HomeMy WebLinkAboutResolution 2021-114 Approving Purchase of Property and Right of EntryCity of Corcoran County of Hennepin State of Minnesota Motion By: Botfiema Seconded By: Nichols September 23, 2027 A RESOLUTION APPROVING THE PURCHASE OF CERTAIN REAL PROPERTY INTERESTS, AUTHORIZING CLOSING, AND APPROVING A FIRST AMENDMENT TO RIGHT OF ENTRY AGREEMENT WHEREAS, William E. Mason ("Seller") is the owner of certain real property within the City of Corcoran, described on the attached Exhibit A (the "Subject Property"); and WHEREAS, the City of Corcoran, desires to purchase portions of the Subject Property, as described in the Purchase Agreement in order to complete the 66th Avenue/Gleason Parkway Corridor Improvements Project (the "Project"), and HEREAS, the City has received developer posted escrow funds to complete this purchase; and WHEREAS, the City Council desires to approve the Purchase Agreement between the City and Seller and authorize the Mayor and the Administrator or his designee to execute the Purchase Agreement, deliver the funds contemplated therein, and execute any and all documents necessary and proper to facilitate closing of the transaction; and i •- -• • commence erojeci• aavance OT inis acquisition an vhich required commencement of • •n action to acquire the required property iteUsts by October 1, 2021 in the event no purchase agreement could be reached; and HE E S, the City and Seller have reacl°�ed a purchase agreement which is contingent upon approval by fibs court and the parties desire to exfiend the deadline by which the City must commence a condemnation action via a First Amendment to Right of Entry Agreement. The City therefore desires to approve the First Amendment to the Right of Entry Agreement and authorize the Mayor and the Administrator or his designee to execute the same. NOW THEREFORE BE IT RESOLVED, the City Council of the City of Corcoran hereby approves the Purchase Agreement between the City and Seller for the purchase of the specified portions of the Subject Property and hereby authorizes the Mayor and the Administrator or his designee to execute the Purchase Agreement, deliver the funds contemplated therein, and execute any and all documents necessary and proper to facilitate closing of the transaction. The City Council further approves the First Amendment to the Right of Entry Agreement and authorizes the Mayor and Administrator or his designee to execute the same.
