." and; NOW, TI-IEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORCOI�►AN, MI11 EjSOTA, that it should and hereby does approve the request by Mr. Michael Leuer for a final plat, subject to the following findings and conditions: FURTHER, that the development contract for said plat shall be completed by the City Attorney and that the Mayor and City Clerk are authorized to execute the development contract on behalf of the City; and FURTHER, that the final plat shall be subject to the following findings and conditions: 1. A final plat is approved to allow the creation of Lot 1, Block 1; Lot 1, Block 2; Lot 1, Block 3 ; and Outlots A, B, C, D and E in accordance with the plans and application received by the City on November 8, 2007, except as amended by this resolution. 2. Outlots A, B and C will be owned by a Homeowners Association and covered by a conservation easement and restrictions in favor of the City of Corcoran. 3. No future subdivision of Outlots A, B and C shall be allowed. 4. Future subdivision of Outlots D and E will be allowed pursuant to the approved Final Plat for Prairie Creek Estates (entire project), approved September 13, 2007, via Resolution 2007-66A. �I 5. All conditions of the preliminary plat must be met. �. Lot 1, Block 3 shall be allowed access to Meadow Creek Drive via a driveway easement following the future road right of way for Prairie Creek Court. This driveway easement shall expire when the roadway for Prairie Creek Drive is platted in Phase 3. 7. A Developers Agreement will be required for Phase 1 of Prairie Creek Estates to insure that the private improvements proposed by the Developer are installed. Future phases will also require the Developer to enter into a Developers Agreement with the City of Corcoran. $. Prior to release of the final plat, the Developers shall satisfy the amount of the Transportation Area Charge by submitting an irrevocable letter of credit in the amount of $16,000 to the City in a form acceptable to the City. The letter of credit shall remain in place for a period of one-year from the date of submission and shall be payable at the bank issuing the letter upon presentation by the City, whether in person or by mail, of a signed statement evincing the assessment of the charge. All costs associated with obtaining the letter of credit shall be paid by the Developer. 9. Prior to release of the final plat, the Developers shall pay Park Dedication fees for the two (2) lots, subject to the park dedication requirements at the time of the release of the final plat for filing. Currently the "cash" donation would total $12,0000 10. The applicant must file the final plat at Hennepin County. 11. The approved Preliminary Plat for Prairie Creek Estates shall expire December 31, 2012, unless an extension is granted by the City of Corcoran. All final plats for future phases 2 and 3 must receive approval from the City of Corcoran by December 31, 2012, unless an extension is granted by the City of Corcoran. 12. The Developer may continue to farm ()utlots A., B, C, D and E until the final plat for Phase 2 has been recorded. 13. Resolution 2007-66A is hereby rescinded.
