The Pledge of Allegiance was said. MOTION by Bucher, seconded by Thomas, to approve the agenda with the addition of 8.c. Interim Administrator. Voting Aye: Bucher, Gageby, Gmach, Guenthner and Thomas. (Motion Carried) Open Forum – No one MOTION by Bucher, seconded by Gmach, to approve the Consent Agenda, approving: November 29 workshop minutes; November 29 council minutes; claims as presented; and award of the cropland bid. Voting Aye: Bucher, Gageby, Gmach, Guenthner and Thomas. (Motion Carried) Dan Lange was present to address the drainage at the Kidnation site. Mr. Lange stated that he felt that there were false statements in the engineer’s report dated December 8, 2001, 1) “.. the natural low point is just west of the Kidnation property..” and 4) “All runoff from the property still goes to the same point as predevelopment conditions.” Mr. Lange provided the council and staff with a map and letter provided from two individuals that have farmed the property, indicating that the low area had been where the Kidnation building is now located. He also provided a letter he had received from Edward Musielewicz, a district conservationist with the USDA. In that letter Mr. Musielewicz referenced the alfalfa in the area where drainage is now occurring, noting that eventually, grasses and other species of lower forage quality would replace the alfalfa, if excessive ponding were to occur. Engineer Vander Top responded to the comments by Lange, stating that storm water has been an issue with this application and details were scrutinized o n the project to assure that the standards were met. The infiltration system first proposed with the site would not have worked; the retention pond was the alternative solution. The preferable method would have been to drain it to the ditch, but due to the topography of the land that was not feasible. The applicant (Kidnation) has met the city’s requirements. The only other solution would be to run drain tile through the entire property. After considerable discussion by the City Council, it was the conse nsus that there was no clear right or wrong answer. The landowners should work together to resolve the situation, and the City would help facilitate that discussion. Attorney Carson will provide information on an organization that provides mediation services, North Hennepin Mediation. MOTION by Gmach, seconded by Gageby, to approve Resolution No. 2001-82, approving the Emergency Coordinator Contract. Voting Aye: Bucher, Gageby, Gmach, Guenthner and Thomas. Voting Aye: Bucher, Gageby, Gmach, Guenthner and Thomas. (Motion Carried) MOTION by Bucher, seconded by Gageby, to approve Resolution No. 2001-85, authorizing pursuing quotes for ditch work on Rolling Hills Road. Voting Aye: Bucher, Gageby, Gmach, Guenthner and Thomas. (Motion Carried) Clerk Vergin reported on information from Mr. Chuck Lymangood. According to the data practice regulations, contracts entered into on behalf of the city are required to include a clause regarding access to public information. Attorney Carson further explained that the requirement falls under Chapter 13.05, Subd. 11. That future contracts entered into by the city shall contain such appropriate language. Carson further reported that staff is presently working on other ordinances regarding data practices, which will be coming forward to the council shortly for consideration. Mayor Guenthner reported that he had a meeting on December 11 with NAC and Bonestroo staff members regarding the comp plan process. It is recommended that the scheduled meeting for December 20 be canceled and rescheduled for January 17. At the January meeting, a draft of the plan will be presented, which will demonstrate how the phasing will take place. Guenthner also noted that he had received feedback that the planning commission feels that they have not been included enough in the meeting process. He will find ways to clarify that it is meeting open for free discussion by all commission and council members. With no objections heard regarding the change in schedule, Guenthner noticed that the December 20, 2001 meeting is canceled and the next comp plan meeting will be on January 17, 2002 at 7:00 p.m. MOTION by Gmach, seconded by Thomas, to offer to Sue Vergin the option of either non-exempt overtime pay at the present rate, or exempt status at grade 10, starting step, to perform the functions of interim administrator during the absence of an administrator, with pay to be effective in the current pay period. Voting Aye: Bucher, Gageby, Gmach, Guenthner and Thomas. (Motion Carried) Councilor Gageby reported on the NW League meeting. Hennepin County representatives were present at the meeting and addressed the CSAH 19 project. Currently the City of Hanover has not approved the preliminary design. Because the project is funded federally with ISTEA funds, if not all entities approve the preliminary design the project does not move forward. This is a concern to Corcoran. The Council directed that two members of the council along with Craig Twinem from Hennepin County attend the next Hanover council meeting to address the importance of the project. Gageby further reported that he had been contacted by the Mayor of Dayton regarding wastewater / development agreements. If Corcoran is interested Dayton would be willing to come and address those. Engineer Vander Top noted that as the engineer for Dayton he could supply that information to Corcoran. Councilors interested in attending should contact Clerk Vergin so that she can confirm registrations.
