HomeMy WebLinkAboutResolution 2022-53 Final Plat-Bechtold Farms_CC Edit (002)City of Corcoran County of Hennepin State of Minnesota RESOLUTION NO. 2022-53 Motion By: Schultz Seconded By: Vehrenkcol mp May 7 2, 2022 APPROVING FINAL PLAT AND DEVELOPMENT CONTRACT FOR "BECHTOLD FARMS AT RUSH CREEK" AT 10165 BECHTOLD ROAD (PIDS 05=119-23-44-0001 AND 08-119-23-11-0007) (CITY FILE NO. 22-024) WHEREAS, Skies Limit, LLC (the "applicant") has requested approval of a preliminary plat to create 12 lots from two existing parcels legally described as: See Attachment A NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORCORAN, MINNESOTA, that it should and hereby does approve the request for final plat, subject to the following conditions. 1. A final plat is approved to create 12 lots for "Bechtold Farms at Rush Creek" in accordance with the plans and application received on February 15, 2022, March 22, 2022, March 24, 2022, March 29, 2022, March 30, 2022, April 7, 2022, April 8, 2022, April 13, 2022, April 147 2022, and April 21, 2022, except as amended by this resolution. 2. The development contract must be executed by the developer and the City must be filed with the final plat. 3. Approval is subject to the preliminary approval conditions (Resolution 2021-129). 4. Approval of the preliminary plat is contingent upon approval of the requested easement vacation (Resolution 2022-54). 5. The applicant shall comply with all requirements of the City Engineer's memo dated April 29, 2022. 6. The applicant shall comply with all requirements of the Elm Creek Watershed Management Commission review dated April 21, 2022. 7. Plans shall be revised to provide wetland buffer monuments at each lot line where it crosses a wetland buffer, and where needed to indicate the contour of the buffer, with a maximum spacing of 200 ft. along the wetland edge. A wetland buffer monument exhibit dated May 2, 2022, delineates the correct locations for conservation and wetland buffer monuments. 9. Plans shall be revised to show the proposed house pad and driveway location for Lot 1, Block 1. The applicant shall provide details regarding the removal of the existing driveway in Lot 1, Block 1 and preservation of the drainage ditch along Bechtold Road for review and approval by the City Engineer. The driveway for Lot 1, Block 1 shall be from Chaparral Lane to the south, unless as part of the building permit application the City determines the relocation is infeasible. 11. Park dedication shall be satisfied by a combination of dedicated trail easements and cash - in -lieu of land for the 11 newly created lots. a. A 20 ft. wide trail easement connecting easement along the west property line shall Chaparral Lane to the existing trail be deeded to the City. b. A 30 ft. wide trail easement along the north edge of the north fork of Rush Creek shall be deeded to the Cit c. Park dedication credit will easement. d. Cash -in -lieu of land shall be $42,559.09. 12. The following documents must be approved by the City Attorney: a. Stormwater Maintenance Agreement b. Development Contract c. Trail Easements d. Conservation Easement e. Easement Vacation Resolution f. Encroachment Agreement for the Lot 10, Block 1 Driveway in Garden Lane. g. Homeowners Association documents h. Wetland Buffer Planting and Maintenance Plan 13. Letter of credit must be in place and fees paid. FURTHER, that the following conditions must be met prior to issuance of building permits: 14. The applicant must file the final plat at Hennepin County within 2 years of the date of approval or the approval shall expire. 15. The following documents must be a recorded at Hennepin County and proof of recording provided to the City: a. Stormwater Maintenance Agreement b. Development Contract c. Trail Easements d. Conservation Easement e. Easement Vacation Resolution f. Encroachment Agreement for the Lot 10, Block 1 Driveway in Garden Lane. g. Homeowners Association documents h. Wetland Buffer Planting and Maintenance Plan 16. Lot and corner monuments shall be installed as required by the Subdivision Ordinance. Wetland buffer monument signs must be installed as required by Section 1050.010 of the Zoning Ordinance. 18. A final wetland buffer plan must be submitted by the developer and approved by the City a. Where it is believed existing vegetation meets the requirements for the buffer, the developer should schedule and inspection from City wetland LGU staff to verify where existing vegetation is acceptable. 19. The wetland buffer plantings must be installed where required. 20. Septic permits must be obtained from Hennepin County. 21. Each lot must show one overstory tree to be planted on the lot. FURTHER, that the following conditions must be met prior to release of remaining escrow: 22. Any request for the City to inspect the required landscaping in order to reduce financial guarantees must be accompanied by recertification/verification of field inspection by the project Landscape Architect. A letter signed by the project Landscape Architect verifying plantings (including wetland and pond buffers) have been correctly installed in compliance with the plans and specifications will suffice. 23.
