City Council Work Session Minutes
September 22, 2022 — 50.30 pm
The Corcoran City Council met on September 22, 2022, in Corcoran, Minnesota. The City Council work
session meeting was held in person and the public was present in person and remotely through electronic
means using the audio and video conferencing platform Zoom.
Mayor McKee, Councilor Nichols, and Councilor Vehrenkamp were present. Councilor Schultz and Councilor
Bottema were excused.
City Administrator Beise, City Clerk Friedrich, Planner McKeown, and Public Works Director Mattson were
present.
1. Call to Order /Roll Call
Acting Mayor Bottema called the work session to order at 5:30 pm.
2. Rental Ordinance
Planner McKeown reviewed the first draft rental dwelling ordinance parameters and requirements. Planner
McKeown noted prior Council discussions regarding the rental ordinance and concerns of corporate entities
purchasing large amounts of available housing and converting the residential homes into rental properties
and options in how the ordinance is structured to mitigate this scenario. Planner McKeown noted
importance of an exemption for property owners who rent to family members. Planner McKeown noted
possibly including rental inspections within the rental ordinance and referenced Minneapolis Federal Bank
website as a helpful resource regarding rental data. Planner McKeown noted a trend of rental property
increases in Hennepin County, with approximately 6 percent non -homesteaded properties located in
Corcoran. Planner McKeown also noted about 3 percent of properties in Hennepin County are owned by
investors ranging from 3 to over 100 homes. Planner McKeown noted AirBNB and VRBO type rentals do
not yet exist in Corcoran. Planner McKeown noted a crime free and disorderly conduct provision could be
considered within the rental ordinance, however, conflicts within the Fair Housing Act would need to be
evaluated if the rental ordinance includes such a provision. Staff and Council discussed aspects of the
rental ordinance and reviewed a disorderly conduct provision, a three -strike system regarding enforcement
of the ordinance and allowing compromise within the ordinance rather than a no tolerance system. Planner
McKeown reviewed a provision within the ordinance limiting the ability to own multiple dwellings, and
currently the draft references single-family homes, however, Planner McKeown noted twin homes and
townhomes should be included as well. Planner McKeown reviewed another option for the rental ordinance
includes limiting rental density. Planner McKeown noted limiting rental properties is an area of
undetermined property right laws. Planner McKeown referenced ordinances from West St. Paul which
included a cap of 10 percent rental density per block, and a cap in Winona of 30 percent. Council and staff
discussed possible enforcement scenarios, types of housing to include within the ordinance, the idea of
rental developments, license and inspection processes, and staffing once the rental ordinance adopted.
Council and staff discussed the nuisance ordinance in relation to the rental ordinance and the definition of
each ordinance within code. Planner McKeown noted finding a balance between Council vision for the
community, while honoring property rights of owners.
