Tim Holmquist of the Lions would like to update the council on their activities for the coming year. 6) Planning and Zoning. None 7) Engineering. a) TIF Project and other engineering updates. See the memo from the engineers. b) Streeter /Ryan Turn back Proposal. Ken Streeter appeared before the council last November asking if the city would be interested in the property at no cost to the city. I brought this to the P & T Commission on Feb. 15th. They are interested but need an opinion from the city engineer and from the PW Superintendent. PW is not interested as they see a maintenance headache with little value coming back to the city. This property is almost entirely a wetland, is unbuildable, and the neighbors will be after the city to maintain to a high standard. Comments from the city engineer are: i) If we pursue, we need to explore the wetland maintenance requirements, (weed control, annual reports, etc.) ii) Obtain any information on restrictive covenants /easements, iii) City Planner's /Council's /Parks and Trails commission viewpoints on parks and trails value (if any), connectivity, future potential uses. I have put on this agenda for discussion not for a decision. I have not informed Mr. Streeter that this is on the agenda at this meeting. I will invite him to the council meeting when the council is ready. 8) Public Hearing. None 9) Consent Agenda a) Council Draft Minutes of 02/10/11 10)Staff Reports. a) Cash Flow Report. Due to the crush of other financial activities, Staff will not have time until next week to work on a report with the information in a format that the council will find acceptable. I will hand out our options at the meeting. b) Development Review Committee (DRC) Report. See report. c) Planning Projects Status Update. Staff has received an application from Loren Kohnen along with previous applications received from Wu and Ravnholdt. Kadlec is an Alternate Commissioner and would like to be considered for one of the two openings for the regular positions. The complete set of applications is in the packet. At this time, there are two regular commissioner openings and one alternate opening. b) Ordinance Update Process. See my memo and a memo from the City Planner. c) 2030 Comp Plan Editing Process. The council members agreed to bring in their suggestions for the editing process at this meeting. d) Parks & Trails Student Appointment. I have received one application from a student, Charles Jacobs, and that is in your packet. The P & T reviewed his application at their meeting on Feb. 15th and they recommend his appointment. e) PW Facility Update. No information to report from staff at this time. 12)New Business a) Amendment to Ordinance 2010 -253. This ordinance on road weight restrictions was amended last March 11th. Staff at that time discussed with council the need to make an additional amendment change to the ordinances. The Road Weight Committee made up of staff, residents, and businesses that met last year recommended that during the road weight restriction period, the city make allowances to the many residents that use a commercial vehicle and keep it at their residence. Specifically, this adds Section 70.02e(4) to the ordinance and it applies to: i) Residents of Corcoran ii) Who use a commercial vehicle for work and parks it at his /her resident in Corcoran iii) Truck must be registered to Corcoran home address and the resident iv) Vehicle exceeds 4 tons per axel but no more than 5 tons (must run empty) v) Obtain no cost annual permit per vehicle b) Discussion on March 3, 2011 Joint Council and Commissions Meeting. In your packet is a suggested draft agenda for the joint meeting on March 3rd. Old Settler's Road A landowner called about possible City use of a wetland mitigation area along Old Settlers' Road. Should the Council wish to further discuss ownership, staff will need to; Obtain any information on restrictive covenants /easements, Explore any wetland maintenance requirements, (weed control, annual reports, etc Obtain Council's and parks and trails commission viewpoints on value and future use of the parcel and how it relates to transportation, etc. CSAH 116 • Vince received a call from City Engineer of Roger's requesting that Corcoran consider modifying the designation of CR 116, (north of CR 30) to an A minor arterial. This request is made in conjunction with Roger's planning for the Fletcher Bypass and it appears to be consistent with our Comp Plan. A resolution will be forwarded to the City. Present were, Mayor Guenthner, Councilor Asleson, Councilor Cossette, Councilor Gmach, and Councilor Milbrandt. Engineer VanderTop to provide more detailed information on gravity sewer line and provide a time line of next steps. An application has been received for a waiver from the topography and wetland requirements and was reviewed by the City Council on November 23, 2009. The City Council expressed concerns about the concept and directed the applicant to revise the concept plan. The applicant submitted a letter extending the review period until January 2012. This will allow the city time to complete the ordinance updates and allow the applicant additional time to explore their options for development /subdivision. 2. Rocks N Blocks Conditional Use Permit (city file no. 10 -012). An incomplete application was received for a Conditional Use Permit and Site Plan Amendment to continue operation of a business with outside storage that is operating at 20010 75th Avenue North. City staff contacted the landowner as part of a follow up to a code enforcement complaint we received. The applicant was given the option to cease and desist or to apply for an after - the -fact permit. The application is incomplete and cannot be processed without additional information. The applicant submitted additional information on February 15, 2011. Staff is currently reviewing the additional materials and will then schedule for the Planning Commission and City Council meetings. Also, there are a number of projects that have been approved, but are still not filed and closed out: 1. Ess Addition (05 -017 and 08 -005). The Preliminary Plat and Final Plat were approved by the City Council on February 26, 2009, subject to a number of conditions. The plat is currently under review at Hennepin County. The applicant has 2 years (February 26, 2011) from the final plat approval to submit the mylars for City signature and file the final plat at Hennepin County. If the final plat is not recorded by February 26, 2011, the approvals will expire. Since nothing has been submitted to the city as of the date of this report, it seems likely that the approvals will expire on the 26tH 2. Corcoran Business Park (city file 06 -005). The City Council granted a one year extension to the final plat approval, which now expires on April 12, 2011. 3. Kellys West Oaks (city file 07 -003). On August 9, 2007, the preliminary plat was approved by Res. 2007 -54. Res. 2008 -06 granted final plat approval with 7 findings and conditions on January 24, 2008, including a condition requiring vacation of an existing easement. The applicant requested and was granted a one year extension to the approvals. On February 10, 2011, the City Council approved an after - the -fact plat extension. The approvals now expire on November 1, 2011 unless the applicant has complied with all conditions of approval and recorded the final plat at Hennepin County. Savoie Fields (city file 07 -11) —Res. 2007 -50 granted a topography and wetland waiver on July 12, 2007. Resolution 2007 -71 granted preliminary plat approval on September 27, 2007 with 9 findings and conditions. On January 24, 2008 the Council voted unanimously to approve final plat Resolution 2008 -07. On December 21, 2009, the City Council approved Res. 2009 -58 extending the final plat one additional year. The final plat approvals expired on January 24, 2011. 5. Lions Park (city file 09 -001). The rezoning to PUD, PUD general plan and PUD final plan to formalize the existing land uses and allow seasonal outside motor vehicle storage was approved by the Council on August 27, 2009. The rezoning was effective on the date of approval. However, the applicant must initiate construction of the improvements PUD within one year after the effective date of the PUD rezoning by the City Council. Upon good cause shown, the City Council may extend the time for one additional year. If construction is not commenced within these time periods, any building permits issued for the PUD shall be void and the Planning Commission may initiate proceeding to rezone the subject property. The one year period ended on August 27, 2010. Staff visited the site on November 1St and noted that while some improvements have taken place, including permits along CR 101, the outside storage of vehicles was not initiated within the one year period and the approvals have expired for that portion of the project. 6. Northern Natural Gas Administrative Permit (city file 09 -009). An administrative permit for a meter station was approved and is under construction. The city will retain the escrow account until the project is completed to ensure that the project is completed according to the plans. The majority of the improvements and conditions of approval have been met. However, the landscaping has not yet been installed. Northern Natural Gas indicates that there are still connections that need to be made on site and landscaping cannot be installed until completed. They expect to install the landscaping in 2011; therefore, staff has required a financial guarantee to ensure that the required landscaping is installed. We will retain this financial guarantee until the landscaping is installed and inspected. Should they fail to install the landscaping, this financial guarantee could be cashed and the city could install the materials. 7. Gleason Administrative Permit (city file 10 -004). An administrative permit for replacement of a legal, non - conforming structure at 7105 CR 19 was administratively approved. The building is under construction. The city will retain the escrow account until the project is completed. 8. Park Place Storage Conditional Use Permit Amendment and Site Plan Amendment (city file 10- 006). On September 23rd the City Council approved Resolution 2010 -36 approving the request with a number of conditions. The applicant is working to address those conditions. 9. Satellite Industries Site Plan Amendment, Conditional Use Permit Amendment, Lot Consolidation and Easement Vacation (city file 10 -007). On September 23 d the City Council approved Resolutions 2010 -37, 2010 -38 and 2010 -39 approving the request with a number of conditions. The applicant has addressed those conditions and has submitted a building permit application and has begun site work. The city has a financial guarantee in place to ensure completion. 10. Corcoran Wildlife Preserve (city file 10 -009). Preliminary plat (city file 06 -004) was approved on September 27, 2007 (Res. 2007 -72) with 8 findings and conditions. On September 23, 2010, the city council approved Resolution 2010 -40 approving the final plat. The applicant has 1 year to address all conditions of approval and record the final plat. 11. McHugh Conditional Use Permit (city file no. 10 -013). An application was received from Bill McHugh for a conditional use permit to allow an approximately 6,000 square foot accessory building where 3,175 square feet is allowed and to allow metal siding on this accessory building. The application was heard at the January 6, 2011 Planning Commission meeting and was approved at the January 27th City Council meeting. 12. Patnode Topography and Wetland Wavier (city file 11 -011). An application has been received for a waiver from the topography and wetland requirements and was approved by the City Council at the January 27th meeting. The request is for a waiver from these requirements for construction of a new home the approximately 78 acre parcel at 23240 County Road 50. MEMORANDUM l0d.. Convene. Chair Krueger called the meeting to order at 7:04 PM in the Corcoran Community Center 2. Trish Krueger was given and recited the Oath of Office as she was recently reappointed to the Commission with a term to run to December 31, 2014. 3. Approvals: a. Agenda. i. Add 6c. Update on changes to Ordinance 36.11 ii. Add 7g. Tree Giveaway iii. Motion to approve agenda as presented: Robran /Anderson. All voted Aye (6:0). b. Minutes of 01.18.11 i. Chair requested adding Commissioner Parks to attendance rooster for the 01.18.11 Commission Meeting as she was present. ii. Motion to approve with change noted above: Robran/Vassello. All voted Aye (6:0) 4. Open Forum. None 5. Presentations. Tim Williams of the sign company Fish & LaBeau, 9350 Co. Rd. 19, Corcoran, 763.591.5800 addressed the Commission about his company's services. He had been asked to attend that meeting by Robran as they were a new sign company in Corcoran and could provide information about the varying types of signage that could be available to the city as it looks at upgrading the park signage in the city. 6. Unfinished Business a. 2010 P & T Annual Report. Donahue distributed the 2009 Annual Report that had been presented to the City Council in 2010 for review. The Commissioners had been asked to be prepared to contribute to the list of accomplishments during 2010 that could become part of the report to the city council. The list developed included: Parks & Trails Minutes 02.15.2011 i. Completion of Phase 1 of the Memorial Garden Park Development ii. P & T Commissioners participated in the Greenway Committee meetings iii. Began work and discussed at great length the issues around the Park Dedication Ordinance and its fee structure iv. Updated the P & T Plan for the 2030 Comprehensive Plan v. Began work on reviewing the P & T park standards vi. Finished the T -Ball Field improvements vii. Installed 11 new aluminum picnic tables and three new aluminum bleachers viii. Held Open House in October for the opening of the new Memorial Garden Park ix. Held tree giveaway at the annual Clean Up Day in May b. 2011 Goals and Objectives. Commissioners discussed possible goals and ideas for goals for 2011. The preliminary list includes: i. Hold a spring Memorial Garden ceremony ii. Complete the updates to the Park Dedication ordinance and fee schedule iii. Investigate the options for further development at the Rockford Schools ball field property iv. Develop a Memorial Garden maintenance plan v. Provide input on the 2012 Parks development plans and maintenance plan vi. Tree giveaway at the annual city Clean Up Day vii. Meet quarterly with the PD and PW viii. Participate in Joint City Council and Commissions meeting in March ix. Work with PW for park improvements in 2011 to include: 1. Park signs 2. better toilet facilities 3. Further development and improvements to the ball fields x. Explore the possibility of submitting a Hennepin Youth Sports Grant application for improvements to the accessibility to the Snyder fields xi. This list is to be brought back to the March P & T meeting for further consideration. Commissioners expressed interest to further Parks & Trails Minutes 02.15.2011 refining the list after the Commission meets with the City Council at the March 3rd meeting. c. Turn Back Proposal by Ken Streeter. A property owned by the Ryan Companies in Corcoran (PID: 2711923440027, which is on Old Settlers Road and at approximately 71St) and represented by Ken Streeter, has been offered to the city at no cost. The P & T Commission had expressed interest in looking at the property and responding to the city council's request for input about the property and its suitability for use as park or trail assets. Donahue provided the background details and history. The property has no building rights, the elevations put it completely within the 100 year flood plan and therefore unbuildable, has limited usable space for trails or park amenities. The commission expressed interest in exploring further. Donahue stated that the PW and city engineers would be advising the council on the suitability of the property for public use. 7. New Business a. Meet with TKDA Consultant Sherri Buss. Donahue advised the Commission that Ms. Buss was unable to attend the meeting. He further said that due to prior commitments, she is unable to attend any meeting on the third Tuesdays of the month. The Commissioners discussed and decided that if Ms. Buss was available, on Wednesday, March 16, 20111, they would move their regular meeting to this date. Donahue was asked to check on her availability and advise the Commissioners. b. Commission Applications. Donahue updated the Commission on the application process for the council appointment to the P & T Commission. He stated that he had received an application from student Charles Jacobs. They reviewed his application and are recommending to the council his appointment as a student member to the Commission. Robran indicated that he will pull together a draft presentation to the council and bring to the February meeting c. Ryan/Streeter proposal on property turnback to City. Commissioners discussed the pros and cons of the site. Hey would like Pat Meister and the city engineer to review the property and advise on its suitability for a small park. d. Fee schedule. Comments on the existing city fee schedule: i. Need fees for the ball field rentals ii. Suggest the damage deposit on City Center rental go from $250 to $350 since the memorial Park is now part of the rental package of the Community Center iii. Asked that staff review other related fees and advise. e. Joint city council and commissions meeting on March 3, 2011. Donahue passed out a suggested draft agenda for the meeting and asked for Parks & Trails Minutes 02.15.2011 comments. Commissioners liked the agenda and liked the idea for the meeting. f. Tax Forfeited Property proposal. Donahue informed the Commission of the city council decision on February 10, 2011 to ask Hennepin County to transfer two tax forfeited properties to the city for public use. The council saw merit in the properties for public use as potential Park & Trail amenities. The Commission agreed. g. Tree Givaway. Anderson discussed the information he had gathered on this year's tree program: i. Trees would be available for purchase by Corcoran residents at a nominal cost. Purchase can be made through the Wright County and the City of Plymouth web site. This information as been given to city staff for inclusion in the upcoming City Newsletter ii. The Corcoran Jaycees are again sponsoring the tree giveaway at the Corcoran Clean Up Day set for Saturday, May 7, 2011. The Jaycees are giving $500 and the P & T Commissioners will be setting up a tent and will hand out the trees to residents. Anderson passed out a selection sheet and the Commissioners selected the trees and shrubs. This information will also be included in the City Newsletter. 8. Subcommittee & Miscellaneous Reports a. City Council Liaison. Asleson updated the Commission on recent council activities. There was discussion on the proposed TIF sewer and water project; and discussed the activities on the Public Works Facility project. b. Soccer Association. Dale updated the Commission on the activities of the Soccer Assoc. There will be discussions in the near future between them and the Corcoran Athletic Assoc. about the possibility of combining the organizations. Dale also asked that the information on the field markers and strip painting information that he sent Donahue be retained and included if a grant application is submitted this year to the Hennepin Youth Sports Grant Program. Commission discussed the needs (including the field markers) of the Soccer Assoc. and asked that this item be put on the next agenda for discussion. c. Athletic Association. Dale updated the recent activates of the assoc.: i. All is going well with the baseball signups and scheduling ii. The Pancake Breakfast also went well with about an average year for attendance. He noted that our two student commissioners both helped out at the event d. Softball League. Robran updated the Commission on the Adult Softball League. Troy Nygaard will be the manager. Robran stated that the Jaycees would be donating to the city the fees for the field use by the League. 2 Parks & Trails Minutes 02.15.2011 e. Park Improvements. Robran discussed a recent meeting between PW Superintendent, Robran and Dale recently met to discussed getting quotes for: i. Making improvements to the septic system and putting in a well for water at the pavilion site ii. Putting in a good bathroom by the pavilion iii. Putting up a multi use shed near the current shed for storage. f. Park Dedication Fund Balance. Donahue advised that he was unable to gather the financial information at this time but would have the report for the next meeting. 9. The current round of updates was launched with the release of the system statements on September 12, 2005. These updates were due in 2008, three years from the date the system statement was received. The City of Corcoran Comprehensive Plan was reviewed by the Metropolitan Council and was found to be compliance with regional plans. The City of Corcoran must now officially adopt the Comprehensive Plan. It is my understanding that the Plan is being finalized and will be ready for adoption in April 2011. • If local zoning ordinances or other official controls conflict with a community's comprehensive plan as the result of an update or amendment to the plan, the official controls must be amended by the community within 9 months following the update or amendment to ensure the official controls do not conflict with the comprehensive plan. Local governmental units must adopt official controls as described in their adopted comprehensive plans and must submit copies of the official controls to the Council within 30 days following adoption, for informational purposes. (MN Stat. 473.864, Subd. 1) • If we adopt the Comprehensive Plan in April 2011, we are required by statute to adopt our official controls to implement the plan within 9 months (by January 2012). Council Meeting: February 24, 2011 Prepared By: Dan Donahue, Administrator Topic: Ordinance Update Process Action Required: Direction Policy: Budget Impact: Summary: I have been working with the City Planner Kendra Lindahl to develop a plan for moving forward on completing the 2030 Comp Plan and the accompanying required amendments to the city's Zoning Codes. I am attempting to set the: • Calendar to complete this whole process • Identify and categorize what must be done and what should be done at a later time. I will leave the setting of priority within these two categories to the city council • Keep the approved budget to complete these activities before you at all time I have been hindered over the past year to provide greater clarity to this process due to the conditions and restraints imposed by a duel planning process, a duel grant process, layered requirements by the grant making bodies, and the state requirements for completing the Comprehensive Plan for the city. I hope what I have worked out to clear away the clutter meets with your approval. I think the first thing we have to do is put this completion process coordination under one person -the City Planner Kendra Lindahl. I think we have reached the point were the work product produced by Bonestroo Consultant Tina Goodroad is adequate to the point that Ms. Lindahl and myself can take it and complete. Recommended Zoning Ordinance Calendar Update Process 1. March 3rd: Joint PC /CC meeting (7:00 — 7:30 present ordinance update process) 2. April 7t" Planning Commission meeting. Present full draft of revised ordinance. Administrator's Report— February 24, 2011 Council Meeting Page 2 3. May 5th Planning Commission meeting. Present a final draft of the zoning ordinance and zoning map based on feedback from the April meeting. We would expect to have the draft approved for a public hearing. 4. OPTIONAL May 19th Open House. Present draft ordinance and map to the public in advance of the public hearing. 5. June 2 n Planning Commission meeting. Public Hearing on the zoning ordinance update and zoning map. The planning commission will take public comments and make a recommendation to the City Council. 6. June 23rd City Council meeting. Adopt the zoning ordinance and zoning map as recommended by the Planning Commission. a. The ordinance will take effect upon Council action, but will need to be published in the Official newspaper. Categorization of Ordinances into Must Do Now and Future 1. To be completed by June 30, 2011 a. New zoning districts and district standards to be consistent with the 2030 Comprehensive Plan i. OPTIONS: The draft includes residential and commercial district performance standards. The City can: 1. Adopt with performance standards (as shown in the current draft) 2. Adopt without performance standards 3. Adopt without performance standards but keep Appendix A (Design Guidelines) b. Revised Accessory Building Standards i. There seemed to be general consensus from the PC and CC on the desired changes. ii. This is an issue that is raised repeatedly by the public. c. Adopt new zoning map i. Keep Holding Zone 1. This is what we have now. Rather than a protracted discussion of the pros and cons of the different options, this will simply continue the existing condition until such time as the City has time to review in detail. 2. Keep the Holding Zone district standards as currently drafted and revise later when the City has time and budget for additional analysis. d. Performance Standards. This section should at least have minimum updates to ensure consistency with accessory building section. Staff believes a complete overhaul is necessary, but proposes to make minimal changes needed to eliminate conflicts and save comprehensive changes for next year. e. Growth Management Ordinance. This may simply be updates to the premature subdivision ordinance, but will note the need to keep balance between residential and commercial development. Inconsistencies in different districts regarding essential services (they are currently listed as both a permitted use and an administrative permit) ii. Clarify how setbacks are measured from existing public streets that are not within a public right -of -way (like Lion's Parks adjacent to CR 101). iii. Update definitions in Zoning Ordinance to reflect new uses and definitions for phrases that have raised questions in the past. iv. Greenhouse language is inconsistent across district and should be corrected. v. Clarify commercial kennels as a primary uses vs. as a home occupation. vi. Seasonal outdoor sales standards should be made consistent across districts g. Revision to Open Space Preservation Plat Standards /Greenway Corridor. This technically is not required at this time but given the importance the city has placed on completion of this specific process, I have placed it in the Must Do list. 2) Not on the Must Do List but To Be Completed after July 1, 2011 with Dates to Be Set Later. The following items were indentified in the Comprehensive Plan as implementation tasks; or by the City Staff, Commissioners, or Council Members as needed updates, but are they are not required to be updated at this time. These items can be delayed until there is city time and budget to make changes: a) Update Development Rights Map i) This should be done on a regular basis, but the development right are reviewed and confirmed by staff when development is proposed. Staff recommends that this map be updated when budget is available for the research and analysis needed to complete the task. b) Updates to the Subdivision Ordinance i) Staff has identified several clean up items that should be adopted in the Subdivision Regulations, but these items can wait for the annual December clean up. ii) Staff would like to propose more comprehensive changes (such as a minor subdivision process that would reduce costs and simplify the process for residents that are doing a 2 or 3 lot subdivision), but these are not urgent issues and can wait until the budget allows. c) Eco System Management. As I understand it, this is an issue that was raised as part of the comprehensive planning process, but there is no statutory requirement that must be addressed immediately. This is a significant exercise and will require a commitment from staff, commissioners and Council. d) Sign Ordinance (Chapter 84). We will need to update the sign ordinance to reflect the new districts, be consistent with the zoning ordinance intent and clean up some confusing elements. However, sign ordinances are an enormous undertaking in most cities and we recommend delaying action on this time. Administrator's Report— February 24, 2011 Council Meeting Page 4 e) Non - conformity section. This section should be reviewed and revised to ensure that the city is phasing out non - conformities while allowing basic maintenance. The current ordinance may be too flexible and makes it difficult for the city to phase out non - conformities. This is not an issue that comes up very often, so this is one area that could be delayed until budget allows. f) Performance standards. This is one of the most important sections of the ordinance because it defines how development will look (building materials, landscaping, parking, etc). This section should be reviewed and updated, but if the building materials section is updated as proposed by staff, then we believe the remainder can be delayed until next year. g) Park Dedication Ordinance. This was identified as a priority from the Parks Commission. This is part of the subdivision ordinance and should be worked on with the City planner. There is no statutory requirement that this be updated this year, therefore, we recommend delaying action until time and budget allow. h) Home Occupations. The council has expressed some desire to examine the way we process home occupations. We believe that given the few home occupations that we see annually, this ordinance update can wait until time and budget allow. i) Misc. updates. I recommend budgeting for an annual ordinance update to keep the ordinance current after the major changes. Budget to Complete the Calendar and the Must Do List In this process (beginning in 2010) of completing both the Comp Plan and the ordinance updates, we have encumbered expenses of: Provider Expenses Bonestroo -DNR Grant $18,944.76 Bonestroo -CGO $19,043.50 Landform $4.028.84 TKDA $0 Total $42,017.10 The original budget was $50,700 in revenues. I know there are expenses from Bonestroo yet to be invoiced to the city. As Ms. Goodroad is not available this past week, I will have to update the council at the council meeting as to the up to date cost of Bonestroo in this process. I will also have to estimate expenses to complete the editing, formatting, and binding of the Comp Plan document by Bonestroo. The city will receive an additional $10,000 from the Met Council once the 2030 Comp Plan is finalized and they receive the city's resolution approving the plan. To accomplish the above plan to both complete the Comp Plan itself and to complete the "Must Do" ordinance updates, my estimate is $5- 7,000. Next week after I talk to Ms. Goodroad, will have a complete budget plan to show you at the council meeting. I believe that the bulk of the work for the minimal required updates has been completed by Bonestroo already and could be adopted by the City with no additional City Council meetings (other than what is stated above) and minimal impact to the adopted 2011 Budget. Delaying action on adoption of these minimum ordinance updates would be inconsistent with State Statute and would likely cost additional time and money to revisit the issues again next year when circumstances and stakeholders may change.
