The Pledge of Allegiance was said. MOTION by Gmach, seconded by Thomas, to approve the agenda. Voting Aye: Bucher, Gageby, Gmach, Guenthner and Thomas. (Motion Carried) Open Forum – No one. MOTION by Thomas, seconded by Bucher, to approve consent agenda items 5.a. January 10, 2002 Council Minutes; 5.b. Claims as Presented; and 5.d. Corcoran Jaycee’s Gambling License Renewal (Resolution #2002-03); and remove item 5.c. Capital Equipment Certificate Purchases for discussion. Voting Aye: Bucher, Gageby, Gmach, Guenthner and Thomas. (Motion Carried) Discussed the Police Chief vehicle proposed in the equipment certificate purchase program. It is proposed to sell the two crown victories through a bid process and retain the jeep for use as a back up vehicle. Chief Schutte is looking into acquiring a vehicle that will meet the needs and demands of a chief’s vehicle. MOTION by Gmach, seconded by Bucher, to approve the equipment certificate purchases as reported. Voting Aye: Bucher, Gageby, Gmach, Guenthner and Thomas. (Motion Carried) Reviewed the UMC / Tomann Family request. Engineer Vander Top gave a brief overview of the proposed infrastructure expansion options. Paul Donna with Juran & Moody and Joanne Foust with Municipal Development Group identified the various financial tools that can be utilized by the city and the developer to assist in the proposed project. Addressed the time frame for proceeding and the need to complete the Comp Plan. Staff identified the next steps to be completed: a letter to Medina regarding the pursuit of the infrastructure expansion and the preparation of financing options and cash flow analysis for the project costs. MOTION by Thomas, seconded by Gmach, to accept the recommendation from staff and authorize the preparation of a letter to the City of Medina and the financial data. Voting Aye: Bucher, Gageby, Gmach, Guenthner and Thomas. (Motion Carried) Planner Sherman reviewed the proposed zoning ordinance amendments affecting landscape standards, impervious surface and outside storage. Any comments that the council has regarding the ordinances are to be forwarded to the planning commission with the draft ordinances. The Planning Commission will review these at their February meeting, with the public hearing tentatively scheduled for March, with final review by the council at the end of March. Planning Technician Jones provided an overview of the land use applications submitted by Hope Community Church. There are two applications before the council. The first application is for the preliminary and final plat of Hope Place, consisting of two buildable lots and two outlots. Voting Aye: Bucher, Gageby, Gmach, Guenthner and Thomas. (Motion Carried) The second application is for a Conditional Use Permit and site plan for the construction of a church on lot 1, block 2 of Hope Place. Several findings and conditions were incorporated into Resolution No. 2002-05, as identified by the Planning Commission and staff. MOTION by Gageby, seconded by Thomas, to approve Resolution No. 2002-05 approving the conditional use permit and site plan for the Hope Community Church, with an amendment to the General Conditional Use Criteria, subparagraph d, stating that the church is a permitted use by CUP under the current zoning. Voting Aye: Bucher, Gageby, Gmach, Guenthner and Thomas. (Motion Carried) The council clarified and noted for the record, that by granting approval of the plat and the construction of the church, that it was in no way a guarantee for any additional development within that area. MOTION by Bucher, seconded by Thomas, to award the quote to G.L. Contracting for the Rolling Hills Road ditch clean up, in the amount of $13,237.56, as the lowest responsible responder. Voting Aye: Bucher, Gageby, Gmach, Guenthner and Thomas. (Motion Carried) Clerk Vergin provided a year-end analysis of the city’s budget. Recommendations for various fund transfers and balances were made. This information will be brought back to the council on February 14 for formal action. Planning Tech Jones updated the council on the status of the home occupation mailer. 54 respondents have been sent an application. The deadline identified on that application is February 15. The council directed Jones to provide an update after the deadline containing more descriptive information on what is being provided to the city. The council discussed the establishment of a subcommittee for the completion of the comprehensive land use plan. It was the consensus of the council to have the subcommittee consist of the full council and three planning commission members, those being Lymangood, Ebert and Hanson. All members of the planning commission will be encouraged to submit written comments on the plan to the subcommittee. Noticed that the Comp Plan Subcommittee will meet on February 5 and February 19, 2002 at 7:00 p.m. in the council chambers. Councilor Bucher addressed code enforcement. The City needs to establish a plan for the enforcement of the home occupation ordinance. Need to identify businesses or properties that have generated the most complaints. This will be pursued while processing the applications.
