Present were Councilors Gageby, Gmach, Guenthner, and Thomas, Administrator Vergin, Clerk/Treasurer Tillmann, and Public Works Director Meister. Mayor Guenthner called the meeting to order at 7:07 p.m., followed by the Pledge of Allegiance to the flag. Councilor Bucher was excused absent MOTION by Gmach, seconded by Gageby and carried unanimously to approve the agenda with the following addition: • Schedule Comp Plan Working Group Meeting and Budget Workshop – New Business • Report on Doboszenski Relocation Proposal – Staff Reports • Report on SW Corner Task Force Meeting – Staff Reports There were two requests by the public to speak during Open Forum. Bill Halverstadt, 6420 Old settlers Road, Corcoran - Questioned why he had been included in the motion of July 11, 2002 Council Meeting to be removed as a member of the HRUA. Felt that the Council had been given incomplete and inaccurate information. Council responded that because Mr. Halverstadt serves on the Board of Directors of the HRUA, he has the ability to influence the decisions that they made, specifically whether they should pull city permits for septic work. The Council agreed that although he was less involved in the activities of the HRUA, information was not being shared with the Council regarding those activities, and he, being on the Board of Directors, should have shared some of that information with the Wastewater Commission, as well as sharing information on City policies with the HRUA. Charles and Carol LaBerge, 9829 Creek View Circle, Rogers - Concerned about the flooding of Rush Creek and the damage it has done to their home and property. Wondering what the City and Hennepin County are doing to correct the problem and what kind of plan will be followed to rectify the situation. Administrator Vergin advised that Engineer Vander Top is working with Hennepin County to create a model to determine the reason that the area is flooding. Public Works has recently cleaned out the culvert. The County and the City are working together to solve this flooding issue. Council responded that the County has to be a part of the solution and that Engineer Vander Top was directed by the Council to work with the County to rectify the situation. It is also important that the homeowner (LeBerge) be involved in the resolution process. The situation will take some time to fix. There will not be an immediate solution because other homeowners will be affected as well. The County designed County Road 30 so they have to be a part of the solution. The issue will be placed on the August 22, 2002 Council agenda for review of progress. MOTION by Gmach, seconded by Thomas, and carried unanimously to approve the consent agenda items as follows: Called to Order Agenda Approval Open Forum Consent Agenda Approval CITY OF CORCORAN REGULAR COUNCIL MEETING AUGUST 8, 2002 H:\City Hall Information\CITY GOVERNMENT\Council, Commissions & Committees\Council Information\Council Minutes\Previous Years\2002 - Need to PDF\08.08.02 Council Minutes.doc 2 • Approve the Council Workshop Minutes of July 25, 2002 as presented. • Approve the Regular Council Meeting Minutes of July 25, 2002 as amended. • Approve claims #2937 – 2966, in the amount of $13,782.90, as presented. • Adopt Resolution #2002-53, appointing Election Judges for the September 10, 2002 Primary Election and setting the hourly wage at $8.00 per hour for Election Judges and $8.50 per hour for Head Election Judges. New Business Discussion was held regarding Home Occupation Public Hearings held on July 18, 2002. Mayor Guenthner provided background information for the Conditional Home Occupation License (CHOL) application submitted by Jon Isaacson, 10515 County Road 116. The request is being made to allow the continuation of a landscaping and lawn care business, which has operated as a home occupation since 1969 and 1980 respectively. Mr. Isaacs on’s business requires a license under the home occupation ordinance because he stores equipment on site and he has one to two seasonal employees. MOTION by Thomas, seconded by Gageby and carried unanimously to adopt Resolution #2002-54, approving the Conditional Home Occupation License for Jon Isaacson, 10515 County Road 116, for the purpose of conducting a landscape and lawn care business, as recommended by the Corcoran Home Occupation Commission, based on the findings of fact on file at City Hall, and with the following conditions: 1. The CHOL is issued to Jon Isaacson at 10515 County Road 116, and is not transferable. 2. Equipment for the business shall be stored so it is not visible from the road or adjacent property. 3. No signage advertising the business is permitted on site. 4. The CHOL shall allow one seasonal employee. 5. The Licensee shall abide by and remain in compliance with all applicable Federal, State, and City rules and regulations. 6. This license will be reviewed by the City every three years from the date of issuance for a determination that the existing Home Occupation still warrants the issuance of a license. 7. The City may revoke or modify the CHOL upon a finding that conditions have changed to warrant revocation or modification of the license. MOTION by Gmach, seconded by Gageby, and carried unanimously to adopt Resolution #2002-55, approving the CHOL for Dan Hastings, 9530 County Road 116, to allow Mr. Hastings as owner and operator of a semi -truck to store the vehicle on site, as recommended by the Corcoran Home Occupation Commission, based on the findings of fact on file at City Hall, and with the following conditions: 1. The CHOL is issued to Don Hastings at 9630 County Road 116, and is not transferable. 2. One semi truck and trailer may be parked on the property. 3. The semi-truck and trailer shall be parked indoors. No signage advertising the business is permitted on site. 5. There shall be no employees. 6. The license shall abide by and remain in compliance with all applicable Federal, State and City rules and regulations. 7. This license will be reviewed by the City every three years from the date of issuance for a determination that the existing Home Occupation still warrants the issuance of a license. 8. The City may revoke or modify the CHOL upon a finding that conditions have changed to warrant revocation or modification of the license. MOTION by Thomas, seconded by Gageby, and carried unanimously to adopt Resolution #2002-56, approving the Conditional Home Occupation License for Thomas Lithgow, 10025 County Road 116, for the purpose of conducting an automotive repair business, as recommended by the Corcoran Home Occupation Commission, based on the findings of fact on file at City Hall, and with the following conditions: 1. The CHOL is issued to Thomas Lithgow at 10025 County Road 116, and is not transferable. 2. Equipment for the business shall be stored so it is not visible from the road or adjacent properties. 3. No signage advertising the business is permitted on site. 4. The CHOL shall allow up to one employee. 5. The Licensee shall abide by and remain in compliance with all applicable Federal, State, and City rules and regulations. 6. Screening shall be maintained insubstantially the same manner as it exists. 7. The two parcels shall be consolidated. 8. This license will be reviewed by the City every three years from the date of issuance for a determination that the existing Home Occupation still warrants the issuance of a license. 9. The City may revoke or modify the CHOL upon a finding that conditions have changed to warrant revocation or modification of the license. Mayor Guenthner scheduled a meeting of the Comp Plan Working Group for Tuesday, August 20, 2002 at 7:00 p.m., and scheduled a Council Budget Workshop for Thursday, August 22, 2002 at 6:00 p.m. Staff Reports Mayor Guenthner reported that he had again met with Ken Doboszenski, his wife and son and two project managers regarding the proposal to relocate his business. Doboszenski is interested in moving his business to an adjoining parcel of property. The current zoning plan was reviewed and they had discussion regarding the City’s comp plan. Mayor Guenthner encouraged them to work with the SW Corner Task Force on a future relocation project. Councilor Thomas reported that the SW Corner Task Force held their first meeting. Discussed meeting with property owners and residents to establish a vision for that area of Corcoran. Will draft a letter to property owners to schedule a meeting with Engineer Vander Top to facilitate.
