Present were Councilors Bucher, Gageby, Gmach, Guenthner and Thomas. Also present were Administrator Vergin, Clerk/Treasurer Tillmann, Police Chief Schutte, Engineer Vander Top, and Planner Grittman. Mayor Guenthner called the meeting to order at 7:00 p.m., followed by the Pledge of Allegiance to the flag. There were no requests by the public to speak during Open Forum. MOTION by Bucher, seconded by Thomas, and carried unanimously to approve the agenda as presented. MOTION by Bucher, seconded by Gageby and carried unanimously to approve the consent agenda items, with the exception of 5.a., as follows: 5.b Approve the Regular Council Meeting Minutes of September 12, 2002 as presented. 5.c Approve claims #3072 - 3121, in the amount of $84,295.89, as presented. 5.d Approve the appointment of Charles LeBarge, 9829 Creekview Circle, Rogers, as an alternate member of the Waste Water Commission, effective October 1, 2002, as recommended. 5.e Adopt Resolution #2002-66, setting the amount to be assessed to benefiting property owners for the improvements to Hage Drive at $93,141.00, payable in equal annual installments over a period of seven (7) years, setting the interest rate at 7%, per annum from the date of adoption of the final assessment resolution, and direct the City Engineer to calculate the amount assessed against individual properties and file a copy in the City Clerk’s Office. 5.f. Adopt Resolution #2002-67, scheduling an assessment hearing for the improvements to Hage Drive for Thursday, October 10, 2002 at 7:00 p.m., directing the City Clerk to notify all affected property owners, and allowing pre-payment of the assessment by property owners. Discussion was held regarding consent agenda item 5.a – August 22, 2002 Com Plan Workshop Minutes. Councilor Bucher felt that the definition of “downtown” district” and “urban reserve” still needed further clarification and would like a more accurate definition before the minutes are approved. Engineer Vander Top suggested that the downtown district be further defined as “the area generally North of County Road 10, West of County Road 116 and bounded by the creek.” MOTION by Bucher, seconded by Gmach, and carried unanimously to approve item 5.a. of the consent agenda as follows: 5.a. Approve the Comp Plan Workshop Minutes of August 20, 2002, as presented. New Business There was no new business for consideration. The following items were discussed in relation to the Plan. Map after Page 7 – Mayor Guenthner pointed out that the map was of the 2020 plan provided by the Met Council. Questioned if the map of the 2030 plan should be used instead, since the Met Council is currently working under the 2030 plan. Comments were heard from Robin Kauffman, Met Council Representative, who advised that the 2020 map should be used since Corcoran’s Comp Plan is being reviewed under the 2020 map. Page 16 – Would like to see the Natural Resources Inventory included as an appendix. Planner Grittman advised that it would have be bound separately due to the size, but would be included in the appendices. Page 36 – Public/Semi-Public Land Use – Integrate language relating to this being a function of a City of Corcoran Park Commission when assessing future open space needs. District Maps – Extensive discussion regarding the level of detail in the maps and how they correspond to the 2020 Land Use Map. It was agreed that the 2020 map should be enlarged to encompass two fold out pages and the following district maps would match the 2020 Land Use Map. Page 63 – Add language referencing a future City of Corcoran Park Commission Planner Grittman advised that the population projections came in lower than originally anticipated. Projections changed from 23,000 to 17,240, reflecting approximately a 25 – 30% change in the population projection for 2020. MOTION by Gmach, seconded by Gageby, and carried unanimously to accept the City of Corcoran Comprehensive Land Use Plan, directing staff to make the changes outlined above and re-submit the plan to the Met Council for review and approval. Discussion was held regarding a proposed amendment to Ordinance No. 170, amending Section 10 of the Home Occupation Ordinance. Mayor Guenthner advised that this amendment stems from discussion that occurred during the Home Occupation Commission meeting held on August 15, 2002. This issue arose during consideration of a home occupation application that would qualify under the ordinance, but does not because of the number of part-time and full-time employees. The home occupation in question is a low impact business. Should the City considers employees based on a full time equivalent instead of number of employees. Discussion was held regarding the Proposed Final Draft of the City of Corcoran Municipal Codes. Administrator Vergin advised that an executive summary at the beginning of each chapter explains the intent of the chapter and any changes that had been made. The Municipal Code deals with general offenses and nuisances within the City. It does not pertain to land use or zoning issues. The Codes will be published in the City’s Official newspaper in summary form and will be bound once finalized. Codes will also be available in PDF format on the City’s website. Changes were made to Section 35.14, regarding the Waste Water Commission and section 70.02 regarding Weight Restrictions. The Animal Unit Chart also needs to be added, as well as information regarding Junk Vehicles. MOTION by Thomas, seconded by Bucher, and carried unanimously to adopt Ordinance No. 179, repealing the existing Municipal Codes of Ordinances for the City of Corcoran and adopting the new City of Corcoran Code of Ordinances, effective immediately, with the stipulation that all zoning, subdivision, franchise agreements, moratorium and home occupation ordinances shall remain in effect. Staff Reports Engineer Vander Top was present to discuss the Elm Creek 2nd Generation Plan. The purpose of the Watershed Management Plan is to protect, preserve, and manage surface water and groundwater resources, as well as managing public resources to study, control and correct flooding and other water quality problems while educating the public on pertinent water resource management issues. The plan has ramifications for the community and the City needs to review the plan and provide comments to the Elm Creek Watershed. Comments were heard from Dennis Stieg, Watershed Commissioner and Corcoran Resident regarding the 2nd Generation Plan. Commissioner Stieg recommended voicing any concerns about the plan during the comment period because it would be difficult to make changes at a later date. The Council directed staff to forward comments to the Hennepin Conservation District, advising that the City of Corcoran embraces water quality, but has some concerns about the plan, specifically pertaining to the responsibility to rectify flooding and other issues, as well as the annual assessment costs to the City, and to inform the Watershed of things that the City is currently practicing to manage our water resources. Engineer Vander Top provided report on the Elm Creek Interceptor. A public hearing will be held on Wednesday, October 9, 2002 at 7:00 p.m. It would be appropriate for representatives from the City of Corcoran to be present at that hearing. Engineer Vander Top provided a report on the status of flooding in the Rush Creek area. At this time, HCD is not willing to complete the flooding study, but will support whatever Hennepin County Transportation in whatever action they decide to take. Hennepin County is looking internally for staff that can assist in doing the necessary modeling. Mayor Guenthner and Engineer Vander Top will arrange a meeting with Commissioner Penny Steele to discuss the situation and determine an appropriate course of action. Administrator Vergin provided an overview of the Highway 55 Corridor Meeting held on September 19, 2002, with representatives from the MN Department of Transportation and Hennepin County. She and Engineer Vander Top attended on behalf of the City of Corcoran. A public open house will be held on October 24, 2002 from 4:00 – 7:00 p.m. The City of Corcoran should be represented at the open house Engineer Vander Top provided an update on the status of Mama G’s redevelopment project. The new Mama G’s is unable to rebuild with the existing 4” service line. Due to construction standards, they will need to have a 6” service line. There are also fire code issues that contribute to the delay. The Council is concerned with the existing structure being a sub-standard, non-conforming structure. It does not conform to City standards in its current state. To date, the Developer’s Agreement between the City and Mama G’s has not been fulfilled. The Council was advised that the City/Developer need to resolve the utility and platting (Delgany II) issues before this project could move forward. Suggested a deadline of the end of 2002, with application for plat of new Mama G’s made to the Planning Commission in early 2003. Councilor Bucher requested a more definite timeline with major progress points mapped out from now until ground breaking for the new facility. Staff was directed to draft a letter to the City of Maple Grove requesting that sewer and water services be considered for the area including and surrounding Mama G’s, and report back at the next meeting. Engineer Vander Top reported on the status of the Park Place Storage plat. Improvements to the plat have occurred over a number of years. Recently the owner, Paul Jorgenson, requested a grading permit for the out lot adjacent to CSAH 19 near the property entrance south of the Honda Electric site. Jorgenson would also like to continue construction of condo/storage units in the west half of the property. Approval of the grading permit is an administrative process, but staff feels that the Council needed to review the application. Staff was advised that Council was not opposed with proceeding with the approval of the grading permit. Police Chief Schutte presented a report on the 2001 – 2002 Safe and Sober Campaign. The project concentrated on alcohol and seat belt enforcement as well as an emphasis on youth alcohol offenses. During this campaign, it was determined that seat belt usage had increased by approximately 5%, and that incidents of impaired driving dropped. Higher concentration of safe and sober patrol was done around the holidays. Discussion was held regarding recent Letters to the Editor pertaining to the Waste Water Commission. Councilor Thomas questioned a statement in the September 14, 2002 WWC minutes stating that they will not provide a response to recent letters to the editor regarding the removal of members from the Commission. The WWC felt that a response by the City might be viewed as adding credibility to statements made by HRUA members. Attorney Carson has compiled a statement of Findings of Fact regarding the issue, which was provided to the Council. The Council acknowledged the Findings of Fact received from Attorney Carson and requested that this item be placed on the October 10, 2002 meeting agenda for further discussion.
