HomeMy WebLinkAboutResolution 2021-105 Approving Final Plan and Contract Tavera 2nd AdditionCity of Corcoran County of Hennepin State of Minnesota RESOLUTION NO. 202'I -1 U0 Motion By: Nichols Seconded By: Bottema September 23, 2027 APPROVING FINAL PLAT AND DEVELOPMENT CONTRACT FOR "TAVERA 2nd ADDITION" FOR LENNAR (PID 35-119-2344-0004 and 35-119-2341-0001) (CITY FILE NO. 21-036) WHEREAS, US Home Corporation, a Delaware Corporation dba Lennar ("the applicant") has requested approval of a final plat for "Tavera 2nd Addition" for 46 new residential lots and five Outlots on property legally described as: See Attachment A FURTHER, that the developme Mayor and that the City Admi behalf of the City; and nt contract for said plat shall be completed by city staff and the nistrator be authorized to execute the development contract on NOW, THEREFORE, BE IT RESOLVED that it should and hereby does approve the request for a final plat for Tavera 1 St Addition, subject to the following conditions: 1. A final plat is approved to create 46 lots and five outlots for "Tavera 2nd Addition", in accordance with the plans and application received by the City on July 20, 2021 and additional information received on August 6, 2021 and August 12, 2021, except as amended by this resolution. 2. Approval is contingent upon City Council approval of the final PUD development plan. 3. The development contract must be executed by the developer and the City and must be filed with the final plat. 4. Development is subject to all conditions of the "Tavern" preliminary plat and preliminary PUD approvals (Resolutions 2020-50 and 2020-51), except as modified by the PUD amendment (Resolution 2021-86). 5. The developer must submit a final plat for each future phase of development. No final approvals are granted at this time for phases of development. 6. Park dedication shall be a combination of land and cash -in -lieu of land as described in Resolution 2021-104. 7. The applicant shall comply with all requirements of the City Engineer's memo dated August 24, 2021. 8. Drainage and utility easements must be provided over all wetlands, wetland buffers and ponds. All permanent wetland buffer monument signs must be erected along the wetland buffer line as required by Section 1050.010, Subd. 7 of the Zoning Ordinance. a. Wetland signs shall be purchased from the City. b. The final locations must be inspected and approved by City staff. c. Monuments and signs shall be installed prior to approval of the building permit. 10. The applicant must file the final plat at Hennepin County within 2 years of the date of approval or the approval shall expire. 11. The following documents must be approved by the City Attorney and recorded at Hennepin County: a. Stormwater Maintenance Agreement b. Temporary Turnaround Easements c. Trail Easement d. Maintenance and Encroachment agreements for landscaping in the public right- of-way. e. Homeowners association documents f. Conservation easement for tree preservation amendment 12. Record the approving resolutions and associated documents at Hennepin County and provide proof of recording to the City. 13. The applicant shall provide proof of recording the final plat and related documents at Hennepin County, 14.
