HomeMy WebLinkAboutResolution 2023-38 Keefe Minor Subdivision ResolutionCity of Corcoran County of Hennepin State of Minnesota RESOLUTION NO. 2023-38 Motion By: McKee Seconded By: Nichols Apri1271 2023 APPROVING MINOR SUBDIVISION ON THE 33.86-ACRE SITE AT 680'1 WILLOW DRIVE (PID 33-119-23-12-0007) (CITY FILE 22-063) WHEREAS, Mike Keefe, Emily Keefe, Debbie Hunz, and Douglas Hunz ("the applicant") requested approval of a minor subdivision to create two lots from one existing parcel legally described as: See Attachment A WHEREAS, city staff determined the application meets the criteria for a minor subdivision as outlined in Section 927.010 of the City Code's Subdivision Ordinance, NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORCORAN, MINNESOTA, that it should and hereby does approve the request for a minor subdivision, subject to the following conditions: 1. A minor subdivision is approved to allow the creation of two lots, in accordance with the application materials and plans received by the City on September 20, 2022 and March 9, 2023, except as amended by this resolution. 2. The minor subdivision exhausts two development rights assigned to the existing parcel. There is one remaining development right after the subdivision which is assigned to Parcel A per the request of the applicant. 3. The applicant shall comply with all requirements in the City Engineer's memo dated April 19, 2023. 4. The applicant must enter into a Site Improvement Performance Agreement and submit a financial guarantee to the City for the proposed work as outlined in Section 1070.050, Subd. 9 of the Zoning Ordinance prior to release of the minor subdivision for recording. 5. The applicant must satisfy the following requirements regarding the private drive proposed to serve Parcel A, Parcel B, and 6855 Willow Drive (PID 33-119-23-21-0002): a. The private drive must be brought up to current City standards and pass a roll test. b. A site plan for the private drive located within the subdivision must be submitted for approval by the City Engineer prior to release of the minor subdivision for recording. The plan must include the following: i. Private drive in compliance with Sheet No. STR-3 of Corcoran's Standard Detail Plates. Upon completion of the final approved private drive design, the applicant must provide construction cost estimates for review and approval by the City Engineer. These costs will be used in the Site Improvement Performance Agreement. d. The applicant is responsible for obtaining any required watershed permits or approvals required to complete the private drive improvements prior to beginning construction. e. Prior to release of the minor subdivision for recording, the depiction and description of the private drive easement location must be revised to encompass the existing roadway location and required turnaround. i. Alternatively, the applicant may choose to correct the existing gravel located outside of the easement and relocate the roadway within the identified easement area on the property survey. Relocation of the gravel must be shown on a site plan or survey prior to release of the minor subdivision for recording. f. A private drive easement encompassing the entirety of the proposed drive must be provided in recordable form and submitted for City review and approval. g. A recordable maintenance agreement for the private drive with updated easeI ent descriptions must be approved by the City Attorney. 6. The plans shall be revised to show dedication of a 40' road easement along Willow Drive. 7. The dedication of the public street must be provided in recordable form and submitted for City review and approval. 8. The following perimeter drainage and as provided in recordable form and su utility easements must be shown on the plans as well bmitted for City review and approval: a. A drainage and utility easement of 10' along the north and west property lines for Parcel A. b. A drainage and utility easement of 10' along the south and west property lines for Parcel B. c. A drainage and utility easement of 10' adjacent to and directly west of the 40' road easement for Parcels A and B. d. A drainage and utility easement over the entirety of the private drive easement. 9. The following requirements must be met regarding the delineated wetlands throughout the subdivision: Page 2 of 7 City of Corcoran County of Hennepin State of Minnesota RESOLUTION NO. 2023-38 Apri127, 2023 a. The plans must be updated to show the wetland buffers and required wetland buffer monument signs as required by Section 1050.010 of the Zoning Ordinance. b. The plans must be updated to show a drainage and utility easement over each wetland and associated wetland buffer. c. The drainage and utilit recordable form and su y easements for the wetlands must be provided in bmitted for City review and approval. d. Wetland signs must be purchased from the City and installed on treated 4x4 wooden posts. e. A wetland buffer planting plan in compliance with Section 1050.010, Subd. 8(C) of the Zoning Ordinance shall be submitted for review and approval by the City prior to release of the minor subdivision for recording. i. Buffer areas that are not vegetated or have been d 10 years shall be replanted and maintained accord Section 1050.010, Subd. 8(C), isturbed within the last ii. If exiting wetland buffers are proposed to remain by the applicant, the City's wetland buffer specialist must inspect and confirm existing buffers are undisturbed and in an acceptable condition prior to release of the minor subdivision for recording. iii. If planting is required to establish wetland buffers, the applicant must provide a cost estimate for the landscaping to be used in the Site Improvement Performance Agreement, 10. The minor subdivision plans must be updated to include the floodplain elevation prior to release of the minor subdivision for recording. 11. One overstory tree with a diameter of at least 2.5 inches at the time of planting must be provided on Parcel A prior to issuance of a certificate of occupancy. 12. Park dedication shall be satisfied by cash -in -lieu of land. a. Park dedication shall be subject to park dedication fees in place when the minor subdivision is approved. b. The City's established park dedication fees are based on the adopted 2040 Comprehensive Plan. c. Park dedication is required based on the finding that the minor subdivision will add one new single-family home in the City. d. Residents of the development will benefit from access to nearby existing trails and parks as well as trails and parks that do not exist today but are planned for in the Comprehensive Plan. Cash -in -lieu of land will be used only for the acquisition and development of parks recreational facilities, playgrounds, trails, wetlands, or open space based on the Comprehensive Plan. f. The parkdedication fee is necessary forthefuture development of the on -road trail on Willow Drive for residents of this subdivision to access the larger trail network within the City. Additionally, the park dedication fee is necessary for the acquisition of a planned community open space park anticipated near Morin Lake, just south of this subdivision. g. Park dedication funds will be collected at the time the minor subdivision is released for recording in accordance with the City Code requirement. The City Code stipulates a requirement of 5% for land in the Rural/Ag Residential land use category, or an equivalent market value in cash. This results in estimated park dedication fees of $5,954 for a single-family unit. 13. The applicant must record the following documents with Hennepin County and provide proof of recording to the City: a. Approving resolution. b. Minor subdivision. c. Required road easement for right-of-way along Willow Drive. d. Drainage and utility easements. e. Private drive easement. f. Private drive maintenance agreement. g. Site Improvement Performance Agreement. 14. Prior to issuance of a building permit for Parcel A: a. Proof of recording must be provided for all relevant documents. b. Lot monuments shall be installed as required by the Subdivision Ordinance and certified by a registered land surveyor. c f. The installation of the wetland monument buffer signs plans must be certified by a registered land surveyor. according to the approved Wetland buffers must be planted and inspected by the City. The private drive improvements must be completed. A septic permit for Parcel A must be obtained from Hennepin County. Approval shall expire within two years of the date of approval unless the applicant has recorded the minor subdivision with Hennepin County and provided proof of the same to the City.
