HomeMy WebLinkAbout2021-445 Assembly Uses Performance Standards in Residential AreasCity of Corcoran County of Hennepin State of Minnesota OR®INANCE NO. 2021-445 Motion By: McKee Seconded By: Nichols December 22, 2021 AN ORDINANCE AMENDING THE TEXT OF SECTIONS 1020.020, 1040.040, 1040.045, 1040.050, 1040.060, 1040.065, AND 1040.070 OF THE ZONING ORDINANCE OF THE CORCORAN CITY CODE RELATED TO PERFORMANCE STANDARDS FOR PLACES OF WORSHIP AND EDUCATIONAL FACILITIES IN RESIDENTIAL ZONING DISTRICTS WITHIN THE METROPOLITAN URBAN SERVICE AREA (CITY FILE 21-034) THE CITY OF CORCORAN ORDAINS: SECTION 1. Amendment of the City Code. The text of Section 1020.020 of the Corcoran City Code is hereby amended by removing the �+r��Uo►, material and adding the underlined material as follows: 1020.020 -DEFINITIONS IMPERVIOUS SURFACE: A surface compacted or covered with material so as to be hi resistant to infiltration by runoff. Impervious surface shall include roads; driveways; and h� parkin areas, whether or not paved; sidewalks greater than three feet wide��atios; tennis and basketball courts; swimming pools; covered decks and other structures. SECTION 2. Amendment of the Cit Code. The text of Section 1040.040 of t Code is hereby repealed and replaced by the underlined material as follows: 1040.040 — RSF-1 (SINGLE FAMILY RESIDENTIAL) ZONING DISTRICT he Corcoran City Subd. 4. The following are conditional uses, subject to the conditions outlined in Section 1070.020 of this Ordinance and the specific standards and criteria that may be cited below for a specific use: A. Existing trees, shrubs, and vegetation may be used to meet the landscaping zone requirement when the intent to provide buffering is accomplished. 5. Parking Lot Screenin and LandscaDin a. Noise. Exterior bells or loudspeakers are permitted between the hours of 9 a.m. and 10 p. m. 8. Additional Requirements. a. The City Council may attach additional conditions to the granting of the conditional use permit for the primary use as well as any accessor uses of the site as deemed necessary to protect the residential character of the neighborhood. b. As provided for in federal statue 42 U.S.C . 2000cc-3 (e), the City Council may avoid the preemptive force of any provision of Chapter 21 C (Protection of Religious Exercise in Land Use and By Institutionalized Person) by changing the policy or practice that results in a substantial burden on religious exercise, by retaining the policy practice and exempting the substantially burdened religious exercise, by providing exemptions for the policy or practice for applications that substantially burden religious exercise, or by any other means that eliminates the substantial burden.
