Mayor Guenthner called the joint meeting of the City Council and Planning
Commission to order at 7:00 p.m., on Tuesday, June 18, 2002. The purpose of the
meeting was to address organization of the Home Occupation Commission and
the procedures that would be followed.
Present were Councilors Gageby, Guenthner and Thomas, Commissioners V.
Anderson, Ebert, Kluck, Lieberman and Walli, Administrator Vergin and Planner
Sherman.
The agenda was approved by consensus.
Mayor Guenthner addressed the operation of the Home Occupation Commission.
The records need to support the findings for the action taken by the City. The first
year will be the more challenging, while future applications will be handled in a
similar manner as a conditional use permit.
It was suggested that tax records might need to be requested to verify employees
and subcontractors.
It was noted that if the people are willing to work with the system then reasonable
limits could be set.
It was suggested that laminated personal identifications be made for the
councilors, commissioners and staff, so that they are easily identified when
making inspections. When setting of the reviews it was suggested that the city
request on-site visits. If on-sites are not possible, drive by inspections definitely
need to be done.
If a recommendation cannot be made because there is a lack of information, the
Commission can table the hearing until that information is available.
It was questioned if there would be any incentives offered to businesses to
relocate into commercial areas. Discussion pursued indicating that if a business is
operating illegally in a residential area, monetary incentives do not seem
appropriate. However, time incentives do, such as granting 90 days to transition to
another location.
Site visits, comments from neighboring property owners and staff reports should
provide the commission with information, as well as induce more questions. The
impact of the business not only on adjacent properties but also on the entire city
needs to be considered.
The enforcement of the ordinance will be the responsibility of the city council not
the home occupation commission.
Staff was requested to check into restroom requirements for employees at home
based businesses.

MOTION by Gageby, seconded by Thomas to make the following appointments
to the Home Occupation Commission:
Council Member (one year) Ron Thomas
Council Member (two year) Ken Guenthner
Council Member (alternate) John Bucher
Planning Comm. (one year) Virginia Anderson
Planning Comm. (two year) Ken Kluck
Planning Comm. (alternate) David Lieberman
Resident Member (one year) George Gmach
Resident Member (alternate) Diane Walli
Voting Aye: Gageby, Guenthner and Thomas. (Motion Carried)
Planner Sherman reviewed the three types of home occupations, permitted, special
and conditional. Reviewed some of the applications as a sampling of what the
Home Occupation Commission will see.
Concurred that the council will need to address “not permitted” home occupations
at a council meeting in July.
Choose four home occupations to hold public hearings for on July 18, the
Hastings, J. Isaacson, D. Isaacson, and Lithgows.
It was encouraged that all members of the commission, including alternates be
present for the first hearings to see how they go. Then from that point forward, we
should have a minimum of four, with a maximum of five members at each
meeting thereafter.
MOTION by Thomas, seconded by Gageby to adjourn, 8:20 p.m. Voting Aye:
Gageby, Guenthner and Thomas. (Motion Carried)
