Acting Mayor Bucher called the regular council meeting of December 27, 2001 to
order at 7:00 p.m. Present were Councilors Bucher, Gageby, Gmach and Thomas,
Clerk Vergin, Engineer Vander Top, Police Chief Schutte and Public Works
Director Meister. Excused absent was Mayor Guenthner.
The Pledge of Allegiance was said.
MOTION by Gmach, seconded by Thomas, to approve the agenda with the
addition of 8.c.3. Administrator Position. Voting Aye: Bucher, Gageby, Gmach
and Thomas. (Motion Carried)
Open Forum – No one
Acting Mayor Bucher informed those present that he would allow for public
comment during the Acacia Hills Sign discussion.
Councilor Thomas requested that item 5.b. Council Minutes of December 13,
2001 be removed from the consent agenda.
MOTION by Thomas, seconded by Gmach, to approve the Consent Agenda,
except for item 5.b. Council minutes of December 13, 2001; and to approve:
December 13, 2001 workshop minutes; claims as presented; Tobacco License
transfer; Local Board of Review meeting date; and Police Chief Schutte as
additional signer of checks for the city. Voting Aye: Bucher, Gageby, Gmach and
Thomas. (Motion Carried)
Corrections to the December 13, 2001 minutes:
“In that letter Mr. Musielewicz referenced the alfalfa in the area where drainage is
now occurring, noting that eventually, grasses and other species of lower forage
quality will would replace the alfalfa, if excessive ponding were to occur.” and
“After considerable discussion by the City Council, it was the consensus that there
was no clear right or wrong answer. and that the city and The landowners should
work together to resolve the situation, and the City would help facilitate that
discussion. “
MOTION by Thomas, seconded by Gmach, to approve the minutes of the
December 13, 2001 council meeting as corrected. Voting Aye: Bucher, Gageby,
Gmach and Thomas. (Motion Carried)
The Council directed that the Certificate of Survey draft ordinance be forwarded
to the Planning Commission for their consideration and the public hearing
process.
Engineer Vander Top gave a brief overview of the request being made to allow
access from Hackamore to the Wild Meadows development located within the
City of Medina. Vander Top requested that the council defer the matter until
January 10 to allow the developer and his engineer to be present for the
discussion. The council concurred with deferring the matter.

Addressed the violation occurring with the placement of two signs at the entrance
of the Acacia Hills development. They have a conditional use permit allowing for
one sign.
Councilor Gmach gave an overview of the situation and the history of the signs.
Raised concerns that there are other signs located within the c ity that are in
violation, that the city should not just enforce this one violation. Corcoran’s
existing sign ordinance is very restrictive and recommends that the city seriously
look at amending the existing sign ordinance.
Councilor Thomas commented that he was not ready to pass judgment on the
ordinance. The process was followed with Acacia Hills, and they chose to ignore
the ordinance. Councilors Bucher and Gageby concurred with Thomas.
Chuck Lymangood addressed the council –There are many signs in violation,
process to enforce by the City could be arbitrary.
Mark Helvick and Brian Holt both spoke on behalf of Acacia Hills. Would like to
see both signs allowed; work with city to resolve to allow both signs.
MOTION by Bucher, seconded by Thomas, to defer this matter to the Planning
Commission for them to review the ordinance, at their convenience. Voting Aye:
Bucher, Gageby, Gmach and Thomas. (Motion Carried)
MOTION by Gageby, to suspend sign ordinance enforcement in the city until the
sign ordinance is reviewed.
MOTION WITHDRAWN by Gageby.
MOTION by Thomas, seconded by Gageby, to suspend the enforcement of the
sign ordinance against the Acacia Hills signs, to allow the Planning Commission
and City Council an opportunity to review the sign ordinances, finding that by not
enforcing the ordinance against this single violation the city will not create a
hazardous situation nor will it fail to protect the safety and welfare of its citizens.
Voting Aye: Bucher, Gageby, Gmach and Thomas. (Motion Carried)
Charter Commission Chair Lymangood addressed the council on instituting a
mayoral primary to be affective in 2002. This would only occur when three or
more candidates have filed for the position of Mayor.
Charter Member Brian Lother identified the time line for implementation.
MOTION by Gmach, seconded by Thomas, to direct staff to proceed with the
necessary steps to establish a Mayoral Primary. Voting Aye: Bucher, Gageby,
Gmach and Thomas. (Motion Carried)
Engineer Vander Top reported to the council on the findings of the feasibility
report for the development of public infrastructure to serve the UMC property.
There are two primary options to consider.

▪ Construct a 12-inch water main from approximately 1,700 feet west of
Willow Drive to UMC and the study area.
▪ Construct a 10-inch sanitary sewer from UMC and the study area to the
City border. Construct a lift station and 6-inch force main to pump to the
15-inch sewer approximately 800 feet east of Willow.
▪ Preliminary Cost Estimate - $980,000
Option #2 –
▪ Construct water supply system within the City of Corcoran including:
o 12-inch well,
o pump house, and
o 200,000 gallon to 300,000 gallon water tower
▪ Construct 12-inch trunk water main within the study area.
▪ Construct the same wastewater collection system identified under Option
#1.
▪ Preliminary Cost Estimate - $1.5 – 1.6 Million
In either option, UMC could construct an interim on-site wastewater treatment
system in lieu of a collection system to Medina.
There is 80.55 acres within the benefited area, of which approximately 70 acres
are developable. Within this area there would be area charges estimated to be
$3,000 per utility per acre.
To move the process forward the following steps were identified: continue to
work on the completion of the comprehensive land use plan; meet with the three
property owners within the benefited area; identify funding options; identify who
is willing to participate, and to what extent; and communicate with Phyllis Hanson
of the Met Council on this proposal and how it plays into the staging of the comp
plan.
MOTION by Gmach, seconded by Thomas to accept the budget analysis as
presented. Voting Aye: Bucher, Gageby, Gmach and Thomas. (Motion Carried)
Clerk Vergin reported on a situation that had occurred regardi ng the placement of
a temporary structure for an emergency quarantine situation. The council
concurred with the decision by staff and recommended that if additional time is
required that at staffs’ discretion the placement of the temporary structure can be
extended. Noted that when the zoning ordinances are reviewed an ordinance to
deal with these types of situations should be considered.
Reviewed the equipment being purchased at this time through the Equipment
Certificate program. Agreed that the monies for the plow should come from the
Certificates, not the general fund.
Addressed the quote presented on the Nextel phones. After considerable
discussion, it was the consensus of the council to deny the Nextel phones. The
Police department will remain the same, no changes to their phones. The Public
Works does appear to have a need. The council directed staff to look into a cell
phone allowance and bring it back to the council for further consideration.

Councilor Gmach reported that he and Mayor Guenthner had attended a meeting
of the Hanover City Council to address the CSAH 19 project. Hanover will
continue to meet with Hennepin County to come to a resolution. At this time, it
appears that the 19 / 117 intersection will become a four-way stop.
Councilor Bucher announced that he would attend the planning commission
meeting, and that Mayor Guenthner could then attend the Highway 55 Corridor
meeting.
The City Administrator job description has been completed. Advertising for the
position will take place the week of January 7. Councilor Bucher will work on the
grading system.
Addressed the planning commission appointments. Councilor Gageby noted
concerns that some of the commissioners’ terms are expiring; yet, appointments
would not be made until January. Clerk Vergin informed the council that the
commissioners appointments actually extend until such time as reappointments or
new appointments are made, as they are a recommending body.

meeting, 9:30 p.m. Voting Aye: Bucher, Gageby, Gmach and Thomas. (Motion
