Acting Mayor Bucher opened the workshop at 6:00 p.m., on April 12, 2001. The
purpose of the workshop was to address the codification of the city’s ordinances
and codes.
Present were Councilors Bucher, Gageby, Gmach, and Thomas, Administrator
Colotti, Police Chief Schutte, Attorney Carson and Clerk Vergin. Excused absent
was Mayor Guenthner.
Addressed the intent on format for proceeding forward. Should staff make
changes, highlight those changes with the council during the workshops and then
any additional changes or recommendations from council can be made at that
point. Or continue as presently doing with council reviewing each chapter with
staff and making changes during the workshops. Consensus to address the format
at the close of the workshop.
Reviewed changes to the code to date; with the following additional changes
recommended:
Chapter 10 General Provisions:
Noted - City Charter should be recognized in the ordinance.
Amended - 10.15 (B) No suit, proceedings, right, fine, forfeiture or penalty
instituted, created, given, secured or accrued under any ordinance previous to its
repeal shall in any way be affected, released or discharged, by such repeal.
Added - 10.99 (E) In addition to the above penalties, the City may take other
actions deemed necessary to eliminate on-going violations such as application for
restraining orders or injunctive relief.
Chapter 30 Administration:
Amended - 30.02 Special Meetings; Emergency Meetings; Adjournment
(A) Special meetings of the City Council may be called by any two members
in writing and filed with the Clerk. The Clerk shall immediately notify
each member of the time and purpose of the meeting by causing a written
notice to be mailed, or otherwise delivered, to each member personally.
The Clerk shall cause an affidavit showing service of the notice as herein
provided to be filed in his or her office prior to the time fixed for the
special meeting. Pursuant to M.S. 471.705, written notice of any special
meeting shall be posted giving the date, time, place and purpose of the
meeting at least three days before the meeting. Written notice shall be
mailed at least three days before the meeting to anyone who has filed a
written request for notice of special meetings. In calculating the three
days, if the last day falls on a Saturday, Sunday or legal holiday, the next
regular business day shall be counted as the third day.
(B) Emergency Meetings. An emergency meeting is a special meeting called
because of circumstances that, in the judgment of the City Council,
requires immediate consideration by the Council. Notice of the
emergency meeting shall be given by telephone or by any other method
used to notify the members of the Council. Notice shall include the
subject of the meeting. Posted or published notice of an emergency
meeting shall not be required. A good faith effort to provide notice of the
meeting to each news medium that has filed a written request for notice
shall be made.

(C) The Council may, by a majority vote of those present, adjourn from time
to time to a special date and hour.
Chapter 32 Emergency Management
32.10 This ordinance is in the process of being rewritten by Attorney Carson. Staff
will review, but will not bring this back for review at a workshop, the council will
review with final draft ordinance.
Section 250 – Planning Commission
250.07 Board of Appeals and Adjustment – This will be modified.
It was suggested that the Waste Water commission should also have a section
allowing for appeals. Attorney Carson will check into the Board of Appeals
further to determine if it is required by State Statutes.
Left off with Waste Water Commission section.
It was the consensus of the council to continue in the manner that they have. Staff
will make appropriate changes and the council will review.
Set May 10, 2001 as a workshop, to address the Employee Handbook.
Set May 24, 2001 as a workshop to continue on the Code Book.
MOTION by Thomas, seconded by Gmach to close the workshop, 6:55 p.m.
