AN INTERIM ORDINANCE PROHIBITING THE SALE OF EDIBLE CANNABINOID
PRODUCTS WITHIN THE CITY LIMITS OF THE CITY OF CORCORAN
THE CITY COUNCIL OF THE CITY OF CORCORAN, MINNESOTA, ORDAINS:
Section 1. Purpose and Authority. The Minnesota State Legislature recently adopted
revisions to Minnesota Statutes §151.72, making the sale of certain edible
cannabinoid products legal in Minnesota. The changes to this law became
effective July 1, 2022. The City of Corcoran City Council desires to exercise its
authority pursuant to Minnesota Statutes §462.355, subd. 4 and adopt this
Interim Ordinance for a period of one year to allow the City to study the impacts
of the new legislation and determine appropriate measures, if any, to regulate the
sale of edible cannabinoid products, as defined in Minnesota Statutes §151.72,
in order to protect the City’s planning process and the public health and safety of
Corcoran citizens. A Moratorium on the Sale of Edible Cannabinoid Products
within the City of Corcoran. The Corcoran City Council hereby declares a
moratorium, under the authority of Minn.
Section 2. Stat. §462.355, subd. 4, prohibiting the sale of edible cannabinoid products, as
defined by Minnesota Statutes §151.72, within the city limits of the City of
Corcoran. During the effective period of this Interim Ordinance, no business,
person, or entity may sell or offer for sale any edible cannabinoid product, nor
direct another to sell or offer for sale any edible cannabinoid product, within the
City of Corcoran.
This moratorium shall not apply to the sale of those products which were lawful to
sell immediately prior to the amendment to Minnesota Statutes §151.72, which
became effective on July 1, 2022.
The moratorium created under this section shall be for one year from the
effective date of this Interim Ordinance unless earlier removed by City Council
action.
Section 3. Study. The Corcoran City Council hereby authorizes and directs City staff to
commence and conduct a study of the issues related to the sales of edible
cannabinoid products and bring back recommendations as to whether
amendments should be made to the City’s zoning, licensing, or general code
provisions in order to better protect the citizens of Corcoran.
Section 4. Enforcement. A violation of this Interim Ordinance shall be a misdemeanor.
Further, the City may enforce this Interim Ordinance by injunction or via any
other appropriate legal or equitable remedy.
Section 5. Effective Date. This Interim Ordinance shall be effective upon adoption and
publication according to law.
