APPROVING AN AMENDMENT TO THE APPROVED FINAL PUD DEVELOPMENT PLAN
FOR "COOK LAKE HIGHLANDS" AT 19220 COUNTY ROAD 10
(PID 25A 19-23-14-0003) (CITY FILE 23-005)
WHEREAS, Beth Hustad of Trek Real Estate and Development, Inc. ("the applicant") requested
approval of a planned unit development amendment (PUDA) to allow an increased impervious
surface coverage, 32 units for the memory care building on Lot 2, Block 1 and a 145-unit senior
apartment building on Lot 1, Block 2 all for "Cook Lake Highlands" on property legally described
as follows on property legally described as follows:
Lot 1 and 2, Block 1, and Lot 1, Block 2, Lots 1-19, Block 3 and Outlots A to F, Cook Lake
Highlands, Hennepin County, Minnesota, according to the recorded plat thereof
WHEREAS, a planned unit development plan approval is a requirement of the final approval of
the applicant's subdivision and development application.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
CORCORAN, MINNESOTA, that the Corcoran City Council approves the request, subject to the
following conditions:
1. A PUD amendment is approved for "Cook Lake Highlands," in accordance with the plans
CA"d application received by the City on March 24, 2023 and revisions received on April
101 2023 except as amended by this resolution.
2. This amendment modifies Condition 11 of Resolution 2021-36, which approved PUD
flexibility for 39% impervious surface coverage for the entire project. The PUD is amended
to allow 39.8% impervious surface coverage for the entire project.
A
. The PUD flexibility is required to allow increased impervious surface coverage on
Lot 1, Block 1 for the playground and sidewalks at New Horizon Academy.
b. The existing stormwater management plan will accommodate the increased area
without changes.

3. Resolution 2022-22 approving the final PUD Development Plan with 27 units for the
memory care is modified by this amendment to allow 32 units. This is consistent with the
preliminary approvals in Resolution 2021-36, which approved 32 memory care units.
Revised building plans must be submitted with the building permit showing 32 units
for the memory care facility.
b. The units shall not have kitchen facilities included so they are not considered units
under the HUD definition.
4. A PUD amendment is approved to modify Resolution 2021-36 and Resolution 2022-22 to
allow a 145 unit senior apartment building where a 100 unit senior coop was approved,
based on the following findings.
a. The footprint of the building does not change.
b. Adequate parking is available. The plans show an additional 44 underground
parking stalls. The proposed parking complies with ordinance requirements.
c. No additional impervious surface coverage is proposed.
d. Revised building plans and building elevations must be submitted with the building
permit showing 145 units for the senior apartment building.
5. A PUD amendment is approved to modify Resolution 2022-22, condition #24 to reflect a
change in the park dedication fees related to the additional units in this PUD
amendment.
a. The applicant previously satisfied the park dedication due with the prior PUD plan
with dedication of Outlot C in exchange for a waiver of the park dedication due on
the 19 villa lots and a cash contribution of $336,407.00. The charge was
calculated in accordance with Section 955 of the City's Subdivision Ordinance as
follows: 100 multifamily units x $3,141.00 ($314,100.00) plus (27 memory care
units / 146) x $4,498 ($17,809.00) plus 1 daycare facility x $4,498 ($4,498.00) _
$3361407.00.
b. The revised PUD plan requested by the applicant includes an additional 50 units.
Park dedication fees are typically collected with final plat, but as part of this PUD
amendment shall be charged for the additional units upon this final approval and
shall be calculated and paid based on the fees in place when the final plat was
approved, in accordance with Chapter 955 of the City Code. Park dedication for
the new PUD would be $475,775.96. The charge was calculated in accordance
with Section 955 of the City's Subdivision Ordinance as follows: 145 multifamily
senior units x $3,141000 ($455,445.00) plus (32 memory care units / 196) x $4,498
($15,832.96) plus 1 daycare facility x $4,498 ($4,498000) _ $47577750963
c. With credit for the previous park dedication payment the amount due with this PUD
amendment is $139,368.96 due prior to issuance of building permit.
6. The applicant shall comply with all requirements of the City Engineer's memo, dated April
17, 2023.
