Mayor Guenthner called the regular council meeting of April 11, 2002 to order at
7:00 p.m. Present were Councilors Bucher, Gageby, Gmach, Guenthner and
Thomas, Clerk Vergin, Attorney Carson, Planner Sherman, Engineer Vander Top,
Public Works Director Meister and Police Chief Schutte.
The Pledge of Allegiance was said.
Mayor Guenthner announced that the City has selected a new City Administrator,
current City Clerk Sue Vergin.
MOTION by Bucher, seconded by Thomas, to approve the agenda with Dennis
Stieg under Open Forum, Greenfield Application under Item 10.a. Staff Reports,
and move Planning Application – Great River Energy after Item 5. Consent
Agenda. Aye: Bucher, Gageby, Gmach, Guenthner and Thomas. (Motion
Carried)
Open Forum – Dennis Stieg: Mr. Stieg informed the council of a public input
meeting being held on April 24 by the Elm Creek Watershed, which the council
may wish to attend. Information regarding the meeting was distributed to the
council.
MOTION by Gmach, seconded by Bucher, to approve the consent agenda items,
Minutes of March 26, 2002 Workshop; Minutes of April 2, 2002 Workshop; and
Claims as presented; removed was the Council Minutes of March 26, 2002.
Voting Aye: Bucher, Gageby, Gmach, Guenthner and Thomas. (Motion Carried)
MOTION by Bucher, seconded by Thomas, to approve the Council Meeting
Minutes of March 26, 2002 as corrected: “NE Corner: Consensus to have all
Mixed Use on the land use map identified as Mixed Use/PUD, (polka dot). All
areas are identified either as 2010 – 2020 or as 2015 – 2020 in the sewer-phasing
map. Therefore, consensus that this area can be re-evaluated again in 2008.”
Voting Aye: Bucher, Gageby, Gmach, Guenthner and Thomas. (Motion Carried)
MOTION by Thomas, seconded by Gmach, to approve Resolution 2002-18,
approving the Great River Energy Preliminary Plat, Final Plat, Conditional Use
Permit and Site Plan for properties identified as 27-119-23-32-0001 and 28-119-
23-13-0001. Voting Aye: Bucher, Gageby, Gmach, Guenthner and Thomas.
(Motion Carried)
Local Board of Review Hearing
Mayor Guenthner opened the Local Board of Review Hearing. Present were City
Assessors Ann Risch and Rolf Erickson, and Chris Bennett representing Hennepin
County.
Ms. Risch identified that the land and commercial properties saw the largest
increases in valuations. Described the process that a property owner needs to
follow in order to appeal their property valuation. If unhappy with the City’s
decision they may appeal to the County, then from the County can appeal to the
State. Alternatively, they have the right to appeal directly to Minnesota Tax Court.

Donald Jeszewski at 6215 Willow Drive was present to protest his valuation.
Bill Halverstadt stated he had no objections but commented on the dramatic
increases to land values. Farmers are not producing more income from land;
people are just willing to pay more.
Assessor Risch noted that Green Acres and Agriculture Preserve properties are
more protected and the values remain more constant.
MOTION by Thomas, seconded by Bucher to close the Board of Review
Hearing. Voting Aye: Bucher, Gageby, Gmach, Guenthner and Thomas. (Motion
Carried)
Mr. Jeszewski was informed that he should supply an appraisal for the Board to
review before they can consider any action on his property’s valuation.
MOTION by Thomas, seconded by Bucher to continue this matter to the next
meeting, of April 25, 2002. Voting Aye: Bucher, Gageby, Gmach, Guenthner and
Thomas. (Motion Carried)
Public Hearing – Dust Control
Mayor Guenthner called the Dust Control public hearing to order.
Engineer Vander Top provided an overview of the dust control program that has
been in place for the past three years, along with an overview of the general
maintenance performed on the 38 miles of gravel roads. At this time it is proposed
to assess $50,000 of the project costs, with the City contributing $30,000. If
individuals are not part of the dust control program, they still can participate in the
voluntary program, 300 feet minimum for $180.00. Intend to experiment with the
application rate, as some roads seem to be holding more moisture then desired.
Improve the gradation of the gravel mix, would like higher fine content. The city
can look at adding or deleting roads from the dust control program. They can also
look at paving options for some streets.
Addressed paving Hage Drive. This is a ½ mile road with 29 units. Preliminary
costs estimate at $4,000 per unit. However, there are things that the City could
look at to reduce the costs through city participation and in house maintenance.
This could reduce the cost to an estimate of $3,000 per unit.
Mayor Guenthner opened the floor to public comments:
Neeme Marcus, Trail Haven – Take into consideration that when the city paves
roads, the density rules change.
Randy Eckhoff, Chisholm Trail - Different road bases need different treatments.
City should figure out the problem, then fix it. In the 17 years this is the worse the
roads have been. Feels that they
are being pressured into looking at
paving the road.

Patrick Roehl, Hage Drive – Road is worse then ever, perhaps quality of product
was better before then it is now. Stated that his road was not sprayed the second
time and that it doesn’t do any good to call the City. The ditches need to be
cleaned out.
Mike Savitski, Hage Drive – Would like to work together with the City to see the
costs of paving Hage Drive reduced.
Rick Roberts, Chisholm Drive – Challenged anyone to drive on Chisholm, will
not pay for dust control.
Marvin Herwig, Fox Valley Drive – Would like to see his road graveled and then
update it to bituminous.
Wayne Whetston, Hage Drive – Over the last several years the roads have gone
down, this year is a disaster. Paving the road with a contribution from the city will
be advantages to both.
Ernest Underwood, Chisholm Trail – This is the worst year, there is gravel in the
yards, can’t mow. What is going to be done?
Mr. Eckhoff presented pictures of Chisholm Trail.
Patricia Saxton, Chisholm Trail – In 1999 the dust control was successful, this
year there is 8 inches of mud at the end of her driveway.
Ken Hage, Hage Drive – There has been more problems on Hage since they
started putting dust control material on it.
Gerald Wickham, Schutte Road – There are six additional property owners that he
feels are affected by Schutte Road and should be added to the assessment.
Dennis Stieg, Stieg Road – Emphasized that in his area there are residents that use
the road, but are not assessed. Should spread the assessment to all that use it.
Glen Kero, Hage Drive – Questioned if other material such as crushed concrete or
limestone could be used on the road. City enforcing septic compliance and now
paving the road, these things cost the residents money.
Bill Halverstadt, Old Settlers Road – Placement of dust control holds the gravel in
place, cuts down on the dust, and has been successful on their road. In favor of
continuing with dust control, but perhaps the Engineer should look at the mixture
that is being used.
Judy Sicora, Lily Pond Lane –
Opposed to spraying the roads.
How does this affect the ground
water? What about other
substitutes, such as an asphalt
mixture? Soybean soap is used in
Kansas, why not here.
Doug Fiore, Hage Drive – Rather
then another layer of gravel and
dust control would like to see
pavement.

Erick Heinz, Cain Road – Would like to see more city involvement.
Dean Strehler, Strehler Road – Would like to see it done on their road.
Jerry Aksteter, Fox Valley Drive – Their road was in good condition after it was
graded and had dust control, but now it is in very poor condition, it needs more
gravel.
Dennis Stieg, Stieg Road – In defense of the road crew it is very difficult to
control the heights of the plows; this is part of living on a gravel road.
Doug Fiore, Hage Drive – Would like to see maintenance monies for paved roads.
Joanne Faue, Horseshoe Trail – The plows took off her sod in front of her house.
Kevin Tabor, Gleason Road – Questioned what a low maintenance road is, as part
of Gleason Road is signed as a low maintenance road.
Public Works Director Meister – Raised the clay content in the gravel last year.
Roads are sloppy until it dries out. The dust control material draws moisture. The
frost line is down about eight inches, that’s why there is 8 inches of slop.
Mike Savitski, Hage Drive – What can the residents do to help the city pave Hage
Drive?
No further comments were heard.
MOTION by Gmach, seconded by Thomas, to adjourn the public hearing, 8:30
p.m. Voting Aye: Bucher, Gageby, Gmach, Guenthner and Thomas. (Motion

Regular Council Meeting Continued
The council and staff responded to the comments that were made during the
hearing.
It was a milder winter, roads were
not frozen when snow fell,
chloride also keeps roads from
freezing, and is more prone to
producing ice. Addressed the need
to keep ditches clean from debris
and trees. Trees also provide
shade, not allowing the roads to
dry out as efficiently. Tiling is
some areas would be beneficial.
Using a different gravel gradation,
i.e. larger rocks, may help bridge
the material. Alternatives to the
calcium chloride have been tried,
black magic, soybean soap, pickle
juice, etc. Those did not work.
Calcium Chloride
environmentally safe? The U of M
says yes, the Watershed says they
see contamination from deicing
salt, which is similar to the
chloride. Overall, there is no
environmental concerns.
Limestone acts very much like
class 5 gravel, however it would
cost 2 – 3 times more. Over the
years, the quality of class 5
material has declined. Dust
Control is not an end run to force
people to pave their roads. Need
to look at the environment and the
lifestyles of what people want.
Paving is expensive and do not
want to jeopardize some one from
staying in Corcoran.

Regular Meeting Continued
Responses to Public Comments
Discussion on moving forward. Re-gravel and grade Chisholm. Eliminate
Chisholm and Hage from the assessments. They can proceed with voluntary
program if so desired. Exclude Trail Haven between CR 50 and CR 10. Eliminate
81st Place, based on the petition received. Continue dust control on Rush Meadow
Lane, regardless of petition to exclude, it had been petitioned for during the public
hearing last year, and no one was present to address the assessment this year.
MOTION by Thomas, seconded by Gmach, to approve Resolution 2002-17,
providing dust control based on Option #2 of the assessment role, with the
elimination of Trail Haven, Hage Drive, Chisholm Trail, and 81st Place, and a city
contribution of $30,000. Voting Aye: Bucher, Gageby, Gmach, Guenthner and
Thomas. (Motion Carried)
Addressed how to proceed
forward with making
improvements to roads such as
Hage and other residential cul-de-
sacs. Staff was directed to
provide an outline on procedures
at the next meeting.
Mayor Guenthner called a five-
minute recess. Meeting was then
reconvened.
Mayor Guenthner announced that
the UMC project on the agenda
would not be addressed. A
meeting will be held with the City
and UMC on Friday, April 12, at
8:00 am with the interested
parties.
Dan Lange addressed the council
on his concerns with drainage
from the Kidnation site. One of
the building inspector’s informed
him that a certificate of occupancy
should not have been given until
the mound area had been graded
properly. Now there is water on
the north side of the site coming
onto his property.
Krystal Zimmerman, owner of
Kidnation, responded that the
mound runs east to west entirely
on their property, has nothing to
do with the Lange property.
Mayor Guenthner observed that
the city can try to resolve
disputes, but we are not the courts,
the city is limited in solutions.
Need to look at how this affects
the taxpayers as a whole, what is
fair to the community. Without a
solution offered from the property
owners, the council cannot solve
the problem. There is a mediation
service that could be utilized by
both parties, but it would not be

appropriate to spend city funds for the service.
Dan Lange commented that the City is involved with what occurred.
Tim Zimmerman stated that the trees and berm they have on the north side of their
property hold the snow as it drifts across the field, causing the melting in the
spring.
Mayor Guenthner informed Mr. Lange that he can keep asking to be placed on the
agenda however we are not getting anywhere. Therefore, the city will move
forward on the agenda.

Mr. Lange disrupted the meeting
and Mayor Guenthner requested
Police Chief Schutte to escort Mr.
Lange from the meeting.
Krystal Zimmerman stated that
she feels they are being harassed
by Mr. Lange. Manure has been
mounded next to the day care. His
actions are affecting her business.
Mayor Guenthner recommended
that they consult with an attorney.
Reviewed the final draft of the
Comprehensive Plan. The council
identified edits they want made
prior to submittal to the
Metropolitan Council. Once it is
submitted to the Met Council they
have 10 days to respond if the
plan is not complete. It then goes
through a 60-day review process,
including submittal to the adjacent
cities, school districts in the City
and Hennepin County. A routing
letter from Mayor Guenthner will
accompany the Plan, which will
invite the superintendents to
contact the Mayor regarding the
Plan.
Addressed the placement of a
moratorium on areas within the
city during the review of the
Comp Plan. Staff was directed to

prepare material for review at the next meeting.
Addressed the Financial Analysis. The council concurred that the analysis could
be placed on the consent agenda from this point forward, as it can be removed if
the council has questions or issues with the analysis.
Addressed the CUP application for a trucking operation on Belle Street that is
presently being considered by the City of Greenfield. Staff was bringing this to
the Council’s attention, as is affects Pioneer Trail. Staff was directed to send a
letter to Greenfield identifying that the city does have road restrictions on Pioneer
Trail which are enforced, and that a trucking business in that location should be
discouraged.
Mayor Guenthner announced that the Council would hold a closed session on
April 25, 2002 at 6:30 p.m.
MOTION by Bucher, seconded by Thomas to adjourn the regular council
meeting, 10:35 p.m. Voting Aye: Bucher, Gageby, Gmach, Guenthner and
Thomas. (Motion Carried)
