HomeMy WebLinkAboutResolution 2022-45 Final Plat Town Center Addition - St. ThereseCity of Corcoran County of Hennepin State of Minnesota RESOLUTION NO. 2022-45 Motion By: Schultz Seconded By: Vehrenkamp Apri128, zuzz APPROVING FINAL PLAT AND DEVELOPMENT CONTRACT FOR APPROVING PRELIMINARY PLAT FOR "TOWN CENTER ADDITION" AT 8200 CO RD NO 116 (PID 24-119-23-23=0001) (CITY FILE NO. 22-023) WHEREAS, Saint Therese Communities ("the applicant") has requested approval of "Town Center Addition" a senior living community on property legally described as follows: See Attachment A NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORCORAN, MINNESOTA, that it should and hereby does approve the request for a final plat, subject to the following conditions: 1. A final plat is approved to create two lots and one outlot for "Town Center Addition," in accordance with the plans and application received on March 22, 2022, April 14, 2022 and April 15, 2022, except as amended by this resolution. 2. The development contract must be executed by the developer and the City and must be filed with the final plat. 3. Approval is subject to the preliminary approvals (Resolutions 2021-130 and 2021-131). 4. The plans must be revised to comply with the City Engineer's memo dated April 4, 2022. 5. Park dedication is due for Lot 1, Block 1 and shall be cash -in -lieu of land, prior to release of the final plat for recording. Final park dedication amounts will be based on the fee schedule in place at the time the final plat is released for filing, but is currently estimated at $321,466.37 as outlined in the staff report. FURTHER, prior to release of the final plat for recording: 6. The following documents must be approved by the City Attorney: a. Stormwater Maintenance Agreement b. Development Contract c. Reciprocal Easement and Operating Agreement ("REOX) d. An encroachment agreement for all private improvements located within public easements. e. An encroachment agreement for public improvements on Lot 1, Block 1. 7. Letter of credit must be in place and fees paid. FURTHER, that the following conditions must be met prior to issuance of building permits: 8. The applicant must file the final plat at Hennepin County within 2 years of the date of approval of the approval shall expire. The following documents must be approved by the City Attorney and recorded at Hennepin County: a. Stormwater Maintenance Agreement b. Development Contract c. Reciprocal Easement and Operating Agreement ("REOA33 d. An encroachment agreement for all private improvements located within public easements. e. An encroachment agreement for public improvements on Lot 1, Block 1. 10. Record the approving resolutions and associated documents at Hennepin County and provide proof of recording to the City. 11. The applicant must address all conditions of the preliminary approvals (Resolutions 2021-130 and 2021-131). FURTHER, that the following conditions must be met prior to release of remaining escrow: 12. Lot and corner monuments shall be installed as required by the Subdivision Ordinance. A financial guarantee shall be required to ensure installations per City requirements. 13. Any request for the City to inspect the required landscaping in order to reduce financial guarantees must be accompanied by recertification/verification of field inspection by the project Landscape Architect. A letter signed by the project Landscape Architect verifying plantings (including wetland and pond buffers) have been correctly installed in compliance with the plans and specifications will suffice.
