HomeMy WebLinkAboutResolution 2023-35 Rush Creek FP Resolution (RCR 3)City of Corcoran County of Hennepin State of Minnesota RESOLUTION NO. 2023-35 Motion By: Nichols Seconded By: Schultz Apri127, 2023 APPROVING FINAL PLAT AND DEVELOPMENT CONTRACT FOR "RUSH CREEK RESERVE 3RD ADDITION" FOR M/I HOMES OF MINNEAPOLIS/ST. PAUL LLC (PID 23-119- 23-420-103) (CITY FILE NO. 23-007) WHEREAS, M/I Homes of Minneapolis/St. Paul, LLC (the "applicant") has requested approval of a final plat for "Rush Creek Reserve 3rd Addition" for 18 new residential units on 4.6 acres of property legally described as: Outlot C, Rush Creek Reserve Second Addition, according to the recorded plat thereof, Hennepin County, Minnesota. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORCORAN, MINNESOTA, that it should and hereby does approve the request for final plat, subject to the following conditions. 1. A final plat is approved to create 18 residential lots for "Rush Creek Reserve 3rd Addition" in accordance with the plans and application received by the City on March 21, 2023, April 101 2023 and April 14, 2023, except as amended by this resolution. 2. Approval is subject to the preliminary approvals (Resolution 2014-72 and 2014-73) in addition to the final PUD approval for the project (2020-87). 3. Approval is contingent upon approval of the final PUD (Resolution 2023-34) and easement vacation (Resolution 2023-36). 4. An encroachment agreement shall be required for the retaining wall on the erosion control and grading plans and any other items placed within the City right-of-way or easements if approved by the City. 5. The applicant must submit a final plat for each future phase of development. No approvals are granted at this time for phases of development. 6. The applicant shall comply with all requirements of the City Engineer's memo dated April 20, 2023. 7. Park dedication shall be as required by Resolution 2023-34 approving the final PUD development plan. FURTHER, prior to release of the final plat for recording: 8. The following documents must be approved by the City Attorney: a. Homeowners Association documents b. Trail Easement in recordable form c. Encroachment Agreement d. A financial guarantee shall be required to ensure installations per City requirements.
