Mayor Guenthner called the regular council meeting of March 8, 2001 to order at
7:00 p.m. Present were Councilors Bucher, Gageby, Gmach, Guenthner and
Thomas, Administrator Colotti, Clerk Vergin, Attorney Carson and Engineer
Vander Top.
Others in attendance included: Neeme Markus, Dan Heitke, Vivian Heitke, Jane
Willaims, Rod Baakkonen, Steve Dornsbach, Ericka Wickham, Steve Kohnen,
Loren Kohnen, Pat Puhle, Pat Meister, and Dorothy Thies.
The Pledge of Allegiance was said.
MOTION by Gmach, seconded by Thomas, to approve the agenda, with the
following changes and additions: item 10 – Hearing for 1050 Liquor Violation will
be a report, no hearing necessary; item 12 – Gator Purchase by Police Department;
and item 13 – Meeting date for TIF Workshop. Voting Aye: Bucher, Gageby,
Gmach, Guenthner and Thomas. (Motion Carried)
MOTION by Thomas, seconded by Bucher, to approve the consent agenda items
of: Claims and Description of Claims, and Re-Keying City Building; and to
remove the following items for corrections and discussion: Minutes of February
22, 2001, and Purchase of Office Furniture. Voting Aye: Bucher, Gageby, Gmach,
Guenthner and Thomas. (Motion Carried)
MOTION by Gmach, seconded by Bucher, to approve the minutes of the February
22, 2001 council minutes with the correction of “resign” to “re-sign”. Voting Aye:
Bucher, Guenthner, Gageby, Gmach and Thomas. (Motion Carried)
Addressed the purchase of office furniture for the police department. Directed staff
to look at used furniture.
MOTION by Thomas, seconded by Gmach, to authorize staff to proceed with
obtaining the furniture, not to exceed $4,400.00, with staff reporting back to the
council on the decision made regarding used or new furniture. Voting Aye:
Bucher, Gageby, Gmach, Guenthner and Thomas. (Motion Carried)
Open Forum – Neeme Markus, 8655 Trail Haven Road: Concerned with
development of land adjacent to his property.
Mayor Guenthner explained that if the development of the property is done within
the perimeters of the rules and regulations that the city has in place; then there is
nothing the city can do. If it does not meet the criteria defined by city regulations,
then perhaps it would not be allowed. Would be happy to meet with Mr. Markus to
address this further after the meeting.
Administer Colotti noted that to her knowledge no application has been made to
the city for the development Mr. Markus is referring to.
MOTION by Thomas, seconded by Gmach, to adopt Ordinance No. 162
adopting a moratorium on accessory structures in the side or rear yard on
parcels that are three acres or less, effective until May 30, 2001, allowing

time for the city to review design standards for accessory structures. Voting
Aye: Bucher, Gageby, Gmach, Guenthner and Thomas. (Motion Carried)
MOTION by Bucher, seconded by Thomas, to adopt Ordinance No. 163,
extending the moratorium on Home Occupations until April 30, 2001,
allowing the city additional time to review regulations for those types of
activities. Voting Aye: Bucher, Gageby, Gmach, Guenthner and Thomas. (Motion
Carried)
PUBLIC HEARING - ROLLING HILLS ROAD
Mayor Guenthner called the public hearing to order at 7:28 p.m., as published and
noticed as required, for the purpose of addressing the proposed improvement to
Rolling Hills Road.
Various affected property owners were present for the discussion, including the
Heitkes, Dornbachs, Willie, and Baakkonens.
Engineer Vince Vander Top described the proposed project. It will consist of
constructing a 24-foot wide bituminous path with four (4) foot gravel shoulders on
either side, soil corrections, improvement of two curves, ditch improvements,
upgrading of culvert box and other related construction improvements. In
conjunction with this they will look at lowering the hill from Homestead Trail.
Easements required along Rolling Hills Road are in the process of being acquired.
Addressed the cost estimates and methods by which those costs could be paid. The
total project cost, with Homestead Trail is estimated at $755,000.00. Of this
Nedegaard will contribute $285,000.00 with the remaining coming from MSA
funds. In order to finance this with MSA funds, year 2002 funds will most likely
need to be allocated to this project.
Addressed assessing methods of the project to the other affected properties. There
are four parcels within the project area that will be granted more building rights, as
they will abut a paved road. Need to look at the city’s assessment policy and what
is equitable to the remaining city.
Reviewed the proposed project schedule. If council authorizes plans and
specifications, anticipate that construction would begin in May or June with gravel
base completed by September, the bituminous surface would not be completed
until 2002.
Mayor Guenthner opened the hearing for public comment.
Dan Heitke: Stated that he was under the impression that there would not be any
assessment for this project, because the developer was seeking the improvement.
Wanted to know when the city changed that decision and decided to assess the
properties.

REGULAR COUNCIL MEETING CONTINUED
Councilor Gmach stated that as a result of the improvement, development rights
will increase. The MSA funding subsidizes the costs, allowing the city to defer
assessments on open land. If Rolling Hills road uses only MSA, it is not equitable
to the rest of the city, need to treat everyone equally.
Mayor Guenthner noted that the developer is buying down the other assessments.
Engineer Vander Top informed the council that it appears that five out of the nine
property owners have indicated moving forward and are willing to grant the
easements if they are not assessed. For easements that are not acquired, the city
will need to move forward with condemnation proceedings, anticipate that
occurring in April.
MOTION by Thomas, seconded by Bucher, to adopt Resolution #2001-17,
ordering the plans and specifications for the Rolling Hills Road Improvement
Project. Voting Aye: Bucher, Gageby, Gmach, Guenthner and Thomas. (Motion
Carried)
MOTION by Gageby, seconded by Gmach, to adopt Resolution #2001-18,
adopting the Liquor License Violation Policy to include the following language:
“ …the City Council has determined to impose, at a minimum, a penalty…”
Voting Aye: Bucher, Gageby, Gmach, Guenthner and Thomas. (Motion Carried)
Attorney Jeff Carson reported that the 1050 Club has paid the fine imposed for the
liquor violation, therefore waiving their right to a hearing.
Set a workshop on Thursday, March 15, 2001 at 7:00 p.m. to address tax increment
finance (TIF) matters. The staff was directed to have information available for the
workshop identifying eligible projects, timetable, procedures required, and other
technicalities of amending the TIF district.
MOTION by Gageby, seconded by Bucher, to call a public hearing for April 26,
2001 for consideration of amending the TIF District within the City of Corcoran.
Voting Aye: Bucher, Gageby, Gmach, Guenthner and Thomas. (Motion Carried)
Police Chief Paul Schutte was present to address the purchase of a 6x4 John Deere
Trail Gator Utility vehicle. Requested that the city authorize the purchase with the
funds coming from the Police Capital Improvement Plan (CIP) in the event that
donations do not fully fund the acquisition. Chief Schutte noted that he is very
confident that donations will cover the acquisition.
The council concurred at
this time that no action
would be taken and
directed Police Chief
Schutte to bring this
matter back before them
once a decision has been
made regarding
additional funding.
