HomeMy WebLinkAbout2001-02-22 Council MinutesCITY OF CORCORAN REGULAR COUNCIL MEETING FEBRUARY 22, 2001 Z:\CityHall\Office97\2000\Word\Council Minutes\Council Minutes-01\Feb.22, 2001 Minutes.doc Mayor Guenthner called the regular council meeting of February 22, 2001 to order at 7:00 p.m. Present were Councilors Guenthner, Gageby, Gmach, Thomas, Administrator Colotti, Clerk Vergin and Planner Sherman. Absent was Councilor Bucher, who was excused. Also in attendance were Dorothy Theis, Ken Kluck, Jake and Erika Wickham, Bruce Nedegaard, Loren Kohnen, and Jon Isaacson. The Pledge of Allegiance was said. MOTION by Thomas, seconded by Gmach, to approve the agenda, with the following changes and additions: Comments under item 11 – Ag Preserve; Items 18 and 19 will be reversed; addition of Hillside Drive Accessory Building under Planning Report; under General Business add Call for Liquor Violation Hearing on March 8, 2001; and under Council and Mayor’s Report add discussion of Tax Increment Financing and Dayton Residential Development. Voting Aye: Guenthner, Gageby, Gmach and Thomas. (Motion Carried) Open Forum – No participants. MOTION by Gmach, seconded by Thomas, to approve consent agenda items including: February 8, 2001 Workshop Minutes, February 8, 2001 Council Minutes, February 12, 2001 Wastewater Commission Minutes, Authorize Purchase of Tractor and Mower, and January 2001 Monthly Police Report; remove the following items from the consent agenda for discussion: Claims, Budget Reports, Pre-paid Claims Signature; and Purchase of Computer. Voting Aye: Guenthner, Gageby, Gmach and Thomas. (Motion Carried) Discussed the claims. Addressed planning services, what services could be provided by city staff and what could be handled by the consulting staff. Mayor Guenthner informed the council that he and Councilor Thomas have met with staff and intend to meet again to further review this matter. A follow up with the council will be done at a later date. MOTION by Thomas, seconded by Gmach, to approve claims #1275 – 1317, and prepaid claims totaling $69,891.51. Voting Aye: Guenthner, Gageby, Gmach and Thomas. (Motion Carried) Discussed the budget reports. Explained the general accepted accounting principals (GAAP), where excess revenues are shown in brackets, making it appear as a negative; and where excess disbursements are shown as positives, as it relates to the budget. Administrator Colotti reviewed the projected variances for the year-end based on data through the end of January. MOTION by Gageby, seconded by Thomas, to accept the Budget Report. Voting Aye: Guenthner, Gageby, Gmach and Thomas. (Motion Carried) Discussed authorizing staff to process and sign checks for prepaid claims. It was noted that Councilor John Bucher, as acting mayor, could also sign checks in the absence of Mayor Guenthner. Voting Aye: Guenthner, Gageby, Gmach and Thomas. (Motion Carried) Addressed the acquisition and use of a laptop computer and projector. The Corcoran Jaycee’s have pledged $3000.00 towards this purchase. Their organization as well as other community organizations and those that rent the civic center could utilize the projector. The laptop would be made available to other departments of the city, for such things as the Firearms Safety and Snowmobile Safety training sessions. MOTION by Thomas, seconded by Gmach, to authorize the acquisition of the projector and laptop computer as described. Voting Aye: Guenthner, Gageby, Gmach and Thomas. (Motion Carried) MOTION by Thomas, seconded by Gageby, to adopt Resolution #2001-09, authorizing the issuance of liquor licenses to Golden Acres Golf Course (DBA Pheasant Run). Voting Aye: Guenthner, Gageby, Gmach and Thomas. (Motion Carried) Reviewed the three agriculture preserve applications, identifying the areas they are located within the city. Noting that they are not within the three development areas identified in the Comprehensive Land Use Plan. Addressed the signing up and signing out process. When a landowner requests to be placed in a preserve the City requires that they sign up and out, allowing them to be in the preserve for a period of eight (8) years, and if at the end of that time they choose to continue, they re- sign for another 8 years. MOTION by Gmach, seconded by Thomas, to approve Resolution # 2001-10, designating the Edmund Cain Family Farms to Agriculture Preserve. Voting Aye: Guenthner, Gageby, Gmach and Thomas. (Motion Carried) MOTION by Thomas, seconded by Gmach, to approve Resolution # 2001-11, designating Loren and Joanne Kohnen’s property to Agriculture Preserve. Voting Aye: Guenthner, Gageby, Gmach and Thomas. (Motion Carried) MOTION by Gmach, seconded by Thomas, to approve Resolution # 2001-12, designating Chester and Arlean Kottke’s property to Agriculture Preserve. Voting Aye: Guenthner, Gageby, Gmach and Thomas. (Motion Carried) Addressed the Liquor Violation Policy. MOTION by Gageby, seconded by Gmach to approve Resolution #2001-13, adopting the Liquor License Violation Policy. Discussion: There were concerns raised that there should be some time frames and limitations identified in the policy. After much consideration and discussion the council considered an amendment to the Policy. Voting Aye: Guenthner, Gageby, Gmach and Thomas. (Motion Carried) MOTION by Gmach, seconded by Thomas, to adopt Resolution # 2001-14, ordering the feasibility report for the Rolling Hills Street Improvement project. Voting Aye: Guenthner, Gageby, Gmach and Thomas. (Motion Carried) MOTION by Gmach, seconded by Thomas, to adopt Resolution # 2001-15, calling for the public hearing on the Rolling Hills Street Improvement project. Voting Aye: Guenthner, Gageby, Gmach and Thomas. (Motion Carried) MOTION by Thomas, seconded by Gmach, to adopt Resolution # 2001-16, approving the re-plat of lots 1,2,3, of block 1 Lake Jubert Estates. Voting Aye: Guenthner, Gageby, Gmach and Thomas. (Motion Carried) Addressed the Home Occupation Ordinance. After considerable discussion the council concurred that the ordinance needs to be simple, specific, and enforceable. Directed Planner Sherman to redraft the ordinance, based on the discussions of the council, and bring it back for their review at the March 22 council meeting. After council review, it would be presented to the planning commission for their review, and a public hearing would be ordered for consideration of adoption. Staff was then directed by the Council to prepare an ordinance for the next meeting to consider the extension of the present moratorium on home occupation businesses. Addressed the matter of an accessory building located on Hillside Drive. Per Planner Sherman the accessory building meets the requirements of the ordinance. If the Council wishes to have tighter controls over accessory buildings then an amendment to the ordinance needs to be made. Staff was directed to proceed with preparation of an ordinance amendment for accessory buildings based on the discussion. MOTION by Thomas, seconded by Gageby, to direct staff to prepare a moratorium ordinance to prohibit permitting construction of accessory buildings on lots less then three acres for consideration at the March 8 council meeting. Voting Aye: Guenthner, Gageby, Gmach and Thomas. (Motion Carried) Addressed the prioritization of the codebook. Set an initial work session for March 8, at 6:00 p.m. to address the codebook, beginning with the General Provisions and Administration sections. MOTION by Thomas, seconded by Gmach to set a hearing for March 8, 2000 at 7:00 p.m. to review the alleged liquor license violation of the 1050 Club. Voting Aye: Guenthner, Gageby, Gmach and Thomas. (Motion Carried) Councilor Gageby informed the council of information that he had received addressing potential legislation to TIF districts that may affect the city. Gageby also informed the council of a residential development in Dayton that used the clustering method, one well and one septic system, allowing a higher density development, and still provide green space. Planner Sherman informed the council that the Schlagens have questioned if the council will reconsider their application if they provide the right of way previously requested by the city. It was the consensus of the council that if the Schlagens are willing, in writing, to meet the requirements as previously identified, the city would reconsider their application.
