HomeMy WebLinkAboutResolution 2011-05 Patnode Topo ExemptionCity of Corcoran January 27, 2011 County of Hennepin State of Minnesota RESOLUTION NO. 2011-05 Page 1 of 2 Motion By: Cossette Seconded By: Gmach A RESOLUTION TO APPROVE A TOPOGRAPHY AND WETLAND DELINEATION EXEMPTION FOR PROPERTY LOCATED AT 23240 COUNTRY ROAD 50 (PID 19- 119-23-41-0001) WHEREAS, the applicant has requested an exemption from the topography and wetland delineation requirements for a preliminary plat as allowed in Section 930.020, Subd. 6(B)2 and 3 of the Corcoran Subdivision Ordinance and the conditional use permit survey requirements in 1070.020 of the Corcoran Zoning Ordinance; and WHEREAS, the Corcoran City Council reviewed this item at their meeting on January 27, 2011; and NOW THEREFORE BE IT RESOLVED that the Corcoran City Council approves the topography and wetland delineation exemption based on the following findings: 1. The property has 7 building rights remaining. The property has one single family home on the 78.84-acre parcel and the property is currently farmed. 2. The property is currently enrolled in the Metropolitan Agricultural Preserve program and these restrictive covenants and MN State Statutes prohibit subdivision of this parcel until the property is removed from the Agricultural Preserve program in 2012. 3. A topographic survey and wetland delineation shall be provided for the areas where development is proposed for new home and associated improvements as part of the future conditional use permit application, but the remainder of the site shall be exempted from these requirements. 4. The topographic survey shall be provided for the areas where development is proposed, but the remainder of the site shall be exempted form these requirements. b. The wetland delineation shall be required for the proposed lot for the new home. The existing farm lot shall be exempted from this requirement. c. The new lot for the new home shall be required to provide wetland buffers, buffer setbacks and buffer monuments as required by Section 1050.010 of the City Code. The existing farm lot shall be exempted from this requirement until further subdivision is proposed. 5. The existing use is consistent with the City’s Comprehensive Land Use Plan. 6. No other exemptions or variances are granted. 8. Granting the topography and wetland delineation exemption neither grants nor implies approval of any plat or conditional use permit. ADOPTED by the City Council this 27th day of January 2011.
