APPROVING VACATION OF DRAINAGE AND UTILITY EASEMENTS ON OUTLOT A, FERN
MEADOWS (PID 03A 19=23-13=0002) (CITY FILE NO. 21-005)
WHEREAS, Rains Properties, LLC ("the applicant") has requested approval of an easement
vacation on the lot legally described as:
Outlof A, Fehn Meadows
WHEREAS, the applicant has been working to establish a wetland bank on the property: and
WHEREAS, approving agencies require a perpetual conservation easement over the wetland
bank in favor of the State of Minnesota; and
WHERAS, the easement must be unencumbered by existing drainage and utility easements;
WHEREAS, the applicant has requested vacation of the existing easement legally described as
follows:

WHEREAS, the Corcoran City Council considered this item at a Public Hearing;
WHEREAS, notice of the public hearing was mailed to all landowners of property directly
abutting the area to be vacated and fi0 all utility companies serving the area;
WHEREAS, notice of the public hearing was published in the official newspaper;
WHEREAS, the City finds that the existing drainage and utility easements are no longer
required as new easements will be dedicated with this resolution; and
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
CORCORAN, MINNESOTA, that it should and hereby does approve the following vacation,
subject to the following conditions:
1. The easement vacation is approved, in accordance with the plans and application
received by the City on January 25, 2021, except as amended by this resolution.
2. The applicant must comply with the conditions in the City Engineer's memo dated March
17, 2021.
3. The applicanfi must dedicate new drainage and utility easements over the proposed
wetland areas.
4. Prior to release of the vacation resolution for recording, the applicant must provide a
copy of the new easement for City review and approval.

Vacate all drainage easements dedicated in the plat of FERN MEADOWS, lying within Outlot A
of said Fehn Meadows, according to the recorded plat thereof, Hennepin County, Minnesota,
except therefrom the 2 easement areas described as follows:
Exception 1 (drainage easement to remain)
Commencing at the northwest corner of said Outlot A; thence South 01 degree 45 minutes 38
seconds Wesfi, plat bearing, along the
west line of said Outlot A, a distance of 273.00 feet to the
point of beginning; thence South 88 degrees 14 minutes 22 seconds East, a distance of 40.00
feet; thence South 01 degree 45 minutes 38 seconds West, a distance of 168.90 feet; thence
North 88 degrees 09 minutes 37 seconds West, a distance of 40.00 feet to said west line of
Outlot A; thence North 01 degree 45 minutes 38 seconds East, a distance of 168.85 feet to the
point of beginning.
Exception 2 (drainage easement to remain)
Beginning at the southeast corner of said Outlot A; thence South 89 degrees 59 minutes 44
seconds West, plat bearing, along the south line of said Outlot A. a distance of 195.00 feet;
thence North JO degrees 56 minutes 35 seconds East, a distance of 166.00 feet; thence North
58 degrees 01 minute 45 seconds East, a distance of 137.00 feet to the east line of said Outlot
A; thence South O 1 degree 45 minutes 08 seconds West, a distance of 215.00 feet to the point
of beginning.

5. The applicant must record the resolution approving the vacation at Hennepin County and
provide proof of recording to the City.
6. The applicant must record the new easement at two County and provide proof of
recording to the City.
