APROVING A VARIANCE APPLICATION FROM WESTSIDE WHOLESALE TIRES
LOCATED AT 19925 75T" AVENUE NORTH (PID 26-119-23-14-0018) (CITY FILE 22-011)
WHEREAS, Westside Wholesale Tire ("the applicant") has requested approval of a variance to
allow a 35400t parking lot front yard setback variance on property legally described as follows:
Lot 5, Block 4, Countryside Plaza 2nd Addition, Hennepin County, Minnesota.
WHEREAS, the Planning Commission reviewed the variance at a duly called public meeting.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
CORCORAN, MINNESOTA.
1. The review was based on the application and plans received by the City on February 2,
2022, February 4, 2022, February 18, 2022 and the revised site plan received on May 2,
2022.
2. The variance to allow a 35-foot front yard setback where 50 feet is required, is approved
based On the following findings:
a. That there are practical difficulties in complying with the Zoning Ordinance
created by the location Of the seasonal snowmobile trail, which prevents the
improvements from sliding any further south.
b. That the conditions upon which a petition for a variation is based are unique to
the parcel of land for which the variance is sought and were not created by the
landowner. The snowmobile trail is a unique constraint. The applicant indicates
that snowmobile trail runs along 75th Avenue until it reaches this property where
is moves off the road and crosses the rear of the property which is safer for
snowmobiles. There are few properties in Corcoran's urban area with this
condition.
c. That the granting of the variation will not alter the essential character of the
locality because it will allow the applicant to resolve a code enforcement issue
and the resulting site will be more consistent with the area than the existing
condition.
d. The proposed variance would be in harmony with the general purposes and
intent of the Ordinance because it would resolve a code enforcement issue and
allow for a paved parking lot screened outside storage, which is in the
community's best interest.
e. The variance would allow development that is consistent with the uses
anticipated in the comprehensive plan.

f. The City may impose conditions on the variance to address the impact of the
variance. The ordinance requires 21 trees and 34 shrubs to be planted on site.
As a condition of the variance, those planting should be focused in the front yard
to mitigate for the loss of green space.
3. The variance to allow a gravel off-loading area with a 6.5-foot setback as shown on the
plans is approved, based on the following findings and conditions:
a. There is a practical difficulty in complying with the setback requirements for when
unloading heavy equipment that will be serviced across the street.
b. The conditions are unique to the site and the business operations of Westside
Tire.
c. Granting the variance will not alter the essential character of the area.
d. The proposed variance would be in harmony with the general purpose of the
ordinance which allows unloading of equipment and then transfer to a site across
the street for service.
e. The variance would allow development that is consistent with the commercial
uses anticipated in the comprehensive plan.
condition of the variance approval, no on street parking of trucks, vehicles
or equipment related to the Westside Tire business shall be permitted, except
that if a delivery is scheduled on a WB-92 truck the landowner shall notify the
Corcoran police department in advance and may be allowed temporary parking
in the street to unload.
g. An encroachment agreement must be executed for the unloading area in the City
drainage and utility easement.
